Present: The City Commission of the City of Sanfo'rd, Florida met in Regular Meeting on September 9, 1991 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Mayor-Commissioner Bettye D. Simmons City Clerk Janet R. Donahoe Absent: City Attorney William L. Colbert The Chairman called the meeting to order. Public hearing to consider tentative Budget and gro~osedMillage for FY 91/92, as advertised via Notice of ProDosed Property Taxes {TRIM) Notice), mailed b~ Property Appraiser. Mayor Smith announced that the proposed millage rate of 6.8759 mills exceeds the rolled-back rate by 12.3054%, which is necessary for the City to provide continuing level of City Services in the face of inflation, and to meet the new demands associated with new development. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, said tentative Budget and proposed millage for FY 91/92. Bill Suber, Seminole County Property Appraiser, appeared and reported that he is responsible for determining the just value of property in Seminole County, that the law does not provide any means for him to consider an owner's name, age, income level, etc., as part of the appraisal process. Also, property must be reviewed on an annual basis to determine, within specific guidelines, whether just value has been achieved by property class, that if changes are deemed necessary then changes are made, even though said changes may appear to be unfair and excessive. Further, he is very upset over events which have occurred the past few days and weeks, that he accepts responsibility for increased valuations, and as a result of some of those increased valuations, anincrease in some peoples' taxes. However, he will not accept the responsibility or irresponsibility by the actions of a taxing authority, who alone has the power to budget, and the power of taxation to fund that budget. Further, fiscally responsible taxing authorities who are faced with the possibility of windfall tax revenues should consider that and compensate by rolling back tax rates to a lower level. Further, Seminole County has a large population of senior citizens who live on fixed income, when property values are affected as drastically as some have been this year, senior citizens are severely impacted. The City has the authority to reduce the budget to a level which is fiscally responsible, which will reduce taxes on the City's citizens. Commissioner McClanahan reported that the City realized an increase of 12.3054% in real dollars over last year's ad valorem taxes, including new construction, that a lot of properties went up, some went down, and some stayed the same, and that there had to be an adjustment down as well as up, to end up with 6% to 10% variation across the board. Further, 'the City does not have the capacity or the capability to solve the problem of increased property taxes, and that the City did not raise the millage or give a COLA. 1 3 2 MINUTES City Commission, Sanford, Florida 7:00 PM September 9 19 91 Mr. Suber reported that the majority of properties in Sanford that experienced an increase in value, increased between 20% and 70%. Further, the City of Sanford is no different from any other City or jurisdiction in a small rural County in Florida where they go through year after year with no sales, and no data which gives any indication that values have ever changed. Also, 90% of all new properties in Seminole County, which are improved, particularly residential, were built after 1970. Now, that actual sales are done on a day- to-day basis, we have been able to determine the value of these older homes. Mayor Smith reported that Sanford's millage rate has not increased over the last three years. Mr. Suber concurred. Bobbie Barrineau, 711 South Palmetto Avenue, appeared and reported that she submitted 400 signatures prior to this evenings meeting, that she is able to pay her fair share of taxes because she is still able to work, and that commercial properties should be valued justly. Bill Balzer, 222 Bradshaw Drive, appeared and reported that the homes in Country Club Estates have been appraised 300% higher than last year, that his property was assessed $13,000 more than last year, and that he has filed an appeal. Dick Barnett, 2070 Grandview Avenue, appeared and reported that the focus of this government should be on the ability of the people to pay for the kind of government they should be receiving, and on the amount of money it would take to operate on that basis. Mayor Smith reported that the General Fund is 13 million dollars, and that the ad valorem taxes are a part of same. Commissioner McClanahan reported that the information the City had in June, which is the same information we have now, told what revenue the City could expect from ad valorem taxes for the year 1991, it did not indicate where said taxes were coming from. Harold Christensen, 1718 Magnolia Avenue, appeared and reported that he does not like the services the City provides, and asked how many people in the audience received a 10% or more tax increase; approximately 90 - 100 people raised their hands. George Curry, 4030 Lake Harney Circle, Geneva, appeared and reported that he owns properties in Sanford, and that a small percentage of the people are having to pay a large amount of the taxes. Mayor Smith asked for a show of hands from those individuals in the audience who were opposed to the property assessments; approximately 10 people raised their hands, and how many people in the audience were opposed to the 6.85 millage rate; approximately 5 people raised their hands. Vallie