inspecting the property next to the golf course. Comm. Eckstein reported they didn't~ he
went with Capt. McCoy. Mayor Dale reported staffhas been reviewing~ he has had
discussions with Lake Mary and has talked to the developer, after developer responds, it
will be staffed more and a report sent to the Commission. Lake Mary will eventually close
Rantoul Lane.

Eckstein reported she is the first SHS student to go to Harvard University, and she
was the state champion in the Optimist Club's Oratorical Contest. Commission
concurred a letter be sent to her, in recognition of her accomplishment.

TV.......... Reported the city continues to experience dumping violations; people dump trash,
garbage, and construction debris (such as their old roof) in the right of way and
expect the city to pick it up as a free pickup, which the city has done. He passed
around a picture taken July 3 of a dumping violation and stated that 60 cubic yards
had been removed from the same location on July 1. Joann Legge reported 10
loads was pickup up by hand at one property, 6.1 tons from another house~ FRS
charges the city and the city bills the property owner, but many do not pay.
Commission concurred City Manager and staff make recommendations to
Commission to make dumping in right of ways a criminal violation, see if the city
can bill for removal on tax bills like the county does, and exempt from billing those
property owners who had no control over dumping done on their property.

Reported the city has received complaints of unsafe foot bridges over Mill Creek
(city property). Commissioner Williams stated if these are between 14th and 15th
Streets, they have been there about 90 years, and they are the only way the
residents have to use the front doors of their homes; otherwise they could only use
the back doors. The City Attorney reported that if the city has been notified of
something unsafe on city property, ultimately, the city may have some
responsibility~ and that before the next Commission meeting he will meet with the
City Manager and staff and determine how soon Mill Creek will be filled in,
whether or not to repair the bridges, etc., and advise the Commission.

The Chairman called the meeting to order.

Nell Snow, 176 Woodridge Trail, asked what happened regarding the meeting Mayor Dale and Commissioner
Eckstein were supposed to have to look at City property next to Rantoul Lane. Commissioner Eckstein said they never went,
but that he went with Captain McCoy. Mayor Dale said that he and Commissioner Eckstein can't meet like that to discuss issues
that will require a vote of the Commission, because it would be a violation of the Sunshine Law. Staff is handling the issue on
behalf of the Commission. Mayor Dale said he has had discussions with Lake Mary and has spoken with the developer who
made the request and that the developer is to speak with Lake Mary, a_Qer which he will speak with Mayor Dale, after which
it will be discussed with Staff, after which it will be discussed by the Commission. Ms. Snow said it would be a shame to close
off the road because since it has been paved, many people use the road. Mayor Dale said the request that came before the
Commission was to modify the approval the Commission had already given. The road was put in to allow the private school
to operate. The road is supposed to be taken out and there will be a new subdivision developed to the north of the school with
lots fronting the golf course. Then a request came in to be allowed to put in the road up to the end of their property and have
lots that front on the road; it would be a private road. The road wouldn't come out on SR 46A. The piece on the comer is in
Lake Mary and is zoned commercial. Mayor Dale asked Mr. Marder, Engineering & Planning Director, to find out what the
frontage property across from Kaywood next to the lake is zoned.

Ordinance No. 3570 was read by title. City Manager VanDerworp reported that the Planning & Zoning
Commission heard this item on July 6, 2000 and unanimously recommended approval. Mayor Dale reported the Commission
would hear from those persons present to speak for, or in opposition to, Ordinance No. 3570. Laura Latimer asked for
clarification regarding signs being removed seven days after the election and if not removed is there a fine. Mayor Dale said the
signs have to be removed within seven days aRer the election and if not removed, the $100 deposit is forfeited. The deposit is
also forfeited if signs are found in the right-of-way. If a candidate claims they didn't place a sign in the right-of-way, an appeal
can be made to the City Commission for return of the deposit, If a sign is not removed from private property, the property
owner would be cited for a Code Enforcement violation. The ordinance allows for placing signs immediately upon qualification.

Consider appealin~ the ruling of the Code Enforcement Board
re: Case No. 98-1102.
Charles Rowe, Director of Community Development, reported that if a property is found to be in violation of
City Code, due process is followed and the Code Enforcement Board hears the ease and can elect to impose a fine of up to $250
per day for the first infraction, and for a second infraction can impose a fine of up to $500 per day. The fine remains until the

imposed a fine of $25 per day. The owners brought the property into compliance after the fine accrued to $5,575. The Code
Enforcement Board can hear testimony regarding waiving or reducing fines based on one of the following criteria: medical
hardship, financial hardship, or mitigating circumstance. In the case of No. 98-1102, the Code Enforcement Board determined
that based on financial and medical hardship, the fine should be reduced from $5,575 to $100.

