121393-Regular Meeting MINUTES City Commission, Sanford, Florida Reou]ar Nleetinc December 13 19~3 The City Commission of the City of Sanford, Florida, met in Regular Meeting on Monday, December 13, 1993, at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Bill Marcous reported that the Florida Government Communicators Association has selected the City of Sanford to receive the 1993 Community Relations Award, for the City's Access 93 Meetings, and presented Mayor Smith with a plaque regarding same. Public Hearing to consider changes and amendments to the Zo-~ng Ordinance/Land Development Regulations to incorporate the "Old Sanford Regulations", as advertised in the Sanford Herald on December 2, 1993. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed changes and amendments. Jami Meeks, President, Sanford Historic Trust, 621 Park Avenue, appeared and requested that the City Commission support and vote in favor of the proposed architectural guidelines/regulations, and submitted an endorsement for same signed by eight (8) persons. Recommendations submitted from the Planning and Zoning Commission and Director of Planning and Development to approve the proposed changes and amendments. Commissioner McClanahan moved to refer the proposed Adult Entertainment Regulations, including City Code and Land Development Regulation Amendments, to the Planning and Zoning Commission for formal review and recommendations. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the rezoning. Ann Alexander, 198 Elder Road South, appeared and reported that Elder Road cannot handle the additional traffic that would be generated by the proposed development. Richard Holiday, HOH Associates, Inc., 1560 Orange Avenue, Winter Park, appeared and reported that he represents Leo Trepanier and Lois Paulucci, owner/applicants, that the plan represents the total property (just under 19 acres) proposed to be rezoned to multiple- family, for construction of 379 multiple-family units. Jay Marder, Director of Planning and Development reported that Planned Development zoning offers fleXibility as well as restrictions, that the developer can propose whatever he wants within the context of the City's Comprehensive Plan, and is required to present a planned development master plan as part of the rezoning. MINUTES City Commission, Sanford, Florida Reqular Meet n December ]3 19 93 City Manager reported that it will be difficult to put a twenty-four (24) foot roadway within a thirty (30) foot right-of-way, and recommended that the developer be required to acquire the necessary right-of-way to facilitate a better access road. Mr. Holiday reported that after review of the initial plan submitted by the developer, City Staff requested the deVeloper to provide a secondary access when the Elder Road right-of-way north of this property is acquired, and until such time there would be no access road on Elder Road, and the developer agreed to do so. Further, he would be willing to continue this matter to discuss/address concerns. Commissioner McClanahan reported that there needs to be some restrictions/requirements i.e. the development will be built in phases (specified number of units) based on traffic flow; with the remaining units being considered at a later date. DirectOr of Planning and Development reported that Elder Road access is desirable but not necessary for this project, since Upsala Road traffic counts are within capacity even with this project. Recommendation submitted from the Planning and Zoning Commission to approve the rezoning. Director of Planning and Development recommended approval, conditioned upon developer providing access to Elder Road and construction of that portion of Elder Road adjacent to the site at such time as the segment between the property and SR 46 is constructed/improved. On recommendation of the City Manager, Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to rezone the property as recommended, with the Master Plan to include approval for 50% of the requested development at this time, with the remainder to be considered at a later date, after a traffic study. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the rezoning. The following individuals appeared: Susan Hughes, 228 West 18th Street, reported this is the only free access field in the area, the 15th Street and French Avenue intersection is dangerous and there have been 20 auto accidents there to date this year, Sanford Middle School is directly across from this field and there have been four accidents at the school crossing to date, people crossing the street will have to dodge traffic coming into and out of a commercial building, more development will increase accidents, the field is used as a landing site by the air ambulance helicopter, other parks in the area are either not large enough or are not accessible at all times, and requested this field be kept open as it is. Curt Jansen, 221 West 17th Street, reported he thought that none of the property would be developed commercially, they do not want any more commercial development there, and they want the field left as open as possible. Further, although the homeowners had stated 72 MINUTES City Commission, Sanford, Florida Rsgu18r Nleeting December 13 19 93 they would raise funds for the property, nothing has been done because the homeowners did not know what the City was going to do. Lisa Nason, 900 South Magnolia, requested clarification of "public safety complex", and requested if at all possible, that funding be obtained other than by selling the portion of the property which fronts on French Avenue for commercial development. Bill Terwilliger, 15th Street, reported he is concerned about traffic on 15th Street and on Laurel Avenue if a fire station/public safety complex is constructed on 15th Street, and the street is not wide enough for emergency vehicles to turn. Joe Young, retired Sanford Middle School teacher, reported that in the six years the school's physical education classes used the field there was only one accident, and that safety is a matter of control. Sylvia Smith, 425 West 18th Street, repOrted that the car dealership on 17-92 and directly west of her property has no access onto 17-92 and closes at dark, that a retail- commercial center on three acres would encroach further easterly into the neighborhood and will detrimentally impact traffic, noise, and lights, 24 hours a day. Further, even though it was a good action to clean out under the trees, it has detrimentally affected her quality of life by opening up a noise factor and a light factor from Checkers. She stated that the city could apply for grant money for a recreational facility on the property; that their main concern is they do not want commercial development any further east than it already is; a public safety complex at 15th Street would be detrimental because a major traffic hazard already exists at Checkers; the shopping center entrance at 15th Street is a hazard; the major dip in the pavement at the entrance is a hazard; a public safety complex would be better suited on the 18th Street/17-92 corner; they would like to see all the property kept for recreation. City Manager reported that the City does not intend to be the developer of the commercial portion of this property, that once the property is rezoned the land will be sold, with the new owner being required to submit a development plan/proposal. Further, no more than one-half of the property will be developed for a safety complex. Recommendations submitted from the Planning and Zoning Commission and the Director of Planning and Development to approve the rezoning. After discussion, and on recommendation of the City Manager, Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to rezone the property as advertised. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the rezoning. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the rezoning. No one appeared Recommendation submitted from the Director of Planning and Development that this item be tabled until a related comprehensive plan amendment is processed. On recommendation of the City Manager, Commissioner Eckstein moved to table the public hearing until the first meeting in May, 1994. A. Report 993-06, 1804 Cedar Avenue, Jay M. and Meggan E. Fues, owners. B. Report 993-07, 1011 Holly Avenue, Turner Clayton, Jr., owner. C. 'Report 993-09, 1111 Sanford Avenue, vernell R. Roberts, owner. Vernell Roberts, owner, 1111 Sanford Avenue, appeared and reported that this property is rented as a single-family residence, that the illegal use of said property has been corrected, and requested that demolition of this building/structure be held in abeyance. City Manager recommended that upon completion of the public hearing, the Commission make a finding of condemnation, and authorize a thirty (30) day extension for the owner to complete repairs to bring the property up to code. Commissioner Thomas moved to-remove Item C, Report 993-09, 1111 Sanford Avenue, Seconded by Commissioner Howell. Commissioner Thomas withdrew from the condemnation list. the foregoing motion. Donald Flowers, 1121 South Sanford Avenue, appeared and submitted a petition requesting this property be demolished. He stated that the house is being used as a crack house, that people in the neighborhood are losing money, that there are continuous break-ins, and that since the prior tenants left the building, crime has gone down substantially. Further, Mr. Roberts was aware that the property was being used as rooming house. Commissioner Eckstein moved that finding the above-referenced structures A, B, and C, to be unsafe, dilapidated, unsanitary or uninhabitable, that said structures be condemned, and the property owners granted a time period of 30 days in which to demolish and remove said buildings or structures or place them in a state of sound repair.
