051997 ws/rm min.462 E405354 MINUTES City Commission, Sanford, Florida WORK SESSION May 19 19 97 The City Commission of the City of Sanford, Florida met in Work Session on Monday, May 19, 1997, a 3:30 o'clock P.M. in the City Manager' s Conference Room, Sanford City Hall, 300 North Park Avenue, Sanford, Florida. Present: Mayor-Commissioner Larry A. Dale Commissioner Whitey Eckstein Commissioner Velma H. Williams Commissioner Brady Lessard Commissioner Kerry D. Lyons City Manager William A. Simmons Acting City Clerk Cynthia Porter Absent: City Attorney William L. Cotbert City Clerk Janet R. Dougherty The Chairman called the meeting to order. Water Resource Atlas program. Nancy Christman, St. John' s River Water Management District, gave an overview of the Water Resource Atlas Program (David Dewey attended with her). Ms. Christman presented copies of the Water Resource Atlas to the Commission. She explained what was being done in regards to water supply and flood protection. She also presented a video of retention ponds for the City to use for informing citizens. Ms Christman stated that President Clinton is going to designate ten rivers in the United States as American Heritage Rivers. She said they would like to put in an application to have .~e St. Johns River designated as one of those rivers. This could possibly mean utilizing some federal funding. She stated they are going to hold four community meetings, one in Sanford. The Mayor' s and City Manager' s office will receive invitations to the first informational/fact finding meeting to be held june 25, 1997. She encouraged anyone interested to participate with them. She left fact sheets regarding this meeting. Mayor Dale expressed caution about getting involved in anything with the Federal Government which might have some strings attached. Police ConSultant Selection Committee. The Mayor reported receipt of two responses to the RFP, one from PAS and one from The Fairfax Group, Ltd. The committee recommended PAS. The Mayor stated they are now in the process of doing due diligence on PAS. The City Manager asked everyone to confirm receipt of the agenda for the meeting to be held Thursday, May 22, 1997 regarding this issue. The meeting time was changed from 6:00 p.m. to 4:00 p.m. The Mayor stated this will be a public hearing so there may be other work session activities brought into it. Personnel (budeel) requests. Continuation of personnel requests not covered in the May t2, 1997 work session. Personnel Director - Tim McCauley requested reclassification of one Secretary HI position to Personnel Specialist to compensate for one person who wilt be retiring, and restructuring of remaining key personnel in which that person will not be replaced. City Manager explained this was per his suggestion. City Manager asked for any discussion or comments on total personnel requests and reclassi~cation requests presented at either the May 12 or May 19, 1997 meetings. Commissioner Eckstein commented he has never been enamored by merit pay. We need to either get rid of merit pay or modify it because it is killing us. We should catch up where we should be and get rid of merit pay and give cost of living raises every year. E405354 MINUTES City Commission, Sanford,' Florida 463 WORK SESSION May 19 19. 97 Commissioner Lyons agreed but wanted to know if that meant there would be no new positions. Commissioner Eckstein said he is looking at some new positions and he would like to add as many new positions as possible within the budget. Mayor Dale stated the Commissioners need to give the City Manager some direction in this budget process, and decide iflhey are willing to increase taxes. Commissioner Lyons stated they have to decide whether they are going to increase salaries or h/re new people. Commissioner Willjams felt they should increase current pay and think about some new positions and some reclassifications. Commissioner Lessard opposed raising taxes. He felt public safety is the primary function of government. He is in favor of paying less people more money. He feels we need to ask the county how they appraise property. He felt a lot of the property in Sanford in appraised too low and new appraisals could increase tax revenue. Revenue and Expense Report and FY97 preliminary revenue projection. Finance Director, Carolyn Small, reported the current year as of March 31, 1997 was in line with the budget. She presented statistical information on the current year revenue as of March 31, 1997 (the original budget, total revisions to the budget, and expenses). Ms. Small also included in her presentation the proposed budget for FY98 information for the General Fund