WHEREAS, said properties are adjacent to each other. WHEREAS, the CITY OF SANFORD has agreed to grant an easement for ingress, egress and public utility service over and across the property described on Exhibit "A"; NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, and other good and valuable considerations, the receipt and sufficiency of which is hereby acknowledged, the CITY OF SANFORD declares as follows: 1. The CITY OF SANFORD hereby grants to the lessees, their guests, employees, invitees and the general public, an easement and right of way, together with the full and free right for him, her and them, and his, her and their tenants, servants, visitors and licensees, in common with all others having the like right, at all times hereafter with or without automobile or other vehicles or on foot, for the purpose of ingress, egress and public utility service to and from Lots 1 through 8 of Sanford Riverfront Project and for all other purposes connected with the use of said lots to pass and re-pass over and across the property described on Exhibit "A." 2. It is further understood and agreed that the easement granted herein is to be held by the respective lessees as appurtenant to the land owned by the respective grantor. So long as this easement grant remains in effect the easement area shall not be used for any purpose other than the uses permitted under this Declaration of Easement, and no building, structure, improvements or development other than as is contemplated for or permitted under this Declaration of Easement shall be constructed thereon unless otherwise authorized by the City of Sanford. There shall be no use nor obstruction or impediments in the easement area in any way that will impair, obstruct, or will interfere with the purpose of the easement defined herein.
