The City Attorney explained that a title check had been made by Attorney's Title Insurance Company and apparently the park was dedicated to the public not to the City nor the County. The County has taken care of the park up to this time, and they agree that if the City uses it for a public park they would be willing to give the City jurisdiction. Lonnie Groot, Assistant County Attorney, for Seminole County presented a letter explaining the County will submit a petition for annexation for the use of the public. Mr. Groot submitted a Letter for Petition as Exhibit F and Letter of Affidavit which would be Exhibit E. The Affidavit explained the County had been maintaining and use of the park for public purposes. The County is willing to admit jurisdiction to the City of Sanford as the park is owned by the public. The City Attorney explained the Commission could annex with the County's concurrence and a new petition be submitted from the County and transfer jurisdiction or the City could pursue a law suit for ownership. Owner: Hassan & Farideh Mokhberi Representative: Ray Mokhberi City Commission Public Hearing - 1/11/88 Unanimously denied the request for an extension of the approval of the site plan for Sanford Arms, a 140 unit apartment deve- lopment located at 2540 Hartwell Avenue in a MR-2 zone, based on the adverse effect-it could have on people and the environment. Mr. Kantor stated that he could not close with the original lender on time and he has had to restructure with a new lender. His approval expired on September 2nd. The Commission recommended that the City Commission be advised, due to the lag of time, Planning and Zoning requests a full blown site plan review.
