092391-Work SessionMINUTES 1 4 3 City Commission, Sanford, Florida 5:00 PM September 23 19 91 The City Commission of the City of Sanford, Florida met in Work Session on Monday, September 23, 1991 at 5:00 o'clock P.M. in the-City Manager's Conference Room, City Hall, Sanford, Florida. Present: Absent: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas Commissioner A. A. McClanahan Assistant City Attorney Donna L. McIntosh City Manager William A. Simmons City Clerk Janet R. Donahoe City Attorney William L. Colbert Commissioner Lon K. Howell The Chairman called the meeting to order. Sanford Airport Authority's Long Range Access Alternatives and Aeronauti~al Conmiderationa. Steve Cooke appeared and reported that the study concerns ground transportation in the area, and what can be done in the future to attract large transportation aircraft. Currently, there is only one precision approach, which is from the west, and that an alternative approach from the south is needed. Also, the focus was to look at access to the airport as well as around the airport. Seminole County's plan proposes that Lake Mary Boulevard and Silver Lake Drive be extended due east around the airport and eventually connect with SR 415. Further, if the runway is extended north/south, Silver Lake Drive would need to be extended south, and if parallel runways are built, Silver Lake Drive would need to be turned considerably to the south. Presently, the 8,000 foot runway can accommodate 737's and 727's, but cannot handle wide body equipment such as 747's, DC 10's 767's, Charters or International Travel, and, therefore, a 10,000 foot runway is being considered. City Manager reported that the City Commission needs to begin evaluating the Airport's alternatives, to be included in the Seminole County Joint Planning Agreement, and that the roadway around the south end of the Airport is in the 10 year plan. Mr. Cooke stated that approximately 400 acres of land would be needed to implement a north/south runway, approximately 1700 acres for parallel runways, and that ultimate consideration should be given for arrival from the south. Further, wherever Silver Lake Drive goes in the future will dictate the Airport's growth. City Manager reported that joint planning with the County needs to include 3 major entities. Uncle Nick's Oyster Bar. Assistant City Attorney Donna McIntosh reported that if the City's alcoholic beverage code is challenged on the basis of classifications used in licensing, she is comfortable that the code could withstand the challenge, and that she does not have any recommendation to bring forward, at this time, to amend the code. Further, if the code is amended, and Uncle Nick's is allowed to sell alcoholic beverages on Sunday, the City would have to permit same for all similarly situated establishments. Further, the State licensing division reports the City's classification codes are adequate; and the codes meet the City of Sanford's needs. City Manager reported that if the ordinance is amended as proposed, additional existing bars could be open on Sunday, and that there is a potential for bars, which are presently not in existence, wanting to operate on Sunday as well. Also, Assistant City Attorney has advised that, although the City has not enforced Sunday hours for some given period of time, the City is not prohibited from enforcing said hours at this time. Further, there is no way to grandfather Uncle Nick's without opening it up for others with the same type of conditions. Assistant City Attorney recommended that said item be placed on tonight's Regular Meeting Agenda, for City Commission action on it and on the Petition. The Commission concurred. Preliminary Redistricting Concept. After discussion, the Commission authorized Assistant City Attorney to forward the Preliminary Redistricting Plan to Plaintiff's Counsel for review and comments. Request from Mike Severt, for waiver of 2-hour moving requirement/Peddler's License, to sell Christmas Trees on vacant lot north of Aamco on 17-92. After discussion, the consensus of the Commission was to deny said request, that there will be no waivers or variances of City Code Section 18-72, and to direct City Clerk to notify prior holders of Peddler's Licenses, for sale of Christmas Trees and/or Fireworks regarding same. Also, the Commission concurred to place said item on tonight's Regular Meeting Agenda, for City Commission action. The Commission discussed additional Regular Agenda Items as follows: Item No. 5 F, authorization for City Manager to approve the transfer of budgeted funds within, and/or between departments, offices, or agencies, and Item No. 8 , offer from Mr. & Mrs. Anthony B. People, to purchase City owned