Public Hearing to consider Appeal of Denial of Conditional Use for an automobile and truck repair use for a non-conforming lot located at 2531 French Avenue in a GC-2, General Commercial, Zoning District, Richard F. & Gloria Dove, owners, as advertised in the Sanford Herald on June 10, 1992. City Clerk reported that property owner was notified June 8, 1992, and the property was posted June 10, 1992. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the Conditional Use. Robert Seigler, 2934 Jewett Lane, representative for Armondo Ortiz and Richard Dove, appeared in support of said Conditional Use. He stated that Mr. Ortiz will specialize in servicing and repairing Rolls Royces, Jaguars and Mercedez Benz. Also, he is willing to do some remodeling if necessary. Mr. Seigler requested that the City approve this Conditional Use, and stated that he was available to answer questions. Commissioner McClanahan moved to authorize the requested Conditional Use for the non-conforming lot located at 2531 French Avenue, conditioned upon 24' driveway being as close to the north property line as possible, and with the remaining driveway to be restored to City specifications, as agreed to at Planning and Zoning Commission Meeting of May 21, 1992. Ordinance No. 3113, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1990 OF SAID CITY; SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN LAKE MARY BOULEVARD AND HIDDEN LAKE SUBDIVISION AND LYING WEST OF AND ABUTTING ART LANE IS PROPOSED TO BE REZONED FROM AG, AGRICULTURE TO THAT OF RC-1, RESTRICTED COMMERCIAL; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. introduced and placed on first reading at Meeting of June 8, 1992, was next placed on second reading. He stated that the Commission could defer Permit Fees, which include mechanical, electrical, plumbing and building fees, rather than waive said fees, as recommended, that such fees including Land Developments Fees would amount to approximately $250.00 per unit (108 units), totalling approximately $25,000.00. Park, Seminole Education Association, for waiver of paved parking at 2442 Elm Avenue, as discussed at tonight's Work session. Commissioner Eckstein reported he and Commissioner Thomas are members of SEA, and he will abstain from voting and file a Conflict of Interest Form. Commissioner Thomas reported he will also abstain from voting and file a Conflict of Interest Form. On recommendation of City Manager, Commissioner McClanahan moved to approve waiver of paved parking, based upon anticipated usage, with installation of mulch parking lot, other than for handicapped parking space. Also, annual review of usage, with City reserving the right to require higher degree of paving, either entire lot or center driveway section, should usage significantly exceed projections or mulch surface not be maintained. Also, property owner to pave alleyway (and adjoining property) to full width of 24-feet to provide for safe 2-lane ingress and egress from 25th Street. On recommendation of City Attorney and City Manager, Commissioner Thomas moved to authorize the Mayor to execute First Amendment to Development Agreement with Golden Rule, to provide for transfer of title of five lots to Developer during construction, with reverter clause, as described in letter dated June 22, 1992, from City Attorney. On recommendation of City Manager, Commissioner Thomas moved to authorize a one year extension for owner to complete repairs to bring structure up to code, conditioned upon owner keeping the property boarded up, cleaned up, and the yard maintained. Seconded by Commissioner Howell and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Request from Gary Hage, for City to jointly participate with the Sanford Airport Authority to have an Air Show in Sanford. Gary Hage, 2208 Coronado Concourse, appeared and reported that the City of Sanford would be an exceptional location to have an air show, as recently held in Daytona Beach, and that such an event would bring business to the City; and that the City of Sanford should contact the Sanford Airport Authority and work together to bring an Air Show here. The Commission recommended that Mr. Hage discuss the matter with the Sanford Airport Authority, and stated that the Commission would be willing to help in such a venture.