revenue (first run through). There seems to be about a one million dollar spread between requested budget items and expected revenue. Carolyn Small thanked the Commission and her staff for all of their support 'and guidance while being employed by the City and expressed good wishes for the future of the City. She will has resigned her position as Finance Director. Worker's Compensation Excess Insurance. Personnel Director, Tim McCauley explained that excess insurance would cover work related accidents or injuries. The City is presently purchasing insurance through Florida League of Cities, but they have raised their cost by 300% since 1988. He recommends Hilb, Rogal, Hamilton, at.at should be considered for a one year period at a cost savings to the City of $27,000.00. Mayor Dale asked how our experience compared to others and a representative from Hilb, Rogal, Hamilton, at. al said our experience was very good. Commissioner Lyons asked if after one year we could get an extension and the representative answered possibly we could, but again it would be based on our experience. UtiliW deposits. Paul Moore, Director of Utilities, felt that by raising utility deposits we would reduce losses. The City Manager recommended raising utility deposits. Mayor Dale suggested the rate be raised to $75.00. Commissioner Eckstein concurred. City Hall 1st floor office space evaluation. Paul Moore spoke on utilizing the 1st floor office space in City Hall. He explained that the Commission had budgeted for the last two year to have a space study done ($40,000.00) but so far it had not been pursued. Mayor Dale would like to think about possibly selling the City Hall building to the County, or someone else, and build a new City Hall in lieu of remodeling. 464 City MINUTES Commission, Sanford, Florida ~IRK SESSION 19 97 Commissioner Lessard agreed that before we make any capital improvements or remodeling to the existing City Hall we should decide if we are considering building a new City Hall in the next few years. Request to waive vendor licensing and tent inspection fees. Request from Charles Jackson to waive additional fees related to the vendor licenses and tent inspections. The total of this request is $135.00. Mike Kirby, Recreation and Parks Director, recommended that since the Commission has already granted a waiver of the clean-up bond as well as a red~tion on the rental of the Civic Center, and the fact that this last request was not submitted in a timely manner prior to cut-off for the April 29, 1997 Commission Meeting, no further waivers should be granted. To be discussed further at Regular Meeting. Request for reduced Civic Center rental rate. Mayor Dale stated that one rate should be charged to everyone with no reduced rates or free use. Commissioner Willjams felt there should be a flat rate for alcoholic events, whether the alcohol is sold at the event or brought in. Commissioner Eckstein felt that the fee schedule was just fine the way it is. Extensive discussion ensued as to the rates and use of the Civic Center. It was decided to bring up a motion in the regular meeting and see what happens. Riverwalk - ISTEA Enhancement ProjecL Jay Marder, Director of planning and Development explained there has been no change in the schedule. He explained that there are three things items that they have been doing to comply with a request from the Department of Transportation. 1 ) Prove the City owns Seminole Blvd. 2) Become LAP (Local Agency Program) certified. 3) Look into method and costs to repair bulkhead. Mayor Dale felt that the bulkhead should be inspected annually and repaired periodically as needed, possibly requesting a community block grant. Board appointments/reappointments. 1) Commissioner Lessard stated he thought a Sports Commission is a good idea to look at for financing projects and soilciting events. Mayor Date asked Commissioner Lessard to present a proposal to create a Sports Commission. 2 ) Commissioner Lyons said there is one opening to fill on the Police Advisory Board and he would like to submit the name of Tom Carpenter. Regular Agenda Items. A. Mayor Dale would like a Gateway established on 46. Commissioner'Lessard thought that was a good idea and felt possibly Sanford was not being proactive enough with the Autotrain. B. Commissioner Willjams asked about the Winn Dixie Property. According to the City Manager them are no present plans for a new tenant. C. Commissioner Wiltiams asked what the status was of the Loitering Law. The City Manager said that was not a hot item with him right now and he would like to talk to the Chief about it. MINUTES City Commission, Sanford, 'Florida 465 WORK SFSSION May 13 1937. D. Commissioner Eckstein would like to put Historic in front of the stadium name and call it H/storic Sanford Memorial Stadium. It will be brought up in the regular meeting. E. Mayor Dale asked for volunteers to attend two separate events: 1) On Saturday, May 24, 1997 at 6:15 p.m. there is an Historic Goldsboro Reunion Week Banquet. Commissioner Lyons said he would attend. 