GRANT OF EASEMENT
THIS INDENTURE, made this 16th day of June , A.D. 1999 between
EDWARD J. TERRY and WILLIAM J. BENSON, as Co-Trustees of the First Street Trust
dated 10/27/97, whose address is 2434 Sherbrooke Road, Winter Park, FL 32792 and
P.O. Box 291579, Port Orange, FL 32129, parties of the first part, and CITY OF
SANFORD, FLORIDA, a municipal corporation, whose address is 300 N. Park Avenue,
Sanford, FL 32771, party of the second part;
WITNESSETH, that parties of the first part, for and in consideration of the sum of
One Dollar and other valuable consideration to have in hand paid by party of the second
part, receipt whereof is hereby acknowledged, have granted and conveyed, and by those
presents does grant and convey to party of the secor,~L, part, its successors, assigns, and
licensees, a perpetual easement under, upon and across the property situate in Sanford,
Seminole County, Florida, more particularly described as:
20' PERMANENT UTILITY EASEMENT
The South 20.00 feet of the following: Begin 51.60 feet West and 1055.06
feet South of the North 1/4 corner, run South 396.00 feet, run East 330.00
feet, run North 396.00 feet, run West 330.00 feet to the Point of Beginning
(less the South 200.00 feet of the West 200.00 feet and less roads on the
South and West) in Section 26, Township 19 South, Range 30 East,
Seminole County, Florida, lying North of State Road 46.
for utility purposes, including specifically potable water, reclaimed water distribution
system, sanitary sewers and drainage, and for the installation, inspection, servicing, repair,
maintenance and replacement of all utilities now existing or hereafter to exist on said
property, such easement including the right of free ingress and egress over and across
said property for any of the purposes aforesaid. The City of Sanford shall be responsible
for the restoration of property to a condition equal to or better than prior condition following
any of the aforementioned activities by the City of Sanford.
