DEDICATION OF PERPETUAL NON-EXCLUSIVE UTILITY EASEMENT
THIS DEDICATION OF PERPETUAL NONEXCLUSIVE UTILITY EASEMENT,
is made this d~---t'Aday of ff~ , 1997, by PINEVIEW ACADEMY, INC., a Florida
corporation, whose address is 2325 Roanoke Court, Lake Mary, Florida 32795 CDeclarant"), and
the CITY OF SANFORD, a political subdivision of the State of Florida, whose address is 300 Nort~
Park Avenue, Sanford, Florida 32771 (the "City").
THAT THE DECLARANT, for and in consideration of the sum of $10.00 and other
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, by these
presents does, subject to the terms and provisions herein contained, hereby dedicate unto the City
for the use of the general public, a perpetual non-exclusive easement for utilky purposes, including,
but not limited to, such services as sewer, water, irrigation, drainage, electricity, gas, cable
television, and other utility purposes, with full authority to enter upon and to construct, use,
maintain, repair, replace and operate (but without obligation to so construct, use, maintain, repair,
replace and operate) all road improvements, utility lines, pipes, and facilities incident to the use and
enjoyment &such easement now existing or herealter constructed over, across, under and through
the following described property situated in Seminole County, Florida:
See Exhibit "A" attached hereto and
made a part hereof(the "Easement Area")
TO HAVE AND TO HOLD said easement unto the City for the use of the general public.
The City shall have the fight to clear all trees, undergrowth and other obstructions
encroaching into the Easement Area which may interfere with the use and enjoyment of the
Easement Area.
Declarant agrees not to build, construct, or place, or permit others to build, construct or
place, any buildings, structures, barrier or other hindrance on the Easement Area which would

Declarant warrants Declarant is the fee simple owner of the Easement Area, that Declarant
has full power and authority to create and grant this easement and that any holder of any lien on the
Easement Area created by or known to Declarant has subordinated, of record, such holder's lien
encumbering the Easement Area to this Declaration of Easement.
These covenants, terms and conditions shall attach to and run with the land constituting the
Easement Area, and are binding upon and inure to the benefit of Declarant, the City and their
respective successors and assigns.