2) On Sunday, June 1, 1997 at 2:30 p.m. there will be a tree dedication at Columbia Medical Center for National Cancer Survivor's Day. Commissioner Lessard said he would like to attend this event as a representative of the City. 3 ) Commissioner Willjams asked the Commission if they would support the idea of having a representative from the Downtown Merchants' Association come to speak at a Commission meeting and give us a status report of what they are doing. She would like to have it put on the agenda. Ci~V Mana~er's repor~ 1) Reported June 16 would be a good date to hold an executive session to review a bargaining contract and to introduce the wage reopener coming up. The Commission agreed to set the meeting for June 16, 1997 at 4:00 p.m. 2 ) He reported the need to change one of our Budget Hearings to avoid conflict with the County. The consensus was to have the Commission meetings on September 15, 1997 and September 22, 1997 instead of September 8, 1997 and September 22, 1997. 3) Tom Feehey has been committed on May 29, 1997 in the Chambers. Charles Rowe handed out some additional information on condemnations to be discussed in the regular meeting. The owner of 907 Willow has asked for an extension. The property at 802 Sanford Avenue may have some historical value. Contractors have looked at this property but nothing has been done m it, and the owner has not asked for an extension. Commissioner Lessard reported this building is a haven for drugs and prostitution and should be demolished. There being no further business, the meeting was adjourned. Mayor Dale read a proclamation to proclaim. June as Community Pride Month in District 2 and presented it to Commissioner Willjams. Citizen participation, Thetma Thompson, a resident of 14th Street, voiced a complaint of loud music from cars and homes on 13th and 14th Streets in Sanford. Commissioner Lyons informed her of the noise ordinance being worked on at the present time. He agreed and sympath/zed with her. Mayor Dale explained the police do make people turn their music down and citations can be written. Commissioner Eckstein asked about the traffic on 13th Street. Chief Dillard said officers are patrolling 13th Street and do. make the traffic move but as soon as the police leave the traffic comes back. Commissioner Williams said she has talked to ChiefDiIlard about receiving a grant to provide foot patrol 24 hours, 7 days a week on 13th Street. Mayor Dale stated the community has to be behind the City. Commissioner Lyons felt the business owners and residents need to call police. The Chief is willing to provide a foot patrol.on Friday and Saturday nights if manpower permits. Commissioner Lessard stated that tickets need to be written for violations. Thelma Mike, of 1710 W. 15th Street also came forward with a complaint of noise and a lot of people congregating at her rear neighbor's house. She stated there are a lot of people coming and going at that house at all hours, and they have already broken through her fence. The house in question is located on 14th Street. Mary, a citizen of Sanford, complained of a bad area between 12th and 13th Street (a small shopping mall with a laundromat) in regards to drags. She stated she and her friends are scared to go past this area on their way to church on 5th Street and Park. Mayor Dale explained this would include two line segments, one crossing Highway 17-92 at 22nd Street (300 ft. of 8" line) and one between Scott and Virginia Avenue from 4th Street to 8th Street (1054 ft. of 8" line). City Manager Simmons explained the reason they would like to go with Insituform rather than a cut-and-cover is because of the nature of the area. We are piggybacking with the City &Jacksonville whose project was competitively bid. Commissioner Eckstein stated Insituform is a very good company and they are advanced in there work. The total price is $62,276. This will remove the need to dig up the ground. Consideration of request for reduced Civic Center rental rate. Commissioner Willjams stated that since the Celery City Lodge #542 is a charitable organization, and they have been paying for use of the Civic Center for several years, they should be granted a reduced rate. Mayor Dale asked if they had paid for the use of the Civic Center