010891-Special Organizational M4OO MINUTES City Commission, Sanford, Florida JANUARY 8, Meeting on January 8, 1991 at 7:00 P.M. in the City Manager's Conference Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith. Commissioner Whitey Eckstein Commissioner Robert B. Thomas Commissioner A. A. McClanahan Commissioner Lon Howell City Attorney William L. Colbert City Manager Frank A. Faison City Clerk Janet R. Donahoe The Chairman called the meeting to order. There being no further old business to be transacted by the outgoing board, Commissioner McClanahan moved that the meeting adjourn sine die~. Thomas and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Seconded by Commissioner City Clerk administered the Oaths of Office to Commissioner-Elect Whitey Eckstein and Commissioner-Elect A. A. McClanahan, each signed the Oath and Acceptance of Office and was seated a Commissioner of the City of Sanford, Florida. City Attorney reported that at the Regular Meeting of December 17, 1990, the City Commission accepted City Manager Frank A. Faison's resignation, that a local newspaper quoted severance pay in amount of $69,000.00, which was incorrect, that Personnel Director Tim McCauley prepared a memo outlining the benefits Mr. Faison is entitled to, that. he has reviewed same, and concurs with said amount, which has been passed on to the accounting department, that the correct amount is less than half of what was reported in the paper, and that the correct amount of severance pay has not yet been published. Further, Mayor Smith was asked to contact the Florida League of Cities for assistance in screening potential candidates for the position of City Manager, and to meet with Personnel Director Tim McCauley to prepare an advertisement for said position, which has run in various State and National publications. Further, Florida City Managers' Association has a Range Rider Program, which is comprised of retired City Managers, who assist Cites, at no cost, in providing guidance on screening committees, that the program has proven to be successful in the past, and that said procedure is recommended by the ICMA and Florida League of 'Cities.''- Also, Seminole County has used a Consulting Firm from Georgia to search for a Manager, and that said service has cost $17,500.00. Commissioner Eckstein moved to appoint Director of Engineering and Planning, William A. Simmons as City Manager. Seconded by Commissioner Thomas. Commissioner McClanahan stated that it would be premature to offer Mr. Simmons the position, that he could not support said appointment at this time, and that Mr. Simmons should submit his application if he is interested in said position. Commissioner Thomas stated that Mr. Simmons knows more about the workings of the City than anyone else, and that there is no one better qualified to lead the City. Commissioner Howell stated that he has received several phone calls from Sanford citizens recommending Mr. Simmons, and that he deserves a shot at it. Mayor Smith asked Commissioner Thomas and Commissioner Howell if they thought it would be in the City's best interest not to screen other applications; both Commissioners answered in the affirmative. MINUTES City Commission, Sanford, Florida 3ANUARY 8, City Attorney reported that he did not anticipate the City Commission taking any action tonight regarding same, that he was not sure whether it would be appropriate to appoint Mr.'Simmons tonight because this item was not on the Agenda for discussion, however, that he would try to enforce the will of the majority of the Commission. Mr. Simmons reported that he would be submitting his application. Commissioner McClanahan moved to table taking any action. Motion died for lack of a second. City Attorney asked Commissioner Eckstein and Commissioner Thomas if it was their intent to hire Mr. Simmons as City Manager, and, if so, acceptable terms of employment such as salary and benefits would need to be negotiated. Also, in the event Mr. Simmons leaves a tenured civil service position to become City Manager, would he be allowed to return to said position. Commissioner Eckstein and Commissioner Thomas concurred that the motion was to offer the position of City Manager to Mr. Simmons, that the salary and benefits would be what Frank Faison is presently receiving, and that the terms of said employment would be renegotiated at the 1991/92 budget work sessions. Mr. Simmons reported that he is very interested in the position, that he would like to be the City Manager for Sanford, and requested that various items regarding the re- organization of the Planning and Engineering Department be addressed with a member of the City Commission, and brought back to the Commission for final approval. Commissioner Eckstein restated the motion to offer the position of City Manager to Mr. Simmons, subject to the negotiation of an appropriate contract which would contain employment matters, and subject to appropriate re-organization of the Planning and Engineering Deparment, with said contract and re-organization to be brought back to City Commission for final approval. the Commission as follows: Seconded by Commissioner Thomas and carried by the vote of Mayor Smith Nay Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Nay Commissioner Howell Aye The Mayor reported that the fourth Monday in May, a Regular Meeting day, falls on Memorial Day, a City holiday. The consensus of the Commission was to decide upon an alternative meeting date at the Regular Meeting of January .14, 1991. Commissioner Howell moved to appoint Karl Stairs to the Board of Adjustment. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner.'Howell Aye The Mayor reported that the Mardi Gras Ribbon Cutting Ceremony will be held on February 8, 1991 at 5:00 P.M. Commissioner Eckstein reported that Altamonte Springs has a open bid policy, and proposed that the seven cities within Seminole County meet to discuss what items they are interested in purchasing, and that all seven cities be given the opportunity to bid together. Commissioner McClanahan proposed that when there are local suppliers of an item, only local merchants, who pay local taxes, be given the opportunity to bid. City Attorney reported that he did not know whether it would be legally appropriate when advertising for bids, to restrict the boundary where bids are accepted, that the Commission needs to be careful because the .bid would not always be awarded to the lowest bidder, and, therefore, might be viewed as wasting tax payers money. City Manager reported that bids are always advertised when the item to be purchased exceeds a certain limit, and that the City has annual bid contracts; most of which are local. Commissioner McClanahan proposed that the Restricted Purchase Order limit be City Attorney reported that he will research the legal ramifications should the Co~ission wish to consider changing City Purchasing policy, and will report back to the Co~ission. Co~issioner Howell asked how many employees are needed to maintain the softball and baseball fields, and if there is anything that can be done regarding the stickers on those fields. Parks Director, Jim Jerigan reported that currently, there is one fulltime employee available to work on said fields, that two employees are needed, and that there are twelve maintenace workers on staff. Further, there is not enough manpower to remove the stickers in a timely manner, however, Staff is in the process of trying to solve the problem. Co~issioner McClanahan asked if the Co~ission is in favor of reimbursing expenses incurred by members of the Co~ission for state-wide co~ittee meetings, or if the Co~ission would prefer that the members of the Co~ission not serve on those co~ittees. The Consensus of the Co~ission was to reimburse said expenses. There being no further business, the meeting was adjourned. R Attest:
