121294-Regular Meeting322 MINUTES City Commission, Sanford, Florida Regular Meeting December 12, 1994 The City Commission of the City of Sanford, Florida, met in Regular Meeting on Monday, December 12, 1994, at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford, Florida. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner Robert B. Thomas, Jr. Commissioner A. A. McClanahan Commissioner Lon K. Howell City Attorney William L. Colbert City Manager William A. Simmons City Clerk Janet R. Dougherty The Chairman called the meeting to order. Public Hearing to consider closing, vacating and abandoning a ~ortion of a 20 foot north- south drainage easement lying between Northstar Court and Coastline Road and between Upsala Road and Central Park Drive, as advertised in the Sanford Herald on November 24, 1995, and first reading of Ordinance No. 3235. The Chairman announced that the Commission would hear from those persons present to speak regarding the proposed vacating. No one appeared. The City Clerk reported that the property was posted November 23, 1994, and the owners notified November 22, 1994. Recommendation submitted from the Plans Review Committee to approve the vacating as advertised. After being read by title, Commissioner Howell moved on the first reading of Ordinance No. 3235, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF THAT CERTAIN 20 FOOT WIDE NORTH-SOUTH DRAINAGE EASEMENT LYING BETWEEN NORTHSTAR COURT AND COASTLINE ROAD AND BETWEEN UPSALA ROAD AND CENTRAL PARK DRIVE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. Seconded by Commissioner McClanahan and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Public Hearing to consider closing, vacating and abandoning a 15 foot wide east-west utility easement lying on the northerly portion of the property located at 2524 Hiawatha Avenue, as advertised in the Sanford Herald on November 28, 1994, and first reading of Ordinance No. 3236. The Chairman announced that the Commission would hear from those persons present to speak regarding the proposed vacating. No one appeared. The City Clerk reported that the property was posted November 25, 1994, and the owners notified November 28, 1994. The City Manager reported that the Plans Review Committee recommends approval of the vacating, conditioned upon the dedication of a ten (10) foot utility easement along the north boundary line of the property at 2524 Hiawatha Avenue to cover the existing sewer line, and that he concurs with said recommendation-, subject to receipt of the Grant of Easement prior to adoption of the ordinance. After being read by title, Commissioner McClanahan moved on the first reading of Ordinance No. 3236, entitled: MINUTES City Commission, Sanford. Florida Regular Meeting 323 December 12, 1994 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THAT CERTAIN 15 FOOT WIDE EAST- WEST UTILITY EASEMENT LYING ON THE NORTHERLY PORTION OF THE PROPERTY AT 2524 HIAWATHA AVENUE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, Ordinance No. 3231. No one appeared. Mayor Smith repOrted that the applicant has requested that the request to vacate be withdrawn. Ordinance No. 3233, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3230, TO ESTABLISH ONE (1) ADDITIONAL "LICENSING OFFICIAL" POSITION PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. introduced and placed on first reading at meeting of November 28, 1994, was next placed on second reading. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the adoption of Ordinance No. 3233. No one appeared. The City Manager reported, as discussed at tonight's Work Session, there is no longer a need to create an additional licensing official position, and requested that the Commission deny the adoption of Ordinance No. 3233 regarding same. City Commission, Sanford, Florida Regular Meeting December 12, 19 94 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3230, AND ITS AMENDMENTS, AND ADOPTING AN AMENDED CLASSIFICATION AND PAY PLAN EFFECTIVE IMMEDIATELY TO DELETE THE TWO (2) "OUTREACH WORKER" POSITIONS FROM THE DEPARTMENT OF COMMUNITY DEVELOPMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. introduced and placed on first reading at meeting of November 28, 1994, was next placed on second reading. Ordinance No. 3237, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3215, WHICH CLOSED, VACATED AND ABANDONED A PORTION OF JEWETT LANE LYING BETWEEN RINEHART ROADAND UPSALA ROAD, AMENDING SECTION 1 THEREOF TO CORRECT THE LEGAL DESCRIPTION THEREIN; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. introduced and placed on first reading at meeting of November 28, 1994, was next placed on second reading. No one appeared. Commissioner Howell moved on the seconded reading and adoption of said Ordinance No. 3237. Lee, Architectural Design Associates, Inc., for Right-Of-Way Use Permit on the west side of Laurel Avenue between 9th Street and 10th Street, for 15 perpendicular parking spaces. Commissioner Howell moved to deny the requested right-of-way use permit for perpendicular parking. Seconded by Commissioner Thomas. City Manager recommended approval of the right-of-way use permit with 60 degree diagonal parking instead of perpendicular parking. Commissioner Howell withdrew his motion to deny the right-of-way use permit. Commissioner Howell moved to authorize the right-of-way use permit on the west side of Laurel Avenue between 9th Street and 10th Street, conditioned upon 60 degree diagonal parking, with the parking area to be paved with pervious concrete, and open to the public. Modification to Interlocal Agreement with Seminole County, City of Lake Mary, et al regarding schedule for construction of I-4/CR 46A interchange. On recommendation of the City Manager, Commissioner Thomas moved to authorize execution of said Modification to the original Interlocal Agreement between Seminole County, City of Lake Mary, et al dated February 28, 1994, relating to the funding of the I-4/CR 46A Interchange, assignment of rights Under "StiPulation and Agreement" and funding of Rinehart Road with Consents, said modification relating to change of project schedule. Seconded by Commissioner Howell and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Status Report of all current and pending Condemnations. Board appointments/re-appointments. No action required or taken. Central Examining Board: The City Clerk reported that the terms of Roosevelt Green, A1 Porzig and Elmer Smith expire January 10, 1995, and that all have been contacted and are willing to serve again, if re-appointed. Commissioner McClanahan moved to re appoint Roosevelt Green, A1 Porzig and Elmer Smith to the Central Examining Board. Seconded by Commissioner Howell and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye Civil Service Board: The City _~lerk reported that Ernie Cavallero has resigned from the Civil Service Board, effective immediately. Also, there is one vacancy (alternate member). Commissioner Eckstein moved to accept Ernie Cavallero's resignation, and to appoint Bill Royster to replace Mr. Cavallero on the Civil Service Board. Request for payment of statement from Foley & Lardner for professional services through October 31, 1994, for City Coal Gasification, in amount of $40.50. B. Approval of Vouchers for the Month of November, 1994. Approval of Minutes of November 28, 1994, Work Session; and November 28, 1994, Regular Meeting. Approved Minutes of November 28, 1994, Work Session; and November 28, 1994, Regular Meeting. Information regarding invoices paid during the period for previously approved lump sum contracts. The Commission acknowledged three invoices totalling $422,086.53. Police Radios. Commissioner Eckstein moved that each member of the Commission return their police radios to the Police Department, with the exception of the Police Liaison Commissioner, thereby saving approximately $14,000.00. Seconded by Commissioner McClanahan and carried by the vote of the Commission as follows: Mayor Smith Aye Commissioner Eckstein Aye Commissioner Thomas Aye Commissioner McClanahan Aye Commissioner Howell Aye COPS FAST Program Application, as discussed at tonight's Work Session. On recommendation of the City Manager, Commissioner Eckstein moved to authorize Mayor Smith to execute the COPS FAST Program Application.
