The first item of business was continuation of a public hearing to consider closing, vacating and abandoning a portion of a utility easement lying between Sanora Boulevard and Stenstrom Boulevard and between Sanford Avenue and Hunt Drive, Mark Leppla, owner, tabled at June 24, 1991 Regular Meeting. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed utility easement closing. No one appeared. Recommendation submitted from City Planner to approve subject to compatible and matching surface materials, matched roof lines and written confirmatiOn of approval from the Sanora Community Association Board prior to the issuance of a building permit. The Commission next considered a request from Seminole County Expressway Authority, for right-of-way use permits over a portion of American Boulevard and unopened State Street, as discussed at tonight's Work Session. On recommendation of City Manager, Commissioner Thomas moved to authorize said right'of-way use permits for the north end of existing Americana Boulevard and a portion of unopened State Street, for st°rmwater retention pond and an off-ramP, with decision whether or not to fence retention pond to be determined during early stages of construction, and with the stipulation that the Expressway Authority pay for any relocation of existing utilities necessitated bY their use of said right-of-ways. Seconded by Commissioner McClanahan and carried by the Vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Mayor Smith stated that she is Chairman of the Seminole coUnty Expressway Authority, and that she will not receive any personal gain from this vote. The Commission next considered a request from the City of Lake Mary, to adopt a resolution requesting the Florida PublicService Co~mission review the local service calling area; and requesting said service area be extended to Orlando and Apopka locations with no increase in the basic local service fee or the local service base rate, as discussed at tonight's Work Session. Commissioner Thomas moved to authorize City Attorney to prepare a resolution regarding same. On recommendation of City Manager, Commissioner Thomas moved to approve the purchase of said 4-wheel drive vehicle, as described in memo dated June 19, 1991, from Utility Director, necessary for inspection/engineering review of "Site 10" Seconded by Commissioner McClanahan and carried by the vote of the Commission construction. as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye The next item of business was consideration of Joint Agreement with Seminole County School Board for construction of a Swimming Pool Complex, as discussed at tonight's Work Session. On recommendation of City Manager, Commissioner Thomas moved to authorize the execution of said Joint Agreement with Seminole County School Board for construction of a Swimming Pool Complex in amount of $1,200,000.00; City cost approximately $600,000.00, said Agreement to contain a clause whereby the City will have the right to opt out shoUld the Bond Referendum not pass. On recommendation of City Manager, Commissioner Howell moved to authorize the execution of said agreement with Insituform Southeast, Inc. in total estimated amount of $57,102.50, for sewer renovation on First Street from Avocado Avenue to Poplar Avenue, and Highway 17-92 between 18th Street and 19th Street. On recommendation of Acting City Manager, Commissioner Thomas moved to authorize water service, with petitioner to pay applicable water system fees, and to record the Annexation Petition and annex said property when annexable. The Commission next considered Board appointments/re-appointments as follows: Youth Advisory Committee: The City Clerk reported that the terms of Bob Lundquist, Jennifer Campbell, Katherine Williams and Moses Aviles expire July 22, 1991, and that the Committee would like to make recommendations for appointment/re-appointment when it meets again, in September. The Commission took no action. Fire Pension Board of Trustees: The City Clerk reported that Eric Kip Parshall has been elected to replace Larry E. Helman, and that said appointment needs to be confirmed. Commissioner Eckstein moved to confirm the appointment of Eric Kip Parshall to the Fire Pension Board of Trustees. On request and recommendation of City Manager, Commissioner Howell moved to decline Tourist Development Council funds grant for the Beachfront Project, and to request that the Tourist Development Council consider using said funds on the General Sanford Museum/Library project, as discussed at tonight's Work Session. On recommendation of City Attorney, Commissioner MoClanahan moved to authorize the Mayor to execute said Waiver. The Commission discussed the use of illegal fireworks in Sanford, and directed City Staff and City Attorney to research the feasibility of amending City ordinance to prohibit the sale of all fireworks from temporary structures, and to report back to the Commission in 60 days with comments and recommendations. Mr. Balzer, 222 Bradford Drive, appeared and reported that it will not be easy to prevent illegal fireworks from being transported into the City.