Cox, 609 East Second Street, appeared and reported that she did not believe "people are the government" anymore. Alfred DeLattibeaudiere, 807 Sanford Avenue, appeared and reported that he is very dissatisfied with the inconsistencies of the City because some properties are exempt while others are forced to pay. Jane Davis, Upsala Road, appeared and reported that nothing can be done about high tax appraisals, but something can be done about taxes. Also, she is opposed to the swimming pool referendum. Jane Chase, 3565 South Mellonville Avenue, appeared and reported that the Commission knew there was going to be a 12% tax increase, and asked where the Commission thought the money was coming from. Also, someone has to give the citizens some tax relief. MINUTES City Commission, Sanford, Florida 7:00 PM September 9 19 91 7mmm~.ss[oner McClanahan reported that several multi-family and single-family properties came on line in 1990, that the 12% increase will maintain the present level of services, and that inflation is City-wide. Toni Jones, 105 West 21st Street, appeared and thanked the City for fixing the stormwater drains around her house, and asked if City services include tree trimming and building inspections. Mayor Smith asked for a show of hands from those individuals in the audience who were present to protest the millage; approximately eight to fifteen people raised their hands. Carem Gager, 1209 West 19th Court, appeared and asked if there was any way the people could be given some tax relief, and if there was anything in the budget that could be cut. Mayor Smith stated that the budget is bare bones. Viola Williams appeared and reported that she is being taxed out of her property, that Sanford property has gone down in value, and that she wants the taxes lowered. Jordan Beckner, 434 Scott Avenue, appeared and reported that overall taxes went down by $500.00, and that the Commission is doing a good job. Mr. Sweeting appeared and reported that he came back to Sanford because of the lifestyle, which progress is ruining. Also, the citizens of Sanford need tax relief. Commissioner Thomas moved to adopt proposed millage rate of 6.8759, as the tentative millage rate. The Chairman announced that the Commission would hear from ~hose persons present to speak in favor of, or in opposition to, said Sanford Airport Authority's proposed FY 91/92- Budget. Dick Barnett appeared and requested that the Commission keep control over the airport, and not relinquish more than is necessary. Further, the airport has an impact on the quality of life in Sanford. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, said Conditional Use. Bocur Nacu appeared and reported that he bought the property because it was zoned RC-1, and that he purchased a second piece of property for parking spaces required by the City. After discussion, Commissioner McClanahan moved to approve the Conditional Use, to change the use from a residential use to a mixed use of professional offices and two apartments, and refer same to Planning and Zoning Commission for site plan review and approval; and to also refer to Planning and Zoning Commission the request to waive required paving of parking spaces, and only pave the driveway, and the request to reduce the width of required landscaping buffers. Further, that the Conditional Use is granted to the present owner, who must make the required improvements before selling the property, and that it does not run with the land. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, proposed Ordinance No. 3073. No one appeared. Commissioner Howell moved on the second reading and adoption of said Ordinance No. 3073. On recommendation of City Manager, Commissioner Howell moved to authorize the execution of said State Revolving Fund Loan Agreement, in amount of $4,929,600.00, for STP and Reuse Expansion, Wet Weather Discharge, subject to inclusion of revised language, as described in memo dated September 6, 1991, from Finance Director, and recommended by bond counsel. Commissioner Howell reported that the design of the museum does not fit in with the historic design of downtown, and that several people in the audience would like speak regarding same. Warren Skipper, 207 East 10th Street, President, Sanford Historic Trust, appeared and reported that the design does not fit the historic architecture, that it looks too modern, and that the Trust is trying to promote Sanford as a historic City. Bob Cassel, 709 Oak Avenue, appeared and reported that the Memphis Museum was converted from modern to neo-classical, that the Sanford Museum design is too modern and does not fit in with surrounding structures. Parks Director Jim Jernigan appeared and briefly reviewed the history of the library/museum expansion project. Commissioner Howell moved to have the architect review the design for possible changes to the front of the museum. Seconded by Commissioner Eckstein. City Manager reported that the grant from the Tourist Development Counsel requires that the money be expended by September 30, 1992. After discussion, the Commission concurred to authorize City Manager to request that the architect meet with members of the museum/library board, and some of the people present tonight, to review the plans for possible changes to the design of the museum. Declaration of Sergeant Tate'S service weapon as surplus. Commissioner Howell reported that Police Sergeant Tare will be retiring after 26 years of service, and moved to declare his service weapon, Inventory 903337, surplus, and to present same to Sergeant Tate.
