Mcintosh, Assistant City Attorney Janet Dougherty Sherman Yehl Call to Order Mr. Davis called the meeting to order at 5: 14 PM. - Redistricting ...... Mr. Davis stated the Subcommittee could not find a solution in the charter for redistricting and they will present a solution to the City Commission at their next scheduled workshop. Mr. Brodeur stated there is nothing we could or will be recommending to the Charter Review Committee as a whole. He stated what they did decide is to look at a possible redistricting plan as an off committee. Discussion with City Manager Sherman Yehl Mr. Davis stated there was some discussion with the City Manager adding pie charters to the annual report which would show spending by district, tax payer's money, government spending and Federal and State grant spending. ...... Mr. Yehl stated they do a Five Year Capital Plan which identifies by district where the major expenditures are going. He stated a lot of them are citywide except when you get into Public Works; those projects are easier identified by district. Mr. Yehl stated each district has a certain number of city facilities; District #1 has a large number of city facilities which ways the expenditure of funds to one district and is not truly reflective of what types of ...... He stated the other problem is a large number of projects are citywide and we have an annual procreation citywide for several different items such as sidewalks repairs, concrete repairs, street calming, traffic calming, irrigation systems, etc. IIIIIIII! .~ , ....... Mr. Yehl stated that the capital expenditures proposed for 2008 are less than what they have been in the past. He stated there will be less money available for capital projects in future years than what we have now. Mr. Yehl stated there is always going to be a disparity in the amount of money being spent in a district. He stated each district is unique, has different needs and each commissioner is responsive to what their constituents are saying about their needs and try to see that they get funding for those issues out of any single budget year. Mr. Yehl stated they use some pie charts now and other graphs to visually display things better understood by charts citywide, not by districts. He stated the intergovernmental revenue is small, about 9%. He stated the second document is an end of the year comprehensive annual financial report to show that we spent the money in accordance with general accounting practices. Mr. Yehl stated he has instituted and still is institutionalizing a quarterly management report showing how we're spending money on a quarterly basis and if we are meeting performance measurements. Mr. Yehl suggested including in the charter a statement saying the city has an obligation in its day to day activities to be transparent. Mr. Stewart suggested proposed language for Section 5.04. Mr. Davis stated that annual report at the end of the year include some visual display of how city funds are expended. Mr. Kinney suggested in Section 5.04, first paragraph, second sentence include the word district with the words fund, organization unit program, J... 'J'.i' purpose or activity, and object. . .... Kinney Aye Mr. Brodeur stated the dissension is due to it being placed in the charter rather than an Ordinance. Mr. Stewart recommended proposed language for Section 1.05: ,..... Section 1.05 (a) The territorial boundaries of the City of Sanford may be extended or contracted as provided in the applicable general state laws regarding municipal annexations and contractions. (b) The City of Sanford shall maintain a proactive annexation policy to help the city achieve its manifest destiny, provide for economic growth, provide for an escalated quantity of life, and community amenities, provide for additional municipal revenue streams, ensure equity of access to available municipal services, provide for orderly growth and ensure sufficient infrastructure development. (c) City annexations shall be made in a non-discriminatory manner. The city shall seek to include previously by-passed lower income areas in its proactive annexation efforts. ...... Section 1.06 Open Government The City of Sanford shall conduct al of its business affairs and governmental operations in full accord with the letter and spirit of open government laws, public access to public records and the public's right to know and why their government acts in a particular fashion. ..... Section 1.07 Discrimination 3 Redistricting and Related TODics 071107 The City of Sanford shall conduct al of its business affairs and governmental operations in an objective, fair, equitable and non-biased manner. The city shall not engage in discriminatory conduct based upon race, ethnicity, creed, color, nationality, religion, sexual orientation, gender or socio-economic status. .., I ....J Mr. Davis moved to approve the proposed language for Section 1.06 and Section 1.07. Kinney Aye Mr. Stewart recommended proposed language for Section 6.07: Section 6.07 (a) Notwithstanding any other provision of this charter the mayor shall represent the city as a whole and be elected by electors throughout the city. Each city commissioner shall represent one city commission district, shall actually physically reside in the district for which they seek office from the date of their qualification for office until the expiration of their term of office and shall be elected solely by the voters of that district. (b) There shall be four (4) city commission districts that shall be established, defined and . ~ geographically described areas of the city as defined by Ordinance No. 4032 and subsequent successor ordinances relating to commission redistricting as required by this charter, general law and constitutional principles. Each district shall be formed from compact contiguous territory with the boundary lines following the centers of streets. Due consideration shall be given to maintaining the geographical integrity of neighborhoods and developments within the individual districts. The commission district lines shall be constructed so as to comply with the constitutional principles of equal and effective representation required by applicable state and federal guidelines. The city commission shall give due consideration to the multiple constitutional principles involved in the electoral process and shall give due regard for the opportunity of minority representation on the commission as a part of the redistricting process in compliance with applicable state and federal constitutional standards. (c) An incumbent commissioner's seat number may change due to the realignment process occurring during redistricting, however, no incumbent commissioner shall have their term of office cut short by the adoption of a redistricting plan. (d) The city commission may modify city commission districts by the enactment of a successor ordinance under whatever processes, procedures and redistricting committees and/or consultants the city commission may deem to be desirable. The city commission shall begin the initiation of a redistricting process for city commission districts within thirty (30) days after the receipt of the official Decennial Census data every 10 years. The J official Decennial Census data shall be the authoritative source for demographical data .! used in reconstituting city commission districts in compliance with applicable state and federal standards. 4 "... .... ,... .... ..... ...
