Org~Qizational Meeting 487 danu.ary 5 19 93 The City Commission of the City o'f Sanford, Florida met in Organizational Meeting on Tuesday, January 5, 1993 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas, Jr. Commissioner A. A. McClanahan Commissioner Lon K. Howell City Attorney William L. Colbert City Manager William A. Simmons City Clerk Janet R. Donahoe The Chairman called the meeting to order. There being no further old business to be transacted by the out-going board, Commissioner McClanahan moved that the meeting adjourn sine die. Howell and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Seconded by Commissioner The Commission then reconvened. Oaths of Office. City Clerk administered the Oaths of Office to Commissioner-Elect Lon K. Howell, Commissioner-Elect Robert B. Thomas, Jr., and Mayor-Elect Bettye D. Smith, each signed the Oath and Acceptance of Office, and they were seated as Commissioners and Mayor, respectively. Appointment of Members of the City Commission to various C~.uittees. Commissioner Eckstein moved to approve the appointment of Members of the City Commission to Committees for 1993, as follows: APPOINTMENTS MADE BY CITY COMMISSION (City of Sanford Representation.) Commissioner McClanahan moved to appoint Director of Planning and Development Jay Marder, as Staff Member, to the Design/Regulatory Sub-Committee, as recommended by City Seconded by Commissioner Howell and carried by the vote of the Commission as Manager. follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Seminole Towne Center Redevelopment Agreement. City Manager reported that this Agreement is not ready for City Commission consideration, and recommended that said item be referred to the January 11, 1992 Regular Meeting, or a later Agenda as necessary. Environmental Protection Agency Administrative Complaint and Proposed Assessment of Penalty ("EPA"). City Manager reported receipt of Notice of Proposed Assessment of a Civil Penalty, from the Environmental Protection Agency ("EPA"), alleging that the City is in violation of NPDES Permitting. Further, Staff has been working with a consultant from the University of Central Florida regarding this situation. Also, Staff has discussed, met and negotiated with EPA representatives, as well as having on-going discussion with City Attorney and Counsel for EPA. Further, the City has the opportunity of continuing negotiations with EPA, and/or requesting an Administrative Hearing. Also, the City has experienced some failure relative to this type of testing, which is applicable to water being discharged to a surface water body, and is no way indicative of an adverse situation relative application or irrigation program.
