082691-Regular Meeting102 MINUTES City Commission, Sanford, Florida AUGUST 26, The City Commission of the City of sanford, Florida met in Regular Meeting on Monday, August 26, 1991 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Colbert City Manager William A. Simmons City Clerk Janet R. Donahoe The Chairman called the meeting to order. Mayor Smith announced that the City of Sanford received a Certificate of Appreciation for participating in the Florida League of Cities 1991 Innovative Showcase, and presented said Certificate to Bill Marcous, for the video he produced regarding wastewater. A public hearing was held in accordance with Notice published in the Sanford Herald on August 21, 1991, as follows: PUBLIC NOTICE The Sanford Airport Authority will meet jointly with the Sanford City Commission to consider the Airport Authority's annual budget on August 26, 1991, at 4:30 P.M. at the City Commission Chambers. Persons or agencies having an interest in the budget are invited to attend the meeting. Publish: August 21, 1991 The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the Sanford Airport Authority's proposed FY 91/92 Budget. No one appeared. City Manager reported that at tonight's Work Session, the Airport Authority reported revisions to their FY 91/92 Budget: 1) the deletion of a COLA, 2) changes in personnel costs, and 3) a $10,000.00 line item for City services for the next fiscal year, but that no written copies of said changes have been received. Commissioner McClanahan moved to approve the Sanford Airport Authority's proposed FY 91/92 Budget, subject to receipt of written confirmation of the aforesaid changes. Said motion died for lack of a second. Commissioner Eckstein moved to continue the public hearing, pending receipt of revised budget, with inclusion of said changes. Nikki Clayton, Attorney with Baker and Hostetler, representative for Waste Management of Florida, appeared and reported that she does not oppose Ordinance No. 3071, and that she has not had enough time to form an opinion on the approach the City is taking. Further, Waste Management is a commercial hauler, which has- found great success in cooperating with Cities and Counties throughout Florida that are undertaking programs dealing with Solid Waste. Further, it is not their intent to defeat the program, but to cooperate and help determine measuring sticks, which will assist the City in determining whether or not the program is succeeding. Commissioner Howell moved on the second reading and adoption of said Ordinance No. 3071. Said resolution being in words and figures as follows: RESOLUTION NO. 1607 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, ORDERING AND PROVIDING FOR THE HOLDING OF A BOND REFERENDUM ELECTION IN THE CITY OF SANFORD ON OCTOBER 8, 1991, ON THE QUESTION OF ISSUING GENERAL OBLIGATION BONDS NOT TO EXCEED $3,300,000.00 FOR RECREATIONAL FACILITIES; PROVIDING FOR SEVERABILITY AND EFFECTIVE DATE. WHEREAS, it is in the best interest of the citizens of the City of Sanford that the City of Sanford construct, in conjunction with the School Board of Seminole County, a public swimming pool to be located on property owned by the School Board of Seminole County at Seminole High School for the use and enjoyment of the citizens of the City of Sanford; and WHEREAS, it is in the best interest of the citizens of the City of Sanford that the City of Sanford construct an Athletic Complex with four (4) lighted athletic fields to be located on property owned by the School Board of Seminole County at Seminole High School for the use and enjoyment of the citizens of the City of Sanford; and WHEREAS, it is in the best interest of the citizens of the City of Sanford that the City of Sanford construct a Community Recreation Center to be located at Pinehurst Municipal Park for the use and enjoyment of the citizens of the City of Sanford; and WHEREAS, the City Commission of Sanford desires to submit to the qualified electors of the City of Sanford on October 8, 1991, the question as to whether or not General Obligation Bonds should be issued to fund the construction of the above-stated recreational facilities for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: AUTHORITY FOR THIS RESOLUTION. This Resolution is adopted pursuant to the Charter of the City of Sanford, Chapter 100, Florida Statutes (1989), as amended; Chapter 166, Florida Statutes (1989), as amended; Article VII, Section 12, Florida Constitution and other applicable provisions of law. 19 91 -": MINU , ~ · City ,Commission, Sanford, Flod SECTION 2: BOND REFERENDUM ELECTION ON FUNDS FOR CONSTRUCTION OF RECREATIONAL FACILITIES FOR PUBLIC PURPOSES. 