HUTUAL All) AGl{J~Ef\lENT All parties to this agreement have established and maintain fire departments with fire fighting equipment and fire fighting personnel, and WHEREAS, it appears desirable that an Agreement be entered into bet\veen the parties for their mutual benefit in times of emergency, NOW, THEREFORE, it is agreed by and between the parties hereto, that each of the parties agrees to assist the other under the follow- ing stipulations, provisions and conditions: 1. That any assistance shall be rendered by either party only upon the request of the fire chief of the party requesting assistance or his duly-authorized representative; 2. Equipment shall be dispatched only as requested by the calling party and the amount of equipment and personnel dispatched shall be at the discretion of the responding party. 3. Should the called party be involved in an emergency operation at the time of receiving the call, the response may be delayed until such time as the called party may be able safely to respona and should the called party have dispatched equipment and personnel and after dispatching such personnel and equipment an emergency develops in the area protected by the called party, then the called party may recall such of its equipment and material as may be needed by it. 4. All liability for injury for personnel, loss or damage of equipment shall be borne by the party to which such personnel and/or equipment belongs and that all parties carry sufficient insurance to cover all such liabilities. 5. The cost of gasoline and other expendable supplies for con- tinued operation shall be paid by the party to which such personnel and/or equipment belongs. 6. All compensation for personnel shall be born by the party to which such personnel belongs. 7. Ihe party responding to a call from the other party while within the area of the other party shall be subject to the orders and directicns of the officer in charge of the operation in the area where the emergency exists. . '-'I". -.- 8. A first call for mutual aid shall be to the nearest Depart- ment having the equipment needed. 9.
