This Contract is for the furnishing and use of water by and

hereinafter referred to as PROPERTY OWNER, and the CITY OF SANFORD,
FLORIDA, hereinafter referred to as CITY.
WITNESSETH:
WHEREAS, the Department of Environmental Regulation of the
State of Florida has determined that Ethylene Dibromide (EDB) in water in
quantities in excess of 0.1 parts per billion (PPB) is an unacceptable
level, and
WHEREAS, testing of the City's water supply has disclosed
concentrations of EDB in excess of accepted levels, and
WHEREAS, the capacity of the City to furnish sufficient
quantities of water to its citizens has been thereby diminished and the
City has determined that a state of emergency exists, and

property described in Exhibit "A" and attached hereto, and
WHEREAS, the City desires to obtain an emergency supply of
water until corrective measures can be obtained to filter the existing
supply of water or drill additional wells, and in consideration of the
terms, provisions and covenants contained herein, the parties hereto
do mutually agree as follows:
Subject to the terms and conditions hereinafter set forth,
Property Owner shall make available to City, and City shall receive
from the Property Owner water from existing irrigation wells in such
quantities and at such times as are deemed necessary by the City in
order to assure an adquate water supply for the users of the City water
system. Property Owner hereby grants permission for the City or its
designee to enter the property for purposes of testing the water supply,
connecting pumping equipment to existing irrigation wells to lay water
transmission lines over Owner's property to the existing City water

distribution system at the sole cost and expense of the City.
The City agrees to indemnify and hold Property Owner harmless
against any suit, action at law, claim for damages or other expense
incurred by Property Owner arising out of the furnishing of water to the
City pursuant to the terms and conditions of this agreement. This
agreement shall be for an initial term of ninety (90) days from date of
execution and may be continued from time to time upon such terms and
conditions as may be mutually agreed to between the parties.