1. BOND REFERENDUM ELECTION. A Bond Referendum election of the qualified electors residing in the City_ok Sanford is hereby called to be held on Tuesday, October 8, 1991, to determine whether or not the issuance of General Obligation Bonds in an aggregate amount not to exceed THREE MILLION THREE HUNDRED THOUSAND DOLLARS ($3,300,000.00), payable from ad valorem taxes levied at a rate not to exceed one-half of one mill (.50 mill) for a term not to exceed seventeen (17) years on all taxable property in the City of Sanford, shall be approved by such qualified electors to finance the cost of the construction of recreational facilities for public purposes. 2. RECREATIONAL FACILITIES. For purposes of this Resolution the term "Recreational Facilities" shall refer to all three (3) of the following projects: (1) The City of Sanford will construct, in conjunction with the School Board of Seminole County, a public swimming pool on property owned by the School Board of Seminole County at Seminole High School. The estimated cost of the public swimming pool facilities is $1,200,000.00 of which the City of Sanford will pay $600,000.00. (2) The City of Sanford will construct an Athletic Complex with four (4) lighted athletic fields on property owned by the School Board of Seminole County at Seminole High School. The estimated cost of the project is $500,000.00. (3) The City of Sanford will construct a Community Recreation Center at Pinehurst Municipal Park with approximately 26,580 square feet for a gymnasium, weight room, game rooms, staff offices and other facilities. The Community Recreation Center will also include eight (8) lighted tennis courts, a youth baseball field and a stormwater drainage system. The estimated cost of the project is $1,900,000.00. Such purposes described above shall also include other purposes appurtenant, necessary or incidental thereto. SECTION 3: AUTHORIZATION OF BONDS. Subject and pursuant to the provisions hereof, General Obligation Bonds of the City of Sanford, Florida are authorized to be issued in the aggregate principal amount of not exceeding THREE MILLION THREE HUNDRED THOUSAND DOLLARS ($3,300,000.00) to MINUTES 0 9 City Commission, Sanford, Florida AGLJSlJT 76 finance the cost of the recreational facilities generally described in section 2 of this Resolution, including allocations for administrative costs, legal fees, fees of fiscal agents and all other costs associated with the issuance of the bonds. Such General Obligation Bonds shall be payable from ad valorem taxes levied at a rate not exceeding one half of one mill (.50 mill) for a term not exceeding seventeen (17) years on all taxable property in the City of Sanford. None of such Bonds shall be issued for a longer term than twenty (20) years from their date of issuance and such Bonds shall bear interest at such rate or rates not exceeding the maximum rate permitted by law at the time of the sale of the Bonds. SECTION 41 VOTING PLACE. The place of voting for the Bond Referendum election shall be in the Sanford Civic Center, 401 Seminole Boulevard, Sanford, Florida. The polls will be open in accordance with law from seven (7) o'clock a.m. until seven (7) o'clock p.m. on the same day. Ail qualified electors residing in the City of Sanford shall be entitled and permitted to vote in such Bond referendum election. SECTION 51 OFFICIAL BALLOT. The form of ballot to be used shall be in substantially the following form1 OFFICIAL BALLOT CITY OF SANFORD, FLORIDA BOND REFERENDUM ELECTION - OCTOBER 8, 1991 APPROVAL OF BONDS TO FUND CONSTRUCTION OF RECREATIONAL FACILITIES Shall the City of Sanford be authorized to issue not exceeding THREE MILLION THREE HUNDRED THOUSAND DOLLARS ($3,300,000) principal amount of General Obligation Bonds for a term not exceeding twenty (20) years, bearing interest at the maximum legal rate at time of sale and payable from a levy of ad valorem taxes on all taxable property at a rate not exceeding one-half of one mill (.50 mill) for not exceeding seventeen (17) years to fund construction of recreational facilities. YES - FOR BONDS NO - AGAINST BONDS SECTION 6: ABSENTEE VOTING. The form of ballot to be used in the election for absentee voters shall be substantially the form provided in Section 5 above. SECTION 7: PRINTING OF BALLOTS. Clerk on or before the date and time for the opening of the poll for such bond election for the voting place; and, further, is authorized and directed to make the appropriate arrangements for the conduct of the election at the voting place specified. SECTION 8: ELECTION PROCEDURE. The City Clerk shall hold, administer and conduct the Bond referendum election in the manner prescribed by law for holding elections. Returns shall show the number of qualified electors who voted at such bond election on the proposition and the number of votes cast respectively for and against approval of the proposition. The returns shall be canvassed in accordance with law. SECTION 9: ELECTION RESULTS. If a majority of the votes cast at such election in respect