091294-Work Session252 MINUTES City Commission, Sanford, Florida Work Session September 12 19 94 The City Commission of the City of Sanford, Florida, met in Work Session on Monday, September 12, 1994, at 4:00 o'clock P.M. in the City Manager's Conference Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas, Jr. Commissioner A. A. McClanahan Commissioner Lon K. Howell City Manager William A. Simmons City Clerk Janet R. Dougherty Absent: City Attorney William L. Colbert The Chairman called the meeting to order. Request from Johnell Jackson, Westside Homeowners Association, for City to review/address law enforcement issues/concerns in black communities. Bruce Antone, Senator Dyer's Office was present. Johnell Jackson discussed his concerns about the lack of application of certain Florida Statute nuisance laws in minority areas; read a petition which he stated was signed by approximately 500 individuals, expressing their concerns, recommendations and requests relative Certain laws not being applied equally in minority areas, the high crime rate, the future welfare of the younger generation, and the quality of leadership; recommending that the City Commission consider changing the administrative leadership, and requesting that the nuisance laws be applied as prescribed by law, thus providing a better environment and crime reduction; and reviewed a report regarding crime statistics in Seminole County, indicating that of the 18,000 crimes committed in the County in 1992, 3,221 were in the City of Sanford. Mr. Jackson requested fair and equitable law enforcement and code enforcement in the minority areas as in other communities for a better community morally. Further, the majority of grant funds obtained for utilization in minority communities are distributed elsewhere. Also, Ministerial Alliances and the Westside Homeowners' Association will support the City's efforts in the enforcement of these laws. City Manager reported that enforcement of Florida Statute 823.05 will require support from all segments within the community. Further, Staff will review and determine the best course of action relative the allocation of drug confiscated funds, as provided by Florida Statutes. City Manager requested that Mr. Jackson provide a copy of the statistical crime report discussed at tonight's Work Session, for Staff review and further discussion. Mayor Smith requested that Mr. Jackson provide a list of locations needing Code Enforcement. (Mayor Smith recessed the meeting at 4:57 P.M., then reconvened at 5:05 P.M.) Request from Academy Manor Neighborhood Association, for City action regarding loitering in the park, installation of sidewalks, problems with stormwater drainage, and excessive speed on neighborhood streets. Joan Campbell, President, Academy Manor Neighborhood Association ("Association"), reported that. individuals are entering the park at night, playing basketball, drinking alcohol and breaking bottles, and that the Association would like the park to be locked up at night, and to have a community center in the park in the future. MINUTES City Commission, Sanford, Florida Work Session 253 September 12 19 94 After discussion of items/concerns described in Ms. Campbell's letter dated August 1, 1994, and on recommendation of the City Manager, the consensus of the Commission was to increase police patrol and appropriate response to complaints at Academy Manor Park rather than lock the park at night; approve installation of a sidewalk; funding in amount of $42,900.00 is LOGT eligible, on one side of the street as outlined in memorandum dated August 31, 1994, and post "no parking" signs on the side of the street where the sidewalk is installed; monitor drainage problems in the Academy Manor area to ensure that the drainage system and its outfalls remain clear, and re-invert swales and ditches as appropriate, with periodic checking of park grading to ensure that water flows toward existing catch basins; no consultant study at this time; and install seven (7) speed humps with a "calibration" of 25-miles per hour, plus two additional speed humps as requested by Ms. Campbell. Special Event Applications. A. First Shiloh Missionary Baptist Church for Martin Luther King Celebration on January 16, 1995; tabled at August 22, 1994, Work Session, pending additional information relative required liability insurance and police officers for previous church events. Reverend Rucker, First Shiloh Missionary Baptist Church, was present. City Manager reported that the only past church special event, similar in nature to this application, that did not require a police officer was First Baptist Church's "Youthblast", which initially required a police officer, but was subsequently waived because the number of participants/spectators involved in the event decreased, and live music was no longer involved. (Assistant City Attorney Donna L. McIntosh joined the meeting.) After discussion, the Commission referred this item to tonight's Regular Meeting for City Commission consideration. B. Greater Seminole Chamber of Commerce for Airshow at Central Florida Regional Airport on October 29, 1994. Request includes street closures and sale/consumption of