THIS INDENTURE, made this 11th
day of September ,
A.D. 19 89 , between H & H Partners, a Florida general partnership,
of the County of Seminole , and State of Florida ,
part_v_of the first part, and CITY OF SANFORD, FLORIDA, a municipal
corporation, situate in Seminole County, Florida, party of the
second part;
WITNESSETH, that party of the first part, for and in
consideration of the sum of One Dollar and other valuable
consideration to it in hand paid by party of the second
part, receipt whereof is hereby acknowledged, has granted and
conveyed, and by these presents do es grant and convey to party
of the second part, its successors, assigns, and licensees, a
perpetual easement under, upon and across the property situate in
Sanford, Seminole County, Florida, more particularly described as:
The Easterly 30 Feet of the Southerly 30 Feet of the
Northerly 50 Feet of Block 79 of M.M. Smith's Subdivision
according to the plat thereof as recorded in Plat Book
1, Page 55 of the Public Records of Seminole County,
Florida.
for a public wastewater pump station and the utility purposes,
including specifically sanitary sewers, and for the installation,
inspection, servicing, repair, maintenance, and replacement of all
utilities now existing or hereafter to exist on said property, such
easement including the right of free ingress and egress over and
across said property for any of the purposes aforesaid, together
with the right to open an alley for use of party of the second part
and the general public. Party of the second part shall be
responsible for maintenance of wastewater system improvements and
general grounds maintenance of the property included in the
easement.
