020893-Work SessionMINUTES City Commission, Sanford, Florida Work Session February 8, 19 93 The City Commission of the City of Sanford, Florida met in Work Session on Monday, February 8, 1993 at 5:00 o'clock P.M. in the City Manager's Conference Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas, Jr. Commissioner A. A. McClanahan Commissioner Lon K. Howell City Manager William A. Simmons City Clerk Janet R. Donahoe Absent: City Attorney William L. Colbert The Chairman called the meeting to order. Presentation byRalphSchmidt regarding proposed Affordable Housing Project - Sanford Lakes Apartments. Ralph Schmidt reported that the proposed Affordable Housing Project is a 184 unit Apartment Complex, that he has already received tax credits, and is applying for a State funded loan called S.A.I.L. He reviewed requests as described in his memo dated January 22, 1993, which includes: 1) reimbursement of police and fire impact fees upon the City receiving documentary stamp monies, 2) assistance with water and sewer impact fees, and 3) acceptance of 20% to 25% of impact fees upon issuance of building permits, with the remainder to be paid prior to receipt of the Certificate of Occupancy. City Manager reported that the City does not receive documentary stamp money at this time. Further, the City has waived site plan and building permit fees for other affordable housing projects, which are relatively low dollar items. Mr. Schmidt reported that the project will consist of one, two and three bedroom apartments ranging from 735 square feet to 1150 square feet, with rental fees (including utilities) as follows: 1 bedroom - $437.00, 2 bedroom - $525,00, and 3 bedroom - $607.00. Further, total family income cannot exceed 60% of the median income, which is $38,500.00 for a family of four, and $18,000.00 for a family of two. Further, there will be on-site security, which will include two police officers who also reside on the premises. Also, there will be only one entrance into the apartment complex. City Manager recommended that, should the Commission wish to support this project, developer be required to provide a minimum payment of 25% of impact fees upon issuance of building permits, with the remainder to be paid on a unit-by-unit basiS as Certificates of Occupancy are issued, and that Staff meet with Mr. Schmidt to work out a proposed agreement, and report back to the Commission. The Commission concurred to proceed as reconm]ended by City Manager. Request from Jerry Nance, Executive Director, Teen Challenge, for waiver of Impact Fees. Jerry Nance, Executive Director, Teen Challenge, reported that Teen Ohali=nge is a non-profit organization, which is funded through local business, corporate and individual donations. Further, this organization will be housing, feeding and hel3~ing co create productive citizens, which will provide a considerable tax savings' to ~ 3 community. Further, although Teen Challenge originally agreed to pay 1/3 (approximately $5,500.~U) of the impact fees upon commencement of construction, and the balance prior to issuance of the Certificate of Occupancy, this has created a severe financial burden, and requested that the Commission consider waiving all or a portion of the impacts fees. City Manager reported that the City cannot waive impact fees, and that general fund tax dollars would have to be used to pay these fees. MINUTES City Commission, Sanford, Florida WoPk::Session 511 February 8, 19 93 The consensus of the Commission was not to refer this item to tonight's Regular Meeting for City Commission action. Position Description Revisions regarding Police Chief and Fire Chief. After discussion, the Commission concurred to ask City Attorney to provide the necessary steps to accomplish Police Chief and Fire Chief Position Description Revisions as described in memo dated January 26, 1993, from Personnel Director, and to add this item to tonight's Regular Meeting Agenda. Professional Facilitator for Waterfront Master Plan. Director of Planning and Development requested that the Commission appoint a City Commission Member to the Steering Committee, and a Staff Member to the Technical Committee. He reported that the idea of having a facilitator is to provide someone who is skilled in the brainstorming process, to compile ideas to put into a cohesive form. (Commissioner Howell absent from the meeting.) Transient Rental Housing Standards/Requirements. (Commissioner Howell present.) Director of Planning and Development Jay Marder reported that the proposed draft ordinance is limited to "transient rental housing" and provides definitions of same which are more in synchronization with State definitions. Also, Staff will have the opportunity to inspect transient rental properties on an as needed basis. Further, this approach would not create a lot of additional work for City Staff, but would provide the ability to focus in on rental housing. After discussion, the Commission concurred to refer this item to the February 22, 1993, Work Session for further discussion, and to ask City Attorney to be present at said meeting. Also, to start the Work Session at 4:00 o'clock P.M. Franchise Fee/Utility Tax Compliance Review regarding Cablevision, and Florida Power a,~ Light. On recommendation of City Manager, the Commission authorized Staff to proceed with the Florida Power and Light audit, as outlined in memo dated January 25, 1993, from Finance Director. Street Paving Schedule - Brick Streets. Public Works Director Jerry Herman reported that Public Works has not paved over any brick streets and has no plans to do so, as instructed by the Commission on November 23, 1992. The Commission concurred to have Public Works continue paving those portions of Park Avenue which are not, and never have been, brick. Sanford Welcome Signs. After discussion, the Commission concurred with locations for "Sanford Welcome Signs" as described in memo dated February 5, 1993, from Director of Public Works Jerry Herman, with "south" site on 17-92 at Park Drive intersection. The Commission discussed the possibility of placing an additional sign near Seminole High School or as an alterative site to the one on the east side of town. Mayor Smith to contact Gretchen Schapker, Seminole High School Principal, to see if she would be interested in having a sign installed near the High School. 512 MINUTES City Commission, Sanford, Florida WOrk Session February 8, 19 93 Police and Fire False Alarm Fee Ordinances. City Manager reported that although it was understood to be the Commission's intent, the Commission did not formally vote to waive Police and Fire False Alarm Fees incurred prior to January 25, 1993, and to refund all such fees which have already been paid, and, therefore, should do so at tonight's Regular Meeting. The Commission referred this item to tonight's Regular Meeting for City Commission action. Grant Amendment No. 3, to Department of Environmental Regulation Grant #586110 in amount of $3,000,000.00. City Manager reported that Amendment No. 3 changes the Scope of Work under the Grant to delete Contract IV from the Scope of the Grant so receipt of grant monies will not be delayed. On request of City Manager, the Commission referred this item to tonight's Regular Meeting for City Commission action.