alcoholic beverages. City Manager reported that this application was brought before the City Commission for information, and that Staff proceed with same unless otherwise directed by the Commission. The Commission had no comments/questions. Request from seminole county, for city water and sewer service for proposed Seminole County Affordable Housing Demonstration Pro~ect. City Manager reported that the Seminole County Planning and Zoning Commission voted to deny this project. Augmentation of City Code Enforcement Program. After discussion, the consensus of the Commission was to hire one temporary (180 day) contractual code enforcement inspector and one part-time clerical worker, effective October 1, 1994, with funding from contingency funds. Waterfront Master Plan Steering Committee recommendation to install additional sidewalk alonq lakefront between Sailpointe Apartments and City Hall. City Manager reported he concurs with the Waterfront Master Plan Steering Committee's recommendation to construct an additional sidewalk as described in memorandum dated August 29, 1994. Further, Seminole County is expected to receive funds for sidewalks, which the City will seek to partially cover this expense. Staff was directed to contact Sheriff Eslinger to discuss the possibility of using prison labor through Seminole County's Community Service Program. 254 MINUTES City Commission, Sanford, Florida Work Session September 12 19 94 Solid Waste Management Interlocal Agreement with Seminole County. The Commission had no questions or comments. Alternative fuel vehicle initiative. On recommendation of the City Manager, the Commission concurred not to participate in Seminole County's alternative fuel vehicle initiative at this time. Fences in City right-of-ways. Assistant City AttOrney Donna McIntosh reviewed the City's options including 1) compel all fences in City right-of-ways to be removed; 2) develop standards/criteria for utilization of right-of-ways. After discussion, the Commission concurred to have Assistant City Attorney draft standards and procedures for approving fences in City right-of-ways. (Mayor Smith briefly left the meeting, then returned.) Former Sanford Manufactured Gas Plant. Assistant City Attorney Donna McIntosh recommended the City retain Thomas K. Maurer, Esq., Foley and Lardner, as co-counsel with respect to this matter, and stated that every attempt will be made not to have two attorneys working on the same issue/aspect of the case, and that she will handle matters whenever possible. Proposed ordinance establishing requirements for reimbursement of a portion of costs associated with installation of infrastructure. The consensus of the Commission was to authorize Staff to proceed with the proposed ordinance, and strengthen the Land Development Regulations regarding oversizing requirements. (Mayor Smith recessed the meeting for approximately 5 to 10 minutes, then reconvened the Items and other items. A. Request from Amefika Geuka, Goldenrule Housing and Development Corporation, for waiver of $75.00 variance fee, for low income housing project at 2548 E1 Capitan Drive. City Manager recommended denial of the requested waiver because of significant out-of-pocket City expenses. The City Commission referred this item to tonight's Regular Meeting for City Commission consideration. B. Agenda Item %17; Public Hearing - vacate all of 24th Place between Princeton Avenue and Poinsetta Avenue and a portion of a north-south alley between Grandview Avenueand 24th Place and between Princeton Avenue and Poinsetta Avenue. City Manager reported that he concurs with the Plans Review Committee's recommendation to vacate the fourteen (14) foot north-south alley retaining same as a utility easement; granting the owner a right-of-way use permit for driveway/carport use instead of vacating the remaining east-west street right-of- way, and requiring the owner to obtain a building permit for the metal carport and a dimensional variance for the non,conforming setbacks. C. Request for authorization to retain Coopers and Lybrand to conduct an in-depth internal audit of the Licensing Division. Finance Director Carolyn Small recommended the City retain Coopers and Lybrand at an amount not to exceed $10,000.00, as a general fund expenditure, for an in-depth internal audit of the Licensing Division, which will be a two phase approach: 1) identification of the problem and individuals involved; and 2) quantification of what funds, if any, may be missing. Request~Or 90 day advance order of front-end loader from FY94/95 funds. City Manager reported that LOGT and Stormwater funds are available for this expenditure. Agenda Item #26~ B and C, first reading of Ordinance No. 3227, Firefighters' Pension Plan~ and Ordinance No. 3228, Police Officers' Pension Plan. City Manager reported that the City Attorney has requested the first reading of these two ordinances be tabled until the September 24, 1994, Regular Meeting. F. Arbitrage Consultant. Finance Director Carolyn Small recommended that the City retain the firm of Ernst and Young, for arbitrage consultant services, regarding 1989 and 1991 bonds issues, at an amount not to exceed $10,000.00.
