AGREEMENT
THIS AGREEMENT.. made and entered into this 19th day of
May
" A. D... 1975.. by and between the CITY OF SANFORD.
hereinafter called the "City"" and TIME CONSTRUCTION COMPANY OF FLORIDA,
INC... a Florida corporation.. hereinafter called the "Developer";
WHEREAS" Developer has a Contract to purchase from Newb'.lrgh
Development Corporation the following described property:
Being a portion of Section 13.. Township 20 South"
Range 30 East" County of Seminole.. described
as follows: The NE 1/4 of the SW 1/4 of said
Section 13. less the westerly 33 feet for road
purposes", and also that portion of the SW 1/4 of
the NW 1/4 of said Section 13.. less State Road
427 right of way.
and
WHEREAS" that certain Contract dated October 15" 1973, between the
City of Newburgh Development Corporation was rescinded by official action of
the City Commission of the City of Sanford on Monday" May 12, 1975. and
WHEREAS.. in order to develop the above described property the
Developer will need sewer and water service to accommodate the construction
of one hundred twenty five (125) single family units, and the City of Sanford is in
a position to and is agreeable to furnishing such utilities in accordance with the
terms and provisions hereinafter set forth.
NOW THEREFORE" in consideration of the mutual benefits to be
derived by the parties hereto and the mutual covenants hereinafter specified
the parties hereto agree as follows:
1. Developer shall within six (6) months of the date of this Agreement
construct water lines and sewer lines in accordance with the standard specifications
of City from that certain property presently owned by Dreyfus Interstate Develop-
ment Corporation into the above described property" it being specifically

understood by the parties that said construction be seventy (70%) percent
complete within six months of the date of this Agree me nt. In addition to the
water and sewer lines, Developer agrees to construct streets and a drainage
system in accordance with the standard specifications of the City throughout
the development of the above described property, said construction to be
substantially completed within eighteen (18) months of the date of this Agreement.
That all costs for the installation of the water and sewer lines, streets and
drainage system shall be paid for solely by Developer.
2. City agrees to provide sufficient water and sewer service to
service one hundred twenty five (125) single family dwelling units on the above
described property. The monthly utility rate for such water and sewer service
shall be the standard rate charged by the City for service of utilities situated
within the city limits of the City of Sanford multiplied by a factor of 1.25 or such
other factor as may be established as a policy of the City of Sanford at any future
date.
3. In the event all construction of water and sewer lines, streets
and drainage system is not completed within the times specified in this Agreement,
the water and sewer service to said property shall be discontinued. It is the
specific unde rstanding of the parties hereto that time is of the essence in the
performance of this Agreement.
4. The parties specifically agree that Developer shall not have the
right to assign its rights under this Agreement to any other party.
