Commissioner Bridges moved to condemn the structure located at 1709 West 13th Street and allow sixty (60) days in which to erect and encircle and encompass the property with a secured fence, after which allow thirty (30) days to commence work and substantially improve the interior residential structure, with the understanding that it will be monitored by City Staff. [Commission Memo 07-002] The Commission asked City Manager Yehl to invite representative(s) of the Association Board to attend the next Work Session to address the problem of its utility debt. B) 412 East 5th Street: request to waive Code Enforcement fineslliens in the amount of $30,993.86. [Commission Memo 07-010] Commissioner Bridges moved to approve the applicant's request reducing the monetary sum due to the City to $5,035.09, conditioned upon Mr. Giuliani actually taking title to the property, that this waiver is not transferrable to any other applicant, and that the reduced sum be paid to the City simultaneously with the closing on the property, and that the easement be concurrently given to the City, subject to a waiver of any prior claim for any monetary damage liability to the City as to whether or not the City had a prescriptive easement so the City will never have to meet that challenge at any point in the future relative to this easement.
