Present: The C~hy Commission of the City of Sanford, Florida met in Regular Meeting on September 23, 1991 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein. Commissioner Robert B. Thomas Commissioner A. A. McClanahan Commissioner Lon Howell Assistant City Attorney Donna L. McIntosh City Manager William A. Simmons City Clerk Janet R. Donahoe Absent: City Attorney William L. Colbert The Chairman called the meeting to order. Public hearing to finalize and adopt Annual Budget andCaDital Program, and ado~tthe millage rate, for the City of Sanford, Florida, for Fiscal Year of October 1, 1991 to September 30, 1992; as advertised in the Sanford Herald on September 3, 1991 and September 18, 1991. The Chairman announced that the Proposed 1991-92 millage rate of 6.8759 mills exceeds the rolled-back rate by 12.3054%, continuing level of City Services in the associated with new development. and this is necessary for City to provide face of inflation, and to meet new demands The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, Proposed 1991-92 budget and millage rate. Dick Barnett, 2070 Grandview Avenue, appeared and requested an explanation regarding the 13 million dollars in ad valorem taxes, the enterprise fund activity, and a statement of what the total indebtedness is for the City. City Manager reported that the General Fund is approximately $3,000,000.00, of which 4 1/2 million dollars is ad valorem taxes, and that the remainder comes from sales tax, franchise fees, utility fees, license fees, revenue sharing, building permit fees, development permit fees, fines, etc. Further, the Enterprise Fund consists of the Water and Sewer Fund, Refuse Collection Fund, and Stormwater Utility Fund, and that these funds together with the General Fund comprise the total budget. William Balzer, 222 Bradshaw Drive, appeared and requested an explanation regarding the City's billing process for water and sewer. City Manager reported that the utility rate structure is split into two areas consisting of a service charge/connection charge, and metered fee which is based on the number of units of metered water used. Leo Salvail, 2522 Willow Avenue, appeared and reported that he is opposed to the tremendous tax increase in the budget for FY 91/92, that the appraisals for old properties in Sanford increased 200% to 300%, that the City Commission could have reduced the millage to off-set said high appraisals, and because there was no decrease in the millage there should be a large surplus. Alfred DeLattibeaudiere, 807 Sanford Avenue, appeared and reported t'hat Sanford citizens are being taken advantage of, and that he is disgustingly dissatisfied with the way the tax payers are treated in this town. Further. the City of Sanford was solvent seven years ago, and that he cannot understand why the City is in the red today. MINUTES City Commission, Sanford, Florida 7:00 PM September 23 147 19 91 Bradford Gonzales appeared and reported that the County and City want more money, that the State is talking about cutting needed services for the elderly, and that the poor people are paying the higher tax burden. Further, local governments need to work closely together so they don't overlap one another. Also, he hoped some taxes would be used to resolve the flooding problem in Bryn Haven. City Manager reported that tax money will not be needed to fix the drainage problem in Bryn Haven, that the developer's contractor is scheduled to begin adding additional pipes on November 15, 1991, to correct the problem. Art Harris, 1108 Grove Manor Drive, appeared and reported that his property taxes went up, that taxes are raised when the millage is not rolled back, that each person present this evening will have less money to live on as a result of said tax increase, and that the City should be able to make do with less money. Also, the City tore down two pools, and now it wants to build a new one. Daisy Curry, 119 Bethune Circle, appeared and reported that her property assessment was raised from $37,000.00 to $45,000.00, and asked who selects the property appraiser. Also, the County says the City Commission and Mayor are the cause of higher property assessments. Mayor Smith reported that the property appraiser is elected County-wide, and that the City has no input regarding property appraisals. Commissioner Thomas moved to adopt Resolution No. 1617, entitled: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, DETERMINING THE AMOUNTAND FIXING THE RATE OF TAXATION ANDMAKINGTHE ANNUAL TAX LEVY FOR THE FISCAL YEAR 1991-1992, FOR THE CITY OF SANFORD, FLORIDA. Bradford Gonzales appeared and reminded the Commission to "tighten the belt" in order to better use the City's money, and that he would like to see a conservative vote on said issue, and on Ordinance No. 3077. Dick Barnett, 2070 Grandview Avenue, appeared and asked what the difference is between Police and Fire pensions. City Manager suggested that Mr. Barnett speak with Finance Director regarding same. Further, Holiday Inn is not proposing to utilize any space other than Holiday Inn property for these two events. Seconded by Commissioner Eckstein and carried by the-vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Nay Dick Barnett appeared and reported that Sanford citizens are being asked to vote for or against a $3,000,000.00 recreation complex, and asked what the total encumbrances are for the City of Sanford, and when said encumbrances will be paid. City Manager reported that there is no outstanding general obligation bond debt, that approximately 1 1/2 years ago the City sold $3,000,000.00 in Certificates of Participation, to be paid over a fourteen year period, and that there is no other general revenue or ad valorem debt. (Commissioner Howell absent from meeting.) City Manager reported that the Florida TRIM Act requires that the 11.9 