112591-Regular Meeting MINUTES City Commission, Sanford, Florida 199 November 25 19 91 The City Commission of the City of Sanford, Florida met in Regular Meeting on Monday, November 25, 1991 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Colbert City Manager William A. Simmons City Clerk Janet R. Donahoe The Chairman called the meeting to order. Henry Shelton Sanford Museum-Library. Mayor Smith reported that Commissioner Eckstein and Sydney Chase, Jr. will meet with Keith Reeves, Architect's Design Group, on Friday, November 29, 1991, to ask if he is willing to change the design to a more traditional design, and, if not, if he is willing to give the City the plans to date. Hearing to consider revocation of occupational license for apartment complex at 718 West First Street, Violetta Williams, Licensee. Commissioner McClanahan reported that Violetta Williams has put tenant on notice, that Staff has received of copy of said notice, and that no further action is needed. The Commission took no further action. Continuation of Public Hearing to consider condemnation of structure(s) at 213 Laurel Avenue, Condemnation Report 991-19, Creststar Mortgage Corporation, owner. Stefano AngiUlli, Jr., 600 Laurel Avenue, appeared and requested that the Commission remove said property from condemnation. Daniel PatterSon, Jr., 417 West Third Street, appeared and reported that he participated in the improvement of this property, and they have spared no cost for said improvements. On recommendation of City Manager Commissioner McClanahan moved to remove the aforementioned property from condemnation. Ordinance No. 3088, entitled: adoption of Ordinance No. 3088, as advertised AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE CITY OF SANFORD TO CREATE A UNIFORM BUILDING NUMBERING SYSTEM; PROVIDING FOR PURPOSES OF UNIFORM BUILDING NUMBERING SYSTEM; PROVIDING FOR DEFINITIONS; PROVIDING FOR ADOPTION OF SEMINOLE COUNTY BUILDING NUMBERING MAPS; PROVIDING FOR ASSIGNMENT OF NUMBERS AND ADMINISTRATION OF SYSTEM BY CITY ENGINEERING AND PLANNING DEPARTMENT; PROVIDING FOR POSTING OF REQUIRED BUILDING NUMBERS; PROVIDING FOR ASSIGNMENT OF NUMBERS UPON MUNICIPAL ANNEXATION; PROVIDING FOR PENALTIES; GRANTING SANFORD CODE ENFORCEMENT BOARD JURISDICTION; PROVIDING CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. introduced and placed on first reading at Meeting of November 11, 1991, was next placed on second reading. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, proposed Ordinance No. 3088. Commissioner Thomas moved on the second reading and adoption of said Ordinance No. Seconded by Commissioner Howell and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Petition to Annex a portion of property lying between Old Lake Mary Road and Ridgewood Avenue and between SR 46A (West 25th Street) and SR 425 (Airport Boulevard), City of Sanford, petitioner. On recommendation of City Manager, Commissioner Eckstein moved to authorize the Mayor to execute Petition and Application for Annexation, and authorized City Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Complaints from Ronald Paul Hill regarding Brynhaven Subdivision. Ronald Hill, 131 Aberdeen Circle, appeared and reported that nothing has been done with respect to questions/problems he previously submitted to City Staff, regarding the Brynhaven subdivision. City Manager addressed concerns contained in Mr. Hill's letter dated November 5, 1991,as follows: 1) Woodbine Signs - Signs removed, 2) Drainage - Piping materials have been ordered for installation of additional piping; estimated start date on or about November 15, 1991, 3) Entrance sign in median - Approved by City Commission in 1987, subject to developer arranging for perpetual maintenance of said sign and surrounding vegetation, which is included in Sanora Home Owner Association's covenants and deeds, 4) 25' Strip - City of Sanford has no record of developer making any requests relative to same, that City records indicate that said 25' strip is private property owned by Mr. Odham, and that the developer had not committed to, nor has the City required him to maintain same. City Attorney reported that said sign is there with the permission of the City Commission, with the consent of the Sanora Home Owner's Association, and that it is a convenant which is as part of the conditions, restrictions and reservations that run with the land, Also there are procedures that the Home Owner's Association can go through to change the covenants and restrictions, and that the City does not have the authority to change same. City Manager reported that relative to Swale System, Staff believes the developer and representative for St. John's River Water Management District agree that additional work needs to be done, and that Staff is continuing to work on said issue. Kevin MacMillan appeared and reported that he has seen water up into his driveway. Also, that he would like a stop sign at Reel Court and Rabun Court, and asked why the City does not have a youth program at Midway Elementary School. The Commission instructed Staff to provide Mr. MacMillan with a League of Women Voters folder. (Commissioner Howell absent from meeting.) Hutchison, Jr. On recommendation of City Manager, the Commission directed Staff to prepare appropriate text for inclusion in a joint resolution as requested. Request to convert "Special Custodial Worker" positions into "Contractual" positions. On recommendation of City Manager, Commissioner Thomas moved to covert "Special Custodial Worker" positions to "Contractual" positions, as set forth in memo dated November 5, 1991, from Personnel Director to City Manager. Request to utilize same payment procedure in effect for City Commission approved lump sum contracts, for City Commission approved Consultant Contracts. On recommendation of City Manager, Commissioner Thomas moved to authorize the utilization of same payment procedures for City Commission approved Consultant Contracts, as in effect for lump sum contracts. Code Enforcement Board: The City Clerk reported that the term of Alfred DeLattibeaudiere expires December 31, 1991, and that Mr. DeLattibeaudiere is willing to serve again, if re-appointed. Commissioner McClanahan moved to re-appoint Mr. DeLattibeaudiere to the Code Enforcement Board. Scott and Elizabeth Gallant be considered for appointment to this vacancy. Commissioner Eckstein moved to appoint Elizabeth Gallant to the Henry Shelton Sanford Memorial Library. The Commission accepted Keith V. Birkemeyer's resignation. De Public Employees Relations Commission: The City Clerk reported that the terms of Garnett White and Michael E. Gray expire December 31, 1991, and that they are both willing to serve again, if re-appointed. Commissioner Thomas moved to re-appoint Mr. White and Mr. Gray to the Public Employees Relations Commission. The Commission acknowledged four lump sum contract invoices approved for payment totalling $197,553.90. Donation of recovered/abandoned bicycles to under-privileged children. Commissioner Eckstein moved to declare surplus and authorize Staff to donate, recovered/abandoned bicycles to the Kiwanis Club, with Fire Department to repair/fix-up. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Request for authorization for City forces to demolish structure located at 1010 West 13th Street, Mary Smith, owner, Condemnation Report %91-18.