yet, since their event took place on April 27, 1997. Mike Kirby, Recreation and Parks Director, volunteered that they had not paid and they had signed a contract for the full amount. Commissioner Lyons questioned why they were coming forward after an event to ask for a refund. City Manager read the history of their use and payment of the Civic Center in the past. They had paid the alcoholic beverage rate every year except 1993, in which year they paid a reduced rate. Several of the other years they had requested a reduced rate and were denied, and some years they did not request the reduced rate. FORM 8B. Commissioner Lessard stated he had inspected vehicles to be auctioned and found only one, a Crown Victoria with a VIN No. ending in 6544, that can possibly be used if the Commission is willing to be creative in how they use it. He felt possibly it could be painted and police decals put on it, and it could be used for a police officer to drive to and from work for visibility purposes. Commissioner Eckstein stated concern over who would be chosen to drive it. He felt if we were not going to be able to make any money by selling it we should keep it, but we should not set a precedence by giving it to an officer. Commissioner Lyons didn't feel anyone would feel safe driving it. Commissioner Eckstein stated they should take the vehicle in question off of the auction list and let the Commissioners take a look at all the issues. Mayor Dale suggested Commissioner Lessard get with the Chief and come up with a proposal on how to utilize this vehicle. Commissioner Lessard made a motion to remove the Crown Victoria with VIN No. ending in 6544 from the auction list, and decIare the rema/ning items on the list surplus and authorize to sell at auction. Commissioner Willjams recommended Katherine Alexander, a retired teacher of Seminole High School and a long time resident of Sanford be appointed to replace Rev. Jones. Commissioner Eckstein suggested to wait until the 'Commission has a chance to speak with Rev. Jones to see if he is willing to serve again, and also to let the other Commission members become more familiar with Ms. Alexander. Commissioner Lyons stated concern that they did not have an application on file from Katherine Alexander. Commissioner Williams withdrew her recommendation and the matter was tabled until the Thursday, May 22, 1997 Commission meeting. E. Planning and Zoning Commission.. The City Clerk reported Leon Brooks has served the maximum number of terms allowed and his current term will expire on June 30, 1997; Ross Robert's and H. L. Stogner's terms also expire on June 30, 1997 and they both have expressed a desire to be re-appointed. Commissioner Lessard moved to re-appoint Ross Robert. Urged the Commission to immediately look at the loitering laws and the noise laws. City Manager Simmons reported he will be getting with City Attorney Colbert this week to work on the noise ordinance he has gone over with Commissioner Lyons and the rest of the Commission. He also has met with Commissioner Lyons regarding incorporating several elements from the Austin, Texas information. Asked the City Manager who is responsible for maintaining the Iights in the parks. City Manager Simmons reported it is the City's responsibility but someone needs to inform the City when the lights are out or need replaced. Would like the Commission to rescind the action they took in giving Mr. Rowe instructions to notify Ms. Delano of the property on Magnolia by mail. He felt this was money and time the City did not need to spend since the property owner has never cooperated with the City and has been a nuisance. E. Mayor-Commissioner Dale. Asked Comsrfissioners to please keep their reports from the consultants and the RFP for the Thursday, May 22, 1997 meeting at 4:00 p.m. in City Hall. Asked City Attorney Colbert about safety laws for bicycles regarding lights and reflectors. The City Attorney stated there are minimum standards under Chapter 316 of the Hofida Statutes concerning illumination of bicycles and traffic regulations. Mayor Dale stated there are so many bicycles in town with two or three people on them with no lights or reflectors and wondered what the City's 1/ability would be if we don't enforce these laws. The only way the City would be liable is if the police force was given specific instructions not to enforce the regulations. If the City leaves the enforcement to the discretion of the police department liability should not be a question. Mayor Dale felt we may have some reduction in crime if we enforced some of these bicycle regulations. There being no further business, the meeting was adjourned. Attest:
