355 ORDINANCE NO. 31)') ~ ORDINANCE OF THE crn OF SANFORD, FLORIDA, GIVING AND GRANTING UNTO ORANGE STATE OIL COMPANY, A FLORIDA OORPORATION, OF MIAJ4I, FLORIDA, THE RIGHT, PRIVILEGE AND EASEMENT FOR THE TIME HEREIN STATED OF LAYING AND MAINTAINING PIPE LINES AND CERTAIN OTHER NECESSARY FAOILITIES UNDER GROUND ACROSS THAT PORTION OF WATER STREET LYING BETWEEN THE WEST LINE OF MYRTLE AVENUE IN THE CITY OF SANFORD, FLORIDA, AND A LINE 199.5 FEET WEST THEREOF; DEOLARING SAID RIGHT, PRIVILEGE AND . EASEMENT NOT TO BE ltXCLUSIVE AND FORBIDDING THE ERECTION OF ANY BUILDINGS ON SAID PORTION OF WATER STREET AND REQUIRING SAID ORANGE STATE OIL COMPANY TO SAVE THE CITY OF SANFORD HAlUILESS AND DEFEND IT IN ANY SUIT ON ACCOUNT OF DAMAGES TO ANY PERSON, FIRM OR OORPORATION BY REASON OF 'fHE GRANTING OF SAID RIGHT, PRIVILEGE AND EASEMENT. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Orange State 011 Company, a Florida oorporation, of Miami, Florida, be and it is hereby given and granted the right, privilege and easement of laying or oausing to be laid, and maintaining or causing to be maintained, pipe lines and other facilities under ground necessary to its business on adjoining property, across that portion of Water Street in the City of Sanford, Florida, lying between the west line of Myrtle Avenue in said City and a line 199.5 feet west thereof. SEOTION 2: That the right, privilege and easement hereby given and gra.nted unto the aforesaid Orange State 011 Company is given and granted for such length of time aa it oonduots or oausee to be conducted through its tenants or assigns a gasoline, oil and petroleum business on adjoining property and is not given and gr~mted as an exolusive right, privilege and easement and said right, privilege and easement i8 given and granted upon the condition that no building or buil~lng9 shall be erected upon aa~d portion of Water Street by said Orange State Oil Company, ita suooeRsors or assigns and the erect10n of buildings of any kind upon sald portion of Water Street is hereby prohibited and any pipe lines and other facilities placed under said portion of Water Street by said Orange State Oil Companydlftall be plaoed at suoh depth thereunder as not to interfere with any improvements which the City of Sanford may wish to make upon said portion of Water Street. , SECTION 3: That by exeroise of the right, privilege and easement hereby grAnted said Orange State Oil Company agrees to save the City of Sanford, Florida, harmless from any and all da.mages to any person, firm or oorporation oocasioned by the exeroi se of the right, privilege and ea,semen t here~l given to said Orange State Oil Company and will defend the said City of Sanford, Florida, in any aotion brought against it on account thereof. SECTION 4: That all ordinances or parts of o~dlnanoes in oonfliot herewith be and the same are hereby repealed.
