The City Commission of the City of Sanford, Florida met in Regular Meeting on
Monday, June 28, 1993 at 7:03 o'clock P.M. in the City Commission Room, City Hall, Sanford,

Public Hearing to consider closing, vacating and abandoning four (4) feet of a fourteen (14)
foot wide east-west utility easement lying on the north side of the property at 1506
Mellonville Avenue, advertised in the Sanford Herald on June 14e 1993, Fred Peck, Jr., owner.
City Clerk reported that the notice of public hearing was posted on June 11, 1993,
and the owners notified June 7, 1993.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the vacating.
Norman Rubenstein, 703 Camden Road, Altamonte Springs, appeared and reported that
he was available to answer questions on behalf of Fred Peck, Jr., applicant.
Recommendation submitted from the Plans Review Committee to approve the vacating.
On recommendation of the City Manager, Commissioner McClanahan moved to authorize
the City Attorney to prepare the proper ordinance to vacate four (4) feet of the fourteen
(14) foot wide utility easement as advertised. Seconded by Commissioner Thomas and carried

Recommendation submitted from the Planning and Zoning Commission to deny the
rezoning. RecOmmendation submitted from the Director of Planning and Development to approve
the rezoning.
Sue Boso, 760 Upsala Road, appeared and reported that this request is not
consistent with the current use. Further, she did not receive notification of the Planning
and Zoning Commission Meeting and tonight's City Commission Meeting until Saturday, June 26,
1993.
Director of Planning and Development reported that the proposed Master Plan
reflects a density that is within the Future Land Use Plan density for this parcel, which is
six dwelling units per acre.
Commissioner Eckstein reported that he received two ex-parte communications with
regard to this rezoning request; one for and one against.
Mayor Smith reported that the applicant has requested that this item be tabled.
Pat Lee appeared and read a petition (copy submitted) from thirteen (13) adjacent
property owners, setting forth reasons for opposition to the rezoning, as follows: 1)
density, 2) traffic, and 3) drainage run-off. She stated that this is a rental property,
that Mr. Trizzino has never resided on the property, and does not know the quality of life
there. Further, the property is 4.9 acres, that after deduction for the dedicated road
right-of-way, the cul-de-sac and the retention pond, only 3.37 acres remain, thus providing
8 1/2 units per acre, not 5.9 as indicated. Ms. Lee requested that Mr. Trizzino be required
to install a brick wall comparable to the one where Mayor Smith resides.
City Manager recommended that this item be continued until the July 12, 1993
Meeting, to allow Staff the opportunity to work with the applicant and residents, and provide
recommended conditions. City Manager further stated that notification of the public hearing
will be sent by Certified Mail Return Receipt Requested.
On recommendation of the City Manager, Commissioner McClanahan moved to table
consideration of the request to rezone until July 12, 1993, pending meeting with Staff,

Interlocal Utility Construction (relocation) Agreement with Seminole County, for installatio-
of water and sewer utility lines in Seminole County rights-of-way relative CR 425 (S~nford
Avenue) road-widening project.. On recommendation of. the City Manager, Commissioner Thomas
moved to authorize execution of said Interlocal Utility Construction (relocation) Agreement
with Seminole County in amount of $280,468.00, with the City reserving the right to terminate
said Agreement should the cost exceed said amount, plus CEI Services in amount of $28,046.00.

Civil Service Board: City Clerk reported that on June 3, 1993, City
employees elected R.C. Whitmire as City representative on the Civil Service
Board. Mr. Whitmire is the father of Lt. Dennis Whitmire, Police Department,
whose responsibilities include internal affair investigations and
disciplinary involvement. Personnel Director recommended appointment of
George Rufus, as "alternate" member on the Civil Service Board, to replace
R.C. Whitmire, to hear and/or determine matters in which there appears to be
a "conflict of interest".
On recommendation of the Personnel Director, Commissioner Eckstein moved to
appoint George Rufas as "alternate" member on the Civil Service Board, to
replace R.C. Whitmire, to hear and/or determine matters in which there

System Development Fee Advisory Committee: City Clerk reported that the
terms of Herbert Cherry and Robert M. Keith expire July 27, 1993. Further,
Mr. Keith has been contacted and is wiling to serve again, if re-appointed;
Staff has been unable to contact Mr. Cherry.

contracts. The Commission acknowledged twelve invoices totalling $821,882.81.
Holiday Inn. City Attorney reported that on Friday, June 18, 1993, the Motion for Summary
Judgment was not granted and a Stay was entered, that the case will move forward, and that
he will keep the City apprised of further developments regarding this matter.
Bid ~92/93-44, Four (4) Ross Bicycles (Police Department). On recorr~aendation of the City
Manager, Commissioner McClanahan moved to accept only bid, which met specifications, from
Crank'N Bikes in amount of $2,300.00, of which $2,237.00 was a contribution, the balance of
$63.00 to be funded from Uniform Division's FY 92/93 Budget. Seconded by Commissioner Thomas

Utility Rate Adjustment, as discussed at tonight's Work Session. On

City Manager, Commissioner Thomas moved to approve Utility Rate Adjustment Alternative #3,
as described in memo dated June 25, 1993, from City Manager, and to authorize the City
Attorney to prepare an ordinance implementing said rates, effective for all billings on or
after August 1, 1993. Also, City Manager to provide utility rate increase alternatives at
the July 12, 1993, Work Session. Seconded by Commissioner McClanahan and carried by the vote

Audience Participation
Diane Smith, 1413 Oak Avenue, appeared and reported that the property located at
106 Avocado Avenue, Pauline Hold, owner, is in disrepair; does not meet city code; and kids
who live at this location are breaking into nearby residences. Also, there is incomplete
road work on 15th Street and Park Avenue. City Manager to report back with information
regarding these two complaints.