million dollars in utility bonds that were recently sold, be listed as part of this year's budget, that the total outstanding utility bonds are approximately $32,000,000.00, that virtually all of said utility bond debt is mandated, and that the State RevolVing Fund loan is $1,500,000.00. Also, the City of Sanford is in very good shape financially compared to other jurisdictions around the country. (Commissioner Howell present.) Commissioner McClanahan moved to designate Commissioner Howell as the City Commission representative, to attend the Logic & Accuracy test on October 4, 1991 at 3:30 P.M., and the ballot count on October 8, 1991, at 6:30 P.M., for the Bond Referendum. MINUTES City Commission, Sanford, Florida 7:00 PM September 23 157 199 1 Request from Seminole County Humane Society, for free refuse pick-up beginning October 1, 1991. Bo Simpson, 972 Lake Irene, Casselberry, appeared and reported that the Seminole County Humane Society located at 2800 Country Home Road, exists solely on donations and contributions. Further, Casselberry is the only municipality in Seminole County that has animal control, and budgets $219,500. for it, that over the past eight months in Sanford alone, 246 animals were surrendered, there were 126 abuse cases, 43 animals were impounded, 112 animals were adopted, which equals 252 hours of truck time. Further, Seminole County Humane Society does not have the funds for a dumpster, and requested that the Commission consider providing free refuse pick-up. City Manager reported that Ordinance No. 3066 prohibits free refuse pick-up service, however, the Commission may want to consider authorizing funding for one month's free refuse service while he tries to work out funding or free service through Seminole County. On recommendation of City Manager, Commissioner McClanahan moved to authorize funding for one month's free refuse service for the Seminole County Humane Society while City Manager tries to work out funding or free service through Seminole County. Seconded by Commissioner Eckstein and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Request for City Commission to adopt loitering ordinance. Bennie Alexander, 1212 West 8th Street, representative for Celery City Lodge, appeared and reported that there is a serious loitering problem in the area of Celery City Lodge, which has made it difficult to hold meetings, and requested that the Commission adopt an ordinance to stop the loitering. Police Chief Harriet reported that the Police Department is making regular checks in the area, that there has been a concerted effort to move people along, and that said problem is a high priority. Assistant City Attorney reported that loitering ordinances are ~ery difficult and many have been held unconstitutional, and that the City of Sanford adopted an ordinance, which was deemed capricious and arbitrary by the 18th Judiciary Circuit Judge. After discussion, the Commission authorized Assistant City Attorney to research and make recommendations. Martha Yancey, 2100 Cordova Drive, appeared and reported that she was speaking on behalf of the Scenic Improvement Board, as well as other clubs that have donated their time and money on the beautification projects in this City. Further, in 1980, the Commission appointed nine members to serve on the SIB for the purpose of looking into the City's blighted areas and making beautification recommendations, and that said board presented a master plan to the Commission, which was approved. Further, Commissioner McClanahan holds a vendetta against the SIB, that he made the statement "putting money into beautifying the City of Sanford, is like putting money down a rat hole". Also, Commissioner Howell has a vendetta against volunteers, and that he told her she would never serve on the SIB again. 158 MINUTES City Commission, Sanford. Florida 7:00 PM September 23 19 91 uommissioner McClanahan reported that he did not address any items tonight regarding the SIB. Further, in 1974 when the SIB wanted to redo downtown Sanford, he made the remark that doing that project was like putting money down a rat hole, and that was the context in which that remark was made. Further, he has supported every SIB project since he has been back on the Commission, and that he nominated Ms. Yancey to serve on said board. Commissioner Howell reported that Ms. Yancey personally attacked him at a recent meeting, and publicly announced that she would never serve on another board. Albert Fryer, 1805 Madiera Avenue, appeared and reported that there is a serious drug problem in the black community, that something needs to be done to resolve the problem, and requested assistance from the Commission. Brad Gonzales appeared and suggested that a task force be set up, composed of a Commission Member, the Mayor, Community Representative, and Police representative, to coordinate efforts between the community, politicians, and service people. Mr. Gonzales requested a copy of the written response regarding the flooding situation Bryn Haven. Margaret Sweet-Rosier, 1112 Bay Avenue, appeared and reported that she lives in front of a school, and confirmed that drugs are present. Albert DeLattibeaudiere appeared and reported that he did not appreciate the fact that he was not permitted to ask questions regarding the swimming pool referendum, and that tax payers have the right to voice their opinions at Commission Meetings. Further, asked if it is legal to use utility bills to promote elections? (Commissioner Howell absent from meeting.) Mayor Smith reported the information on the back of the utility bills was informational, and did not take either a pro or con position on the Referendum. Assistant City Attorney reported that the City can utilize funds to educate the public on matters that are coming before them for a vote, but cannot advocate a position.
