Approval of Minutes of August. 6, 1991 Special Meeting, and August 12, 1991
Work Session.
On motion of Commissioner McClanahan, seconded by Commissioner Thomas and carried
by the vote of the Commission as follows:

Authorized payment of statements (1) and (2).
(1) Accepted lowest bid, which met specifications, from S & K Air Power of
Florida, Inc. in amount of $1,681.60.
(2) Accepted lowest bid, which met specifications, from Shoemaker
Construction in amount of $99,990.00, plus any approved change orders
deemed necessary during construction.
(3) AcCepted only bid from Mr. Chandu Davda, Big Oaks Mobile Home Park, in
amount of $2,200.00.
(4) Accepted lowest bid, which met specifications, from Jones Equipment
Company at the rate of $71.94 per flashlight; totalling $5,035.80, to be
funded from Law Enforcement Trust Fund.
C. Approved Minutes of August 6, 1991 Special Meeting, and August 12, 1991 Work
Session.
The Commission acknowledged four lump sum contract invoices approved for payment
totalling $105,714.41.
The Commission next considered Addenduln No. 4, to Contract dated April 10, 1989,
with Solin and Associates in amount of $26,200.00, and Amendment to Contract with
Transportation Consulting Group in amount of $3,400.00. On recommendation of City Manager,
Commissioner Howell moved to authorize the execution of said Amendments, total of both
contracts not to exceed $29,600.00, for preparation of Comprehensive Plan Adjustments in
response to Department of Community Affairs work report. Seconded by Commissioner Thomas
and carried by the vote of the Commission as follows:

The next item of business was consideration of a.request from Building Official to
board-up property at 1210 Randolph Street. On recommendation of City Manager, Commissioner
Thomas moved to authorize Public Works Department to board-up said property as requested.

The Commission next considered Amendment No. 35 to Consulting Engineering Services
Contract dated December 17, 1983, with Conklin, Porter & Holmes in amount of $173,000.00.
On recommendation of City Manager, Commissioner McClanahan moved to authorize the execution
of said Amendment No. 35, for Inflow and Infiltration Analysis for Sanitary Sewage Collection

Commissioner Thomas reported that approximately two weeks ago he spoke with an
Orlando Sentinel Reporter and advised that he would be requesting that City Commission rename
13th Street to Martin Luther King Boulevard, and that he submitted a memo regarding same.
Further, he has talked with merchants along 13th Street in Goldsboro, who like the idea, that
he has received several calls from citizens supporting same, and that they believe it to be
a fine gesture.
Commissioner Thomas moved to rename 13th Street, from Sanford Avenue through
Goldsboro, to Martin Luther King Boulevard. Seconded by Commissioner Eckstein.
After discussion, Commissioner McClanahan moved to table consideration of said
request, and to refer same to the September 9, 1991 Work Session for further discussion.

Commissioner Howell reported that he will be holding a meeting on Wednesday, August
28, 1991, to discuss the unfairness of how property taxes are assessed, and that his attorney
will be present as well. Commissioner Howell moved that the City Commission support said
meeting and invite Bill Suber, Seminole County Tax Appraiser to attand and explain the
assessments. Said motion died for lack of a second.

RESOLUTION NO. 1611
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
ESTABLISHING THE AMOUNT OF FRANCHISE FEE TO BE PAID BY
COMMERCIA~ WASTE FRANCHISE COLLECTORS TO THE CITY OF
SANFORD; ESTABLISHING THE AMOUNT OF RECYCLING FEE TO BE
PAID BY COMMERCIAL WASTE FRANCHISE COLLECTORS TO THE
CITY OF SANFORD; ESTABLISHING THE TERMS AND CONDITIONS
OF PAYMENT OF THE FRANCHISE FEE AND RECYCLING FEE;
PROVIDING FOR SEVERABILITY AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: FRANCHISE FEE. Commercial Waste Franchise Collectors
shall pay to the City a franchise fee. The amount of the franchise fee
shall be 15% of the total billings for all services provided by the
Franchise Collector.

SECTION 3: TERMS AND OO~ITIONS OF PAYMENT OF THE FRANCHISE FEE
AND RECYCLING FEE. The Franchise Collector shall pay the franchise fee and
recycling fee monthly, not later than the 20th day of each month following
the month for which the service is billed.
SECTION 4: SEVERABILITY. In the event that any word, phrase,
clause, sentence or paragraph hereof shall be held invalid by any court of
competent jurisdiction, such holding shall not affect any other word,
clause, phrase, sentence or paragraph hereof.
SECTION 5: EFFECTIVE DATE. That this Resolution shall become
effective immediately upon its passage and adoption. -

On request and recommendation of City Manager, Commissioner McClanahan moved to
authorize City Manager to execute Amended Grant Application to the Environmental Protection
Agency, for funding in amount of $280,539.00, to assist with the installation of the vacuum
sewer collection system. Seconded by Commissioner Howell and carried by the vote of the
Commission as follows:

Loren Williams, 2630 South Laurel Avenue, Lot 12, Pinecrest Subdivision, appeared
and introduced Terry Vernon, 2631 South Laurel Avenue, Lot 21.
Mr. Vernon showed a plat, and stated it shows that the City of Sanford owns 60' of
a right-of-way in front of both his and Mr. William's property, and stated that during the
last heavy rainfall the ditch filled up, and showed pictures regarding same. Further, he
spoke with Rick Holloway and Mike Crumpton in Engineering, who advised that it is not the
City's responsibly. Mr. Vernon stated the City is responsible because it is a dedicated
right-of-way owned by the City, and requested that the City regrade the swales.
Public Works Director Jerry Herman appeared and reported that the standby crew was
called regarding said problem, that part of the problem is the fact that neighbors downstream
from Mr. Vernon have built up their driveways, that he is looking into the matter, and will
have more detailed information this week.
Mr. Vernon also stated that there are no sidewalks in the Pincrest Elementary
School area, and asked the City to install a sidewalk on Laurel Avenue.

Commissioner McClanahan stated that the Commission might be receptive to providing
City crews to help with the labor, if the citizens in the neighborhood would be willing to
buy the materials for the sidewalk.
