The Chairman called the meeting to order.
A public hearing was held in accordance with Notice published in the Sanford Herald
on March 4, 1991 as follows:

The City of Sanford proposes to change the use of the land within the
area shown in the map of this advertisement.
A public hearing on the proposal will be held on Monday, March 11, 1991,
at 7:00 o'clock P. M. or as soon thereafter as possible, by the City
Commission of Sanford, Florida, in the City Commission Room, City Hall,
Sanford, Florida. The City Commission will consider revisions to the
Comprehensive Plan.
Interested parties may appear at the meeting and be heard regarding the
transmittal of the proposed plan amendment to the State of Florida
Department of Community Affairs.
Copies of the proposed revisions to the Comprehensive plan are available
at the Department of Engineering and Planning and at the City Clerk's
Office, City Hall, Sanford, Florida, and may be inspected by the public.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed 1991 Revised Comprehensive Plan.
City Planner Jay Marder appeared and reported that the City Commission has had the
opportunity to review said Plan, and that pursuant to the public participation program,
approximately 10,000 City of Sanford utility customers were providing information regarding
same. Further, City Planner recommended that the City Commission transmit the 1991 Revised
Comprehensive Plan to the Department of Community Affairs, recognizing that the Goals,
Objectives and Policies are the actual "Plan" recommended for adoption, and that the Data,
Inventory and Analysis reflects necessary support documentation that is not actually adopted,
and that the City Commission authorize Staff to accomplish additional corrections and
modifications as may be necessary and appropriate prior to such transmittal.
Recommendation submitted from Pl.anning and Zoning Commission to approve said First
Amendment of 1991 to Comprehensive Land Use Plan.
The Chairman announced that the second public hearing will be advertised and held
in September, 1991, to consider the adoption of said 1991 Revised Comprehensive Plan.
On recommendation of Planning and Zoning Commission, Commissioner Howell moved to
authorize Staff to transmit said 1991 Revised Comprehensive Plan to the Department of
Community Affairs, and authorized Staff to accomplish additional corrections and
modifications as may be necessary and appropriate prior to such transmittal. Seconded by

The Commission next held a public hearing to con~ider the condemnation of
structures or buildings under Condemnation Report No. 91-01, 1226-1228 West 13th Street,
Morris Roundtree, owner. The Chairman announced that the Commission would hear from those
persons present to speak regarding said property. No one appeared.
After consideration, Commissioner Howell moved that finding the building under
Condemnation Report No. 91-01 to be unsanitary, unsafe and dilapidated, that structure be
condemned and the owner given 30 days in which to repair or demolish said structure; and if
the structure is not repaired or demolished within 30 days, to authorize the City to demolish
same and levy a lien against the property. Seconded by Commissioner Thomas and carried by

The next item of business was consideration of a request from Willie Edge to
purchase City owned surplus property (the east 1/2 of Lot 10, Block 9, Tier D, Town of
Sanford.) On recommendation of City Manager, Commissioner McClanahan moved to authorize
execution of Contract dated February 26, 1991 with Willie Edge, in amount of $962.50.

The next item of business was consideration of a request to continue Civil Service
System by the adoption of an ordinance regarding same.
City Attorney reported that last year the legislature provided a "sunset"
provision, whereby all State enacted Civil Service Systems will expire July 1, 1991, and
therefore, unless the City Commission adopts an ordinance prior to said date, City employees
will not have a Civil Service System.
On recommendation of City Manager, Commissioner McClanahan moved to continue said
Civil service System, and authorized City Attorney to prepare the proper ordinance regarding
same. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows:

The next item of business was consideration of a request to regrade "Special
Handicapped Custodial Workers. On recommendation of City Manager, Commissioner Howell moved
to regrade Special Handicapped Custodial Workers from Level 01-13 to 01-06, with wage
increase from $3.80 per hour to $4.25 per hour, effective April 1, 1991, to meet Federal

The next item of business was consideration of Drug Screening Contract with Roche
Biomedical Laboratories for FY 91/92, which was discussed at 5:00 P.M. Work Session. On
recommendation of City Manager, Commissioner McClanahan moved to renew said Drug Screening
Contract for FY 91/92 with Roche Biomedical Laboratories in amount of $26.00 per screening,
to include GCMS Confirmation at no additional charge. Seconded by Commissioner Thomas and
carried by the vote of the Commission as follows:

