Regular Meeting

The City Commission of the City of Sanford, Florida, met in Regular Meeting on
Monday, November 8, 1993, at 7:00 o'clock P.M. in the City Commission Room, City Hall,
Sanford, Florida.

The Chairman called the meeting to order.
Public Hearing to consider rezoning a portion of property l¥ing between Celery Avenue and SCL
Railroad right-of-way and between Summerlin Avenue and Brisson Avenue, from SR-1, Single-
Family Dwelling Residential, to PD, Planned Development, as advertised in the Sanford Herald
on October 28, 1993.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the rezoning.
Dan Towby, New Tribes Mission, appeared and stated that he was available to answer
questions.
Recommendation submitted from the Planning and Zoning Commission and the Director
of Planning and Development to approve the request to rezone.
On recommendation of the City Manager, Commissioner Howell moved to authorize the
City Attorney to prepare the proper ordinance to rezone the property as advertised. Seconded
by Commissioner Thomas and carried by the vote of the Commission as follows:

ORDINANCE NO. 1688 AS AMENDED BY ORDINANCE 1850 AS
AMENDED BY ORDINANCE 3076 OF THE CITY OF SANFORD,
FLORIDA; PROVIDING FOR ANAMENDED PENSION PLAN FOR POLICE
OFFICERS TO INCREASE BENEFIT RATES FROM 3.00% TO 3.19%;
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.

FIREFIGHTERS TO INCREASE BENEFIT RATES FROM 2.44% TO

CONTRIBUTION FOR THE FIREMANS' RETIREMENT SYSTEM FROM

Mayor Smith reported that the Firefighters' Pension Board has requested that this
item be tabled until the November 22, 1993, Regular Meeting.

Request from seminole High School Band, for free use of Civic Center, for annual awards
banquet on June 3, 1994. -On recommendation of the City. Manager, Commissioner Howell moved

Consultant Services Contract with Anderson & Associates, for Joint Waterfront-Main Street
Project. On recommendation of the City Manager, Commissioner Thomas moved to authorize
execution of the Consultant Services Contract with Anderson & Associates in amount of
$2,000.00, with funding to be'split $1,000.00 each from Engineering and Planning Department's
Engineering and Architectural Services FY 93/94 budget, and Main Street via grant from
Southern Bell, for market study for Joint Waterfront-Main Street Project. Seconded by
Commissioner Howell and carried by the vote of the Commission as follows:

Amendment No. 9 to Agreement with Conklin, Porter and Holmes for water line extensions and

Center Mall. On recommendation of the City Manager, Commissioner Howell moved to authorize
execution of letter of authorization for additional services in amount of $7,714.24, for
design of reclaimed water main extensions to serve Seminole Towne Center Mall; to increase
the Scope of Services in AmendmentNo. 9 to Agreement dated December 17, 1987, with Conklin,
Porter and Holmes. Seconded by Commissioner Thomas and carried by the vote of the Commission

Pipeline Crossing Agreement with CSX Transportation, Inc., for continued maintenance of
reclaimed water pipel4-- at or near the City of Sanford, in the vicinity of Elliott Avenue
and North Street ("The Crossing"). On recommendation of the City Manager, Commissioner
McClanahan moved to authorize execution of said Pipeline Crossing Agreement No. CSX-020006
with CSX Transportation, Inc., for continued maintenance of reclaimed water pipeline at or
near the City of Sanford, in the vicinity of Elliott Avenue and North

Information regarding invoices paid during the period for previously approved lump sum
contracts. The Commission acknowledged three (3) invoices totalling $6,239.46.
Petition to Annex, David J. and Nita M. Zelenak, owners. City Manager reported that Staff
is trying to get Seminole County to agree not to issue a County building permit if an
annexation is underway, and that he will keep the Commission apprised of the situation.
Old Party Machine PropertY. Commissioner McClanahan requested that Staff provide a status
report regarding the old Party Machine building that burned down and is being propped up
unsafely.
Property at Fifth Street and Palmetto Avenue. Commissioner Howell reported that the property
at this location is being converted into apartments, for which the owner has indicated a
permit has been issued, and requested that Staff look into the matter.
Confirmation of appointment and re-appointments to the Sanford Local Option Public Employees
Relations Commission ("PERC"). On recommendation of the City Manager, Commissioner Thomas
moved to confirm the appointment of Cliff Miller and the re-appointment of Sylvester Chang
and Charles Volk. Seconded by Commissioner Eckstein and carried by the Commission as

Condemnation Report %93-3, 1017 West 13th Street (Starr Theatre), Interdenominational
Ministerial Alliance of Seminole County, owner.
Reverend Player appeared and requested a time extension to complete the necessary
repairs to bring this property up to code.
City Manager reported that this item will be brought forward to the November 22,
1993, Regular Meeting, for City Commission consideration.
