It is identical to 1980-81 agreement. _1/ .5II~l YOfA,1A BItS OPERATIONAL AGREEMENT This operational agreement, made and entered into this 22nd day of September, 1981 by and between the City of Sanford, Florida, a Municipal Corporation, hereinafter called Lessor and Sanford Youth Baseball Association, Incorporated, hereinafter called Lessee. WITNESSTH For and in consideration of the sum of one (1) dollar, together with other good and v~luable conside'ration, as well as covenants and " ., t , .. agr~~rn~nts. h~rein contained, Lessor does rent and hire unto Lessee and .. .... .. Lessee rents and hires of and from Lessor the properties in the City of Sanford, Florida, known as (l) Roy Holler Youth Baseball Field (2) Bay Avenue Baseball Field (3) Randall Chase Baseball Field and (4) Westside Youth Baseball Field from March l5th through August l5, 1982 with an option for an annual renewal. Such option shall be exercised by a written request being submitted to the City of Sanford at least 45 days before any use. The Lessee under this agreement can use these fields for scheduled games and practices but do not have exclusive use or rights to these four fields. The Lessee agrees that each league shall provide at least l20 Little Major games, 60 Junior Major games, ~ Pee Wee League games, and 24 Senior Major games (If Senior League materializes). This agreement shall be renewable on or before the last day of September each year by mutual agreement and signing by both Lessor and Lessee. l. The Lessee shall have the use of the four Baseball fields for Youth Baseball games. 2. The Lessee at it's expense shall perform all necessary erection, maintenance, removal and storage of fence signs and advertisements. All signs and materials erected shall be professionally prepared and all advertisements shall be within the scope of those products and services considered both wholesome and acceptable to youth morality. ( 2 ) Further, the Lessee agrees that sign erection shall be limited to that space on the area known as "outfield fence" between the left field foul pole and right field foul pole. The Lessee further agrees that no sign may be erected prior to April lst and that all signs shall be removed prior to August l5th of each year. 3. The Lessee shall have concession rights and use of concession facilities at the above named fields for the purpose of dispensing concessions for the purpose of raising funds for support of youth baseball programs and Lessee shall receive an exempt license for this purpose. (A.) Lessee agrees that no alcoholic beverages or tobacco products will be dispensed under these concession rights. (B.) Lessee shall be responsible for improvements, operations, repairs, and maintenance of the concession building during stipulated time operations agreement. Any modification to the structure must be first approved by the Parks & Recreation Director. 4. The Lessee through methods named below, shall attemot to raise funds for the operation of the Sanford Youth Baseball activities by: (A.) Membership fees for adult boosters; (B.) Team sponsoring fees; (C.) Concession profits and donations; (D.) Material fees for players; (E.) Sale of sign space on fences. 5. The Lessee shall be directly responsible for costs of league operations including: (A.) All team equipment normally associated with league play in Florida Little Major League; Florida Junior Major League; Florida Senior Major League and Pee Wee League Baseball, that include team uniforms, caps, balls, bats, catching equipment and equipment bags. (B.) All cost associated with operation of concessions. (C.) All cost for league awards and trophies. (D.) All cost of payment of Senior League game officials and scorekeepers. ( 3 ) (E.) All cost for League player accident insurance and Association insurance. (F.) All costs for league sanctions and fees required for member- ship in Florida Little Major League Incorporated. (G.) All costs and arrangements for participation in All-Star competition. 6. The Lessor agrees to provide: (A.) The four playing facilities. (B.) Game officials cost for Little Major League and Junior Major League within the allocated budget sums. (C.) Normal field preparation and facility maintenance. (D.) Provide some administrative assistance such as scheduling. (E.) Lessor agrees to provide reasonable and normal maintenance on field lights including the cost of bulbs and their replacement. (F.) Lessor agrees to provide water and sewer and electrical utilities, within the allocated budget sums. (G.) Lessor agrees to allow the Association the use of all supplies purchased by sponsors and on hand for use in the league. These items shall be returned to the City at the end of annual lease periods. 7. Lessee further agrees to completely relieve Lessor of financial responsibility for league operations to the extent possible, as covered in this lease, and if unable to do so, the lease is immediately void and the City of Sanford will assume the operation of the program as a municipal function.
