022894-Regular MeetingMINUTES City Commission, Sanford, Florida 121 R_eau!_. eetina_ February 28 19 The City Commission of the City of Sanford, Florida, met in Regular Meeting on Monday, February 28, 1994, at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas, Jr. Commissioner A. A. McClanahan Commissioner Lon K. Howell City Attorney William L. Colbert City Manager William A. Simmons City Clerk Janet R. Donahoe The Chairman called the meeting to order. Public hearing to consider closing, vacating, and abandoning a ~ortion of the north-south alley between French Avenue and Laurel Avenue and between West 25th Street and Bayard Street~ WEB Properties, Inc., applicant. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the vacating. Allen Carpenter, Engineer, Conklin, Porter & Holmes, 399 Lake Road, Lake Mary, appeared and reported that he represents WEB Properties, that he brought a conceptual site plan for City Commission review if so desired, and that he was available to answer questions. Further, the vacating only goes to the south side of Sid Gailey's property line, and that the rest of the alley will stay open. Commissioner McClanahan asked if there was any input from individuals which may be impacted by this vacating. The City Clerk reported that notices of the public hearing were posted at both ends of alley on February 14, 1994, and that adjacent property owners were notified February 11, 1994. Jay Marder, Director of Planning and Development, reported that Sid Gailey's house was sold and made a part of this parcel/development. Julia Jamison, 2504 Laurel Avenue, appeared and reported that the alley runs behind her property, and asked how the vacating of same will affect her house. Mr. Allen reported that the portion of alley behind Ms. Jamison's house will remain open. Jerry Evans, WEB Properties, appeared and reported that based on preliminary cost estimates, and barring any unforseen circumstances, he is prepared to pay all costs associated with the relocation of the utilities located in the alley. Further, he should have firm prices before the vacating process is complete. Commissioner McClanahan recommended that this item be tabled, pending determination of any additional costs. Recommendations submitted from the Plans Review Committee to approve the vacating with conditions/stipulations. On recommendation of the City Manager, Commissioner Howell moved to authorize the City Attorney to prepare the proper ordinance to close, vacate, and abandon the alley as requested, with conditions/Stipulations as recommended by the Plans Review Committee, and described in memorandum dated February 18, 1994, from Land Development Coordinator. Ordinance No. 3197, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3146 WHICH ESTABLISHED A COMMUNITY POLICING TEAM (CPT) BY EXTENDING ITS AUTHORIZATION AND SOURCE OF FUNDING; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. introduced and placed on first reading at meeting of February 14, 1994, was next plaCed on second reading. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the adoption of Ordinance No. 3197. No one appeared. Commissioner Thomas moved on the second reading and adoption of said Ordinance No. 3197. On January 10, 1994, the low bid, from Mid Florida Environmental Services, was accepted pending satisfactory submittal of all insurance and bond documentation; Mid Florida Environmental Services was unable to submit the required documentation. The Utility Director and the City Manager recommended acceptance of the second lowest bid, which met specifications, from Bio Gro, at unit price of $140.00 per load. (2) Re-bid %93/94-20, Fluorescent Light Fixtures (Recreation and Parks Department). City Manager recommended acceptance of third lowest bid, which met specifications, from Consolidated Electric in amount of $5,123.32 (The two (2) lowest bids did not meet specifications). (3) Bid %93/94-24, Laboratory Equipment (Utility Department). The Commission acknowledged twelve (12) invoices totalling $130,890.94. Municipal Stadium. On request of Commissioner Eckstein, the Commission concurred to have Staff explore the possibility of using the stadium for baseball and softball tournaments, and obtain information regarding advertising and promotion of same. Status report regarding banner sign on building at the south west corner of Sanford Avenue and First Street. City Manager reported that he checked into this matter and found no banner sign that appeared to be out of order at this location. The Commission asked the City Manager to once again review the situation and report back to the Commission. Request from AMVETS POST %0017 to purchase or lease the PBA Building, as discussed at tonight's Work Session. On recommendation of the City Manager, Commissioner McClanahan moved, with regrets, not to accept the AMVETS proposal to lease the PBA building. Seconded by Commissioner Howell. On recommendation of the City Manager, Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to amend Ordinance No. 3075 (Classification and Pay Plan), to reclassify the position of "Parking Enforcement Specialist" to "Community Service Officer", as requested. On recommendation of the City Manager, Commissioner Howell moved to authorize execution of the Right-of-Way Agreement with Eoghan N. Kelley and Harold G. Hartsock, contingent upon immediate receipt of "right to access" the property by surveyors and the City's engineers. Also, Staff to pursue the possibility of using CDBG funds for the un-funded portion of this project.
