OF SANFORD, a municipality of the State of Florida, grantor(s), to the STATE OF
FLORIDA DEPARTMENT OF TRANSPORTATION, its successors and assigns, grantee.
Witnesseth: That the grantor for and in consideration of the sum of One Dollar and
other valuable considerations paid, the receipt and sufficiency of which is hereby
acknowledged, hereby grants unto the grantee, its successors and assigns, a perpetual
easement for the purpose of clearing, excavating, constructing, operating, and maintaining
a sidewalk with all such fills, cuts, drains, ditches and other incidents which the grantee
may deem necessary or convenient in connection therewith, in, over, under, upon and
through the following described land in Seminole County, Florida, viz:

Commence at an axle with no identification marking the northwest corner of the northeast quarter
of Section 28, Township 19 South, Range 30 East, Seminole County, Florida, as shown on Florida
Department of Transportation Right of Way Map Section 77030, Financial Project Identification
No. 417484 -1; thence run South 00 °09'04" East along the west line of the northeast quarter of
said Section 28 a distance of 1346.62 feet to a point on the existing northerly right of way line of
State Road No. 46 according to said Right of Way Map; thence continue South 00 °09'04" East
along said west line a distance of 100.06 feet to a point on the Centerline of Construction of State
Road No. 46 according to said Right of Way Map; thence departing said west line, run South
88 °11'51" East along said Centerline of Construction a distance of 313.67 feet to the point of
curvature of a curve concave northerly having a radius of 2864.93 feet; thence run easterly along
the arc of said curve and continuing along said Centerline of Construction through a central angle
of 02 °00'32" and a distance of 100.44 feet to the end of said curve; thence departing said curve,
run North 89 °47'37" East continuing along said Centerline of Construction a distance of 1239.84
feet to a point on the northerly projection of the west line of Tract "A ", Northstar Business Park

On Motion of Commissioner ikti1 v U , seconded by
CommissionerO, /�a'1 , the following Resolution was
adopted:
Whereas, the State of Florida Department of Transportation proposes to construct or
improve State Road No. 46, Section No. 77030, F.P. No. 417484 1, in Seminole County, Florida:
and
Whereas, it is necessary that an easement across certain lands now owned by City of
Sanford, Florida, be acquired by the State of Florida Department of Transportation: and
Whereas, said use is in the best interest of the City: and
Whereas, the State of Florida Department of Transportation has made application to said
City to execute and deliver to the State of Florida Department of Transportation a perpetual
easement, or easements, in favor of the State of Florida Department of Transportation for the
purpose of constructing, operating, and maintaining new sidewalk, and said request having been
duly considered.

Now Therefore, Be It Resolved by the Board of City Commissioners of City of Sanford,
Florida, that the application of the State of Florida Department of Transportation for a perpetual
easement, or easements, is for transportation purposes which are in the public or community
interest and for public welfare; that a perpetual easement, or easements, in favor of the State of
Florida Department of Transportation in Sanford, Florida, should be drawn and executed by the
Mayor of the City of Sanford, on behalf of the City and the of City Commission.
Be It Further Resolved that a certified copy of this Resolution be forwarded forthwith to the
State of Florida Department of Transportation at 719 South Woodland Blvd., Deland, Florida,
32720 -6834.
Effective Date. This Resolution shall become effective immediately upon its passage and
adoption.
Passed and Adopted by the City Commission of the City of Sanford, Florida, this 10 day of
December, 2012.