property. Former Sanford Gasification Plant. Assistant City Attorney reported that the Department of Environmental Regulation served the current owner of the Gasification Plant, Florida Public Utilities, with a notice of warning, and that the preliminary study performed by Environmental Consulting and Technology, Inc., concluded that the woods behind Florida Public Utilities, which is owned by Southern Coast Line Railroad, all the way to Cloud Creek Branch, is impacted with coal tar residues. Further, she, City Manager, and Bill Pence, attorney for Plorida Public Utilities, walked the site and concurred that said property is visually impacted. Further, ECT proposes that the City fence and post the impacted property as a precautionary measure. City Manager reported that he will contact DER, and surrounding property owners, to alert that coal tar is on the surface and could cause a hazard to anyone coming in contact with it, and that additional properties may be impacted, and that said property owners will be asked to participate in the cost of said fencing. City Manager recommended that the Commission authorize the execution of Contract with ECT in amount of $2,750.00, for preliminary determination of horizontal extent of coal tar impacted surface soils/sediments in the Cloud Creek Branch drainage system, and that said item be referred to tonight's Regular Meeting Agenda, for City Commission action. Impact Fee Exemption/Time Payment - Affordable Housing. Assistant City Attorney reported that she has researched the legal consequences of establishing a program to provide for an exemption/time payment of impact fees for qualified applicants, for Iow income/affordable housing. Further, Collier County has had a similar program for two years, which allows affordable housing applicants to file an application with the City, for an exemption of impact fees, and that a special fund is established to provide a source of money for said exemption. Further, qualification is based on the cost of the house and/or monthly rental fee, and that said exemption runs with the property. Also, Tallahassee has a two tier qualification system, which qualifies'the dwelling unit as well MINUTES 1 4 5 City Commission, Sanford, Florida 5:00 PM September 23 1991 as the person, and that said program has been in effect for six weeks. Also, granting said exemption is at the discretion of the City, and is limited by availability of funds tappropriated by the City Commission, and whether exemption/delayed payment is granted, sufficient funds must be set aside in a separate fund. City Manager reported that deferred payment can be written into an ordinance provided that a separate fund is set up, and that block grant monies cannot be used to pay impact fees. Further, reserves could be used to establish a revolving fund, with the knowledge that said monies would be covered by a lien, and that there would be a pay back. City Manager recommended that the City Commission adopt an ordinance to set up the frame work for this type of program, which would work toward furthering efforts to facilitate affordable housing in accordance with the City's Comprehensive Plan. Commissioner McClanahan suggested that City Manager contact Tampa regarding the use of block grant monies. Revised Sick Leave Policy. After discussion, the consensus of the Commission was to revise the Personnel Rules & Regulations, to include a "Voluntary Sick Leave Donation Program, as described in memo dated September 23, 1991, .from Personnel Director, and referred said item to tonight's Regular Meeting, for City Commission action. Personnel Classification and Pay Plan. City Manager reported that the Commission previously authorized the reclassification/regrade of 18 Refuse Collector positions to Equipment Operator I's, however, two employees do not meet the necessary requirements for said reclassification, and, therefore, recommended that the FY 91/92 Classification and Pay Plan be amended to delete two Equipment Operator I positions and retain two Refuse Collector positions, until such time as said employees qualify for reclassification, as described in memo dated September 19, 1991, from Public Works Director. Request from Sanford Auto Auction, for waiver of required paving of internal circulation driveway at 200 Pers~,..on Avenue, for Auto Auction on First Street. City Manager reported that the Planning and Zoning Commission recommends a six month waiver of required driveway paving, to use shell instead, with review after six months. The Commission concurred with said waiver. Assistant City Attorney reported that there are new Voting Conflict Laws, which will be in effect October 1, 1991, and briefly reviewed same.