The Commission next discussed a request to approve funding for Hepatitis "B"
vaccinations for all "at risk" Police and Fire Personnel. Memo dated February 25, 1991,
submitted from Personnel Director Tim McCauley, regarding same.
Police Chief Steve Harriet reported that vaccinations would initially be provided
for patrol division officers, that clerical workers would not be included, and that a more
realistic cost figure for said vaccinations would be $14,000.00 rather than $20,000.00.
Mayor Smith asked if sanitary sewer workers should also be immunized.
Public Workers Director Jerry Herman reported that there are approximately 50
sanitary workers including plants workers.
City Commission directed City Manager to obtain additional information regarding
the risk factor involved for sanitary/utility workers, the number of employees at risk, the
estimated cost, and report back to the Commission at the March 25, 1991 Regular Meeting.
Commissioner Eckstein asked if the OSHA mandate has the same effect as law.
City Attorney reported that OSHA regulations are federal regulations that can
affect workers, that said regulations are not considered law, however, if said regulations
apply to City workers, the City of Sanford would be subject to liabilities and/or penalties
for failure to abide by said regulations, and that such expenditure of City funds would be
lawful and appropriate to protect the health and safety and welfare of City employees.
On recommendation of City Manager, Commissioner Eckstein moved to provide Hepatitis
"B" vaccinations for all "at risk" Police and Fire personnel, said vaccinations to be
performed by Seminole County Health Department; with FY 90/91 funds in amount of $20,672.00
to be transferred from General Fund Reserves, and FY 91/92 funds in amount of $1,700.00 to
be included in FY 91/92 Police and Fire Department budgets for continued implementation.

Conklin, Porter and Holmes, for sale of remaining validated Water and Sewer Revenue Bonds.
On recommendation of City Manager, Commissioner Thomas moved to authorize Staff to obtain
Utility Rate Analysis Study as an Additional Service under Continuing Engineering Services
Agreement with Conklin, Porter and Holmes; said Utility Rate Analysis Study in amount up to
$13,000.00, to be funded by remaining validated, but unsold bonds plus possible short term
financing. Seconded by Commissioner Howell and carried by the vote of the Commission as

The next item of business was consideration of Contract with Hughes Design
Associates for Recreational Planning Studies. On recommendation of City Manager,
Commissioner McClanahan moved to authorize execution of Contract in amount of $1,200.00 with

Planning Studies for Hovnanian Park.

The Commission next considered Lease Renewal with CSX Transportation for right-of-
way for reclaimed water distribution system pipeline located between Elliott Street and
Summerlin Avenue.
Commissioner Eckstein moved to authorize City Attorney and Staff to proceed with
negotiations with the Woodruff Heirs to purchase said property whereby title would be
transferred to the City of Sanford. Seconded by Commissioner Howell.
City Manager reported that the present lease will expire shortly, that two years
ago Staff considered purchasing said right-of-way, but did not pursue because a reverter
clause existed, and that the Railroad offered only a quit claim deed, and, therefore,
recommended that the Commission approve lease renewal, and authorize Staff and City Attorney
to proceed with negotiations to acquire said property.
City Attorney reported that there would not be enough time to identify, contact and
negotiate with the Woodruff Heirs and the Railroad prior to lease expiration on April 30,
1991, and recommended that the City Commission authorize lease renewal fOr a period of one
year, and authorize City Attorney and Staff to identify, contact and negotiate with the
Woodruff Heirs and the Railroad to acquire title regarding said property.
After discussion, the Mayor called for the vote on the aforesaid motion to
authorize Staff and City Attorney to pursue negotiations with the Woodruff Heirs to purchase

The next item of business was consideration of a request from Community Development
Officer to approve CDBG Emergency Repair Program Guidelines, and to amend City Rehabilitation

The next item of business was consideration of a request from Helen L. Stairs,
Stairs Property Management & Realty Inc., for a variance regarding the property located at
606 Park Avenue whereby said property could be utilized as a multi-family dwelling.
Commissioner Howell moved to approve said variance to use the property located at
606 Park Avenue as multi-family dwelling, with stipulations as follows:
1. The subject property to remain a six unit apartment building.
2. The apartments will be offered under a one year lease.
3. The apartments will be managed by a local management firm.
4. One of the apartments will be reserved for the owner.
5. Rental rates, market allowing, to be from $350.00 to $375.00 per month.
6. Central heat and air to be added.
7. Each unit to be refurbished with new appliances in kitchens and new fixtues
in bathrooms.
8. Each unit will have a functional fireplace, as each unit has a fireplace at
present.

City Attorney reported that the City Commission has the authority to accept said
offer, however, acceptance of same could be considered precedent. Further, if the property

recommended that the City Commission authorize expenditure of funds up to $3,000.00 for said