to the aforestated proposition shall be "YES - FOR BONDS", such proposition shall be approved and then the particular Bonds, the issuance of which shall be thereby approved, shall be issued as hereafter provided by the City of Sanford. If less than a majority of the' votes cast at such referendum shall be "YES - FOR BONDS", such proposition shall be defeated and no Bonds may be issued and no ad valorem tax shall be levied therefor. SECTION 10: NOTICE OF BOND REFERENDUM ELECTION. Notice shall be first published at least thirty (30) days prior to the Bond referendum election. The publication shall be made at least twice, once in the fifth and once in the third week prior to the week in which the referendum election is held, in the manner provided in Section 100.342, Florida Statutes and substantially in the form attached hereto as Exhibit "A". The Clerk of the City of Sanford is hereby charged with the responsibility of accomplishing the provisions of this Section. SECTION 11: SEVERABILITY. In the event that any word, phrase, clause, sentence or paragraph hereof shall be held invalid by any court of competent jurisdiction, such holding shall not affect any other word, clause, phrase, sentence or paragraph hereof. SECTION 12: EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption. The next item of business was consideration of a request from Richard Casselberry, for a Conditional Use Permit, for property located at 400 South Palmetto Avenue, as discussed at tonight's Work Session; said request was previously denied by the City Commission on May 13, 1991. Mayor Smith asked for a show of hands from those individuals in the audience, who were present regarding said Conditional Use; approximately 15 - 20 individuals raised their hands. Commissioner Howell reported he had researched the building's history, and addressed various issues/concerns presented by Mr. Goff at tonight's Work Session as follows: 1) 400 Palmetto Avenue has three front doors. Commissioner Howell showed pictures of framed vernaculars, none of which have three front doors, and reported all were multi-family homes at one time, and have been converted back to single-family dwellings; 2) The building could very well have been called the "Pray Boarding House" prior to 1887. It is not listed as an apartment house, although 606 Park Avenue is. He also showed pictures of particular apartment buildings from 1926, including 606 Park Avenue. Further, according to an 1860 dictionary, a boarder is a person who has food, diet and lodging in another person's home, and therefore, there would have been only one kitchen, and that if 400 Palmetto Avenue was indeed a boarding house, it would have had one kitchen and a dining room; and 3) It would be strange to have a 106 year old apartment building with 8 bedrooms, 4 kitchens, and 4 bathrooms because apartment buildings in 1887 had outdoor bathroom facilities. Bob Goff, representative for Richard Casselberry, appeared and reported that the earliest registry provided through the museum lists 400 Palmetto Avenue as the Pray Boarding House, that the property has been appraised by a historic architect, who feels confident that this house, which is on the National Historic Registry, was a 4-unit apartment building. Mr. Goff further stated that tie has provided copies of leases and inventory sheets, plus a developer's agreement, which is more stringent than the one required for 606 Park Avenue, and requested permission to put this issue before the Planning and Zoning Commission, to provide him the opportunity to bring professional experts to prove his case. City Attorney reported that City Planner's memo dated August 2, 1991, provides three alternative actions which include: 1) Deny the request for non-conforming use status, and thus deny the ability of the applicant to request a conditional use permit from Planning and Zoning Commission, 2) Permit applicant to request a conditional use permit before the Planning and Zoning Commission, or 3) Approve the applicant's request, with conditions and stipulations. Further, if the Commission believes sufficient information has been provided on which to make a decision, it has the right to do so. Further, both he and Assistant City Attorney recommend that the City participate in the funding of a new contamination assessment study in an amount not to exceed $7,500.00. Also, said study will provide additional information, to determine the extent of contamination and the cost of clean-up regarding same, and to better assess if the City has any liability. Further, in order to claim the exception to liability for assessment and clean-up under Comprehensive Environmental Response, it would be necessary to conclude that nothing occurred prior to 1924 or between 1924 and 1928, which, in his opinion, would be difficult to do without further study.
