The action of the Commission was to approve the recommendation to accept said conservation easement. Please have the the conservation easement documents prepared and submit them to this office for recording. MEMORANDUM / TO: City Manager/~~/ FROM: Director of Engineering and SUBJECT: NOVEMBER 20, 1986 Planning Historic Preservation Board Recommendation for Acceptance of Conservation Easement Mr. Faison: During their November 13, 1986 meeting, the Historic Preservation Board heard a presentation by representatives of Sandifur Management, Inc. offering to donate a conservation ease- ment covering the First Union Bank building at 101 E. 1st Street. This conservation easement would prohibit the future placement of any improvements above the building as it now exists. If the easement is accepted, City of Sanford would be assured that this building, located within the Historic District, would never be modified by adding additional floors to the building. As evidenced by the attached recommendation, the Historic Preservation Board recommends acceptance of this easement. WAS:mch xc: Planning and Zoning Commission AGENDA ITeM NO. ~ RECOMMENDATION TO THE SANFORD CITY COMMISSION A RECOMMENDATION TO THE SANFORD CITY CO~IISSION CALF.ING FOR Ta~ ACCEPTANCE BY THE CITY OF A CONSERVATION EASEMENT WHEREAS, on November 13, 1986, the Historic Preservation Board of the City of Sanford, hereinafter the Board, held a duly noticed public ~g; and WHEREAS, at such hearing representatives of Sandefur Management, Inc., hereinafter the Owner of First Union Bank Building located at 101 East First Street, hereinafter the Building, offered to donate and dedicate to the City of Sanford, hereinafter the City, a conservation easement over the Building; and WHEREAS, said conservation easement would transfer to the City the exclusive right to prohibit the development and placement of improvements above the Building as it exists; and WHEREAS, said conservation easement must be formally accepted and recorded in the public records on or before December 31, 1986 or the offer to dedicate same will be withdrawn by the Owner; and WHEREAS, tance of said conservation easement is and effectuates and furthers the purpose hereafter the Ordinance; the Board has determined that the dedication and accep- in the public interest of Ordinance No. 1777, NOW THEREFORE, pursuant to Section 14 of the Ordinance, the Board hereby makes the following recommendation to the City: 1. that the City Commission consider at its next meeting the offer by the Owner to dedicate said conservation easement to the City. 2. That said the exclusive right conservation easement transfer to the City to prohibit the development or placement of improvements above the Building as it currently exists. 3. That said conservation easement is in the public interest and effectuates and furthers the purpose of the Ordinance. 4. That the City Commission pass an appropriate resolution or ordinance accepting the Owner's offer to dedicate said conser- vation easement. 5. That the City Commission act as expeditiously as possible in formalizing the City's acceptacne of said conservation easement so that said conservation easement can be accepted and recorded in the public 1986.
