4283 amending Brisson West PDOrdinance No. 4283 An ordinance of the City of Sanford, Florida relating to the amendment of the Brisson West planned development; providing for the rezoning of real property located at 3890 Brisson Avenue within the City Limits (map of the property attached) from a Planned Development ( "PD ") on the site to a similar PD, but changing the approved townhome section of the PD to single family lots which are 40 -feet in width; providing for the taking of implementing administrative actions; providing for the adoption of a map and PD master plan by reference; providing for conflicts, but providing for a PD amendment and harmonization with prior actions by the City; providing for severability; providing for non - codification and providing for an effective date. Whereas, Serengeti Properties, LLC is the owner of certain real property within the City Limits of the City of Sanford (assigned Tax Parcel Identification Numbers 17- 20 -31 -5AZ- 0000 -0290, 17 -20 -31 -5AZ- 0000 -029A, 17 -20 -31 -5AZ -0000 0300, 17-20-31 - 5AZ- 0000 -0330, 17 -20 -31 -5AZ- 0000 -033A, 17 -20 -31 -5AZ- 0000 -034A, 17- 20- 31 -5AZ- 0000 -034B, 17 -20 -31 -5AZ- 0000 -0350, 17 -20 -31 -5AZ- 0000 -035A, 17-20-31- 5AZ -0000- 0360, 17 -20 -31 -5AZ- 0000 -0380, 17 -20 -31 -5AZ- 0000 -0390, 17 -20 -31 -5AZ- 0000 -0400, 17- 20 -31- 300 - 0030 -0000, 17- 20 -31- 300 -003A -0000 and 17- 20 -31- 300 -006A -0000 by the Seminole County Property Appraiser) and it applied to the City of Sanford, pursuant to the controlling provisions of State law and the Code of Ordinances of the City of Sanford, to have the property rezoned to the Planned Development ( "PD ") zoning classification from the existing PD to which the property is assigned and approved; and Whereas, on September 25, 2006 the City Commission enacted Ordinance Number 4018 in accordance with the Brisson West PD Master Plan; and Whereas, the subject property is located on the southwest corner of Brisson Avenue and Lake Mary Boulevard with a project address of 3890 Brisson Avenue. The IIPaI site consists of 16 vacant parcels totaling 128.29 acres; and Whereas, the PD amendment proposes to change the approved townhome section to single family lots which are 40 -feet wide; and. Whereas, if the PD amendment is approved, the land would have development rights for 375 homes that would be assessed the City's millage rate and generate additional ad valorem tax revenue to the City. Utility services provided to the development would also increase revenues to the City's utility enterprises (water, sewer and reclaimed water) with the property owner also paying applicable impact fees for roads, schools, utilities, parks, police and fire services; and Whereas, the proposed PD Master Plan seeks to vary the following development standards for single family lots: reduce minimum lot size to 4,400 square feet (lots which are 40 -feet wide only), reduce minimum lot width to 40 feet (where townhomes were previously approved), reduce the minimum front yard setback from 25 feet to 20 feet for the lots which are 40 -feet wide, and reduce the minimum side yard setback from 10 feet to 5 feet for the lots which are 40 -feet wide; and Whereas, the total number of dwelling units will be reduced from 424 to 375 lots resulting in a net density of 4.25 units per acre; and Whereas, the City's Planning and Development Services Department has conducted a thorough review and analysis of the demands upon public facilities and recommended that the subject rezoning application be approved having determined that the proposal is technically sufficient and consistent with the goals, policies and objectives of the Comprehensive Plan of the City of Sanford, the land development regulations of the City of Sanford, and the controlling provisions of State law; and 211'a<.c Whereas, the Citizen's Awareness Participation Plan (CAPP) requirements of the City relative to the proposed rezoning have been satisfied in that the applicant mailed notice to adjoining property owner who own properties located within 500' and provided a CAPP summary to the City dated September 24, 2012; and Whereas, on November 15, 2012 the Planning and Zoning Commission of the City of Sanford recommended that the City Commission approve the rezoning request and recommended that such approval be subject to numerous conditions; and Whereas, the City staff, recommended approval of this Ordinance subject to normative development conditions; and Whereas, the City Commission has determined that the proposed rezoning of the subject property as set forth in this Ordinance is consistent with the Comprehensive Plan of the City of Sanford, the land development regulations of the City of Sanford, and the controlling provisions of State law; and Whereas, the City Commission of the City of Sanford, Florida has taken all actions relating to the rezoning action set forth herein in accordance with the requirements and procedures mandated by State law. Now, therefore, be in enacted by the People of the City of Sanford, Florida. Section 1. Legislative findings and intent. (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the application relating to the proposed rezoning of the subject property as well as the recitals (whereas clauses) to this Ordinance. (b). The approval set forth in this Ordinance is subject to the specific 3 11,, conditions that are set forth subsequently in this Ordinance. (c). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. (d). This Ordinance is consistent with the goals, objectives and policies of the Comprehensive Plan of the City of Sanford. Section 2. Rezoning of real property /implementing actions; Brisson West (a). Upon enactment of this Ordinance the property, as depicted in the map attached to this Ordinance shall be rezoned from the zoning classification resulting from a separate and distinct Brisson West PD consistent with the provisions of this Ordinance. (b). The City Manager, or designee, is hereby authorized to execute any documents necessary to formalize approval of the rezoning action taken herein with regard to the Brisson West PD and to revise and amend the Official Zoning Map or Maps of the City of Sanford as may be appropriate to accomplish the action taken in this Ordinance. (c). The conditions to be incorporated into the pertinent development order relating to the action taken in this Ordinance include the following: (1). Pursuant to Section 4.3.G of the Land Development Code of the City of Sanford, this rezoning shall expire 3 years from the effective date of this Ordinance if all improvements have not been completed or an extension granted. (2). Guest parking shall be provided in the area of the lots which are 40 -feet wide. (3). All air conditioning units shall be placed in the rear of the homes on the lots which are 40 -feet wide. (4). Street lights shall be installed by the property owner on Brisson Avenue as well as on the interior streets in accordance with the City's Land Development Regulations, as set forth in Schedule N, Section 3.2 B, entitled Other Utilities, Street Lights. (5). An air conditioned recreation /community facility shall be provided by the property owner on one of the recreational areas as shown on the PD Master Plan received by the City on September 25, 2012, which Plan is incorporated herein by this reference thereto as if fully set forth herein verbatim. (6). A School Capacity Availability Letter of Determination from the Seminole County School District is required prior the recording of the final plat. (7). Unless specifically requested and approved on the referenced PD Master Plan, any required elements missing from or not shown on the said PD Master Plan shall otherwise comply with the City's Land Development Regulations. Section 3. Incorporation of map and PD Master Plan for Brisson West The map attached to this Ordinance is hereby ratified and affirmed and incorporated into this Ordinance as a substantive part of this Ordinance. The PD Master Plan is also, as noted in Subsection 2(c)(5), hereby ratified and affirmed and incorporated into this Ordinance as a substantive part of this Ordinance. Section 4. Conflicts. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed. City staff shall harmonize the approval and actions set forth herein together 5111 which those taken relative to the Brisson West PD. Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Non - codification. This Ordinance shall be not be codified in the City Code of the City of Sanford or the Land Development Code of the City of Sanford; provided, however, that the actions taken herein shall be depicted on the zoning maps of the City of Sanford by the City Manager, or designee. Section 7. Effective Date This Ordinance shall take effect immediately upon enactment. Passed and adopted this 14th day of January, 2013.