Mayor Dale expressed concern regarding inequity in the way the Code Enforcement Board sometimes waives
fines and said he would like concurrence from the Commission that he and the City Manager discuss this item with the Code
Enforcement Board.
Mr. Rowe said that based on conversations he had with the Mayor and the City Manager, he brought the concern
to the Code Enforcement Board to explain that the Commission is looking for a more aggressive stance.
Commissioner Eckstein said that prior to tonight's meeting, he discussed Case No. 98-1102 with Joe Young, a
member of the Code Enforcement Board who said that he personally knows Mr. Davison, the property owner, and that the
criteria for a waiver, as determined by the Code Enforcement Board, does exist.
Mr. Young 1321 Shepherd Avenue, said he refrained from voting on the case because he personally knows Mr.
Davison, and that Mr. Davison substantiated two legal documents showing financial hardship and other extenuating
circumstances, therefore, the Board voted in his favor.
Mayor Dale said he questioned the case because of the argument by Mr. Davison that the fine was arbitrary and
inequitable considering the low level of the violation. Mayor Dale said he thought the fine was appropriate.
In response to Commissioner Eckstein's question whether the City could prevail if the case was taken before
Circuit Court with the City as the plaintiff, City Attomey Colbert said the Statute that enables cities to create Code Enforcement
Boards does vest the Board with a certain mount of discretion. Any party can appeal to the Circuit Court which would then
determine whether the Board departed from the essential requirements of the law and abused its discretion. Mr. Young already
stated that he believed that the majority of the Board considered all the facts, and if a judge believed that, it would be difficult
for the City to overturn that particular decision.
Mr. Colbert said that as discussed earlier, an option of the Commission is to consider if there is a consensus for
the Mayor' and/or the City Manager to have further discussion with the Code Enforcement Board about perhaps not waiving
substantial fines in the future, which may be beneficial in establishing a dialogue between the Commission and the Board which
it appoints.
Mayor Dale said the item was brought before the Commission tonight not specifically to take it to court, but to
bring up an issue of inequity.
Monarcha Maroct, 801 S. Park Avenue, said that she is a building contractor and knows there are certain
standards that need to be applied to structures, and supports the Mayor's position that code enforcement should be enforced
across the board and that waivers should be more clearly defined with specific documents required to qualify financial hardship
such as bankruptcy, medical records for medical hardship, death in the family that would take you out of town, etc. However,
there are quite a few absentee landlords in Sanford, but that doesn't create a hardship. She owns property in Orlando and if they
are not maintained she would expect someone to tell her to bring the property up to the standards expected by the City. The
Commission would receive citizen support if it took that stance on code enforcement issues.
After discussion, the Commission concurred that Mayor Dale and City Manager VanDerworp discuss with the
Code Enforcement Board the Commission's desire for consistent, aggressive enforcement, with all requested waivers to be
documented by copies of bankruptcy papers, health documents, etc.

has done. He passed around a picture taken July 3 of a dumping violation and stated that 60 cubic yards had been removed from
the same location on July 1. JoAnn Legge, Solid Waste Coordinator, reported that ten loads were picked up by hand at one
property and 6.1 tons from another house. FRS charges the City forthe pick ups and the City bills the property owner, but many
do not pay. The Commission concurred that the City Manager and Staff make recommendations to the Commission to make
dumping in right-of-ways a criminal violation, to see if the City can bill for removal on tax bills like the County does, and exempt

from billing those property owners who had no control over dumping done on their property.
The Mayor reported the City has received complaints of unsafe foot bridges over Mill Creek (City property).
Commissioner Williams stated that if the foot bridges are between 14th and 15th Streets, they have been there about 90 years,
and they are the only way the residents have to use the from doors of their homes; otherwise, they could only use the back doors.
The City Attomey reported that if the City has been notified of something unsafe on City property, ultimately, the City may have
some responsibility; and that before the next Commission Meeting he will meet with the City Manager and Staff and determine
how soon Mill Creek will be filled in, whether or not to repair the bridges, etc., and will advise the Commission.
Them being no further business, the meeting was adjoumed.
