RIGHT OF ENTRY AGREEMENT - PERSIMMON AVENUE LAP SIDEWALK PROJECT
THIS RIGHT OF ENTRY AGREEMENT is entered into this 9th day of April, 2013,
between THE SCHOOL BOARD OF SEMINOLE COUNTY, FLORIDA, a body corporate
pursuant to § 1001.40, Fla. Stat. whose address is 400 East Lake Mary Boulevard, Sanford,
Florida 32773 -7127, hereinafter referred to as the "GRANTOR," and the CITY OF SANFORD,
FLORIDA, a Florida municipal corporation, whose address is 300 North Park Avenue, Sanford,
Florida 32771, hereinafter referred to as the "GRANTEE."
WITNESSETH
For and inconsideration of the sum of ONE AND NO /100 DOLLAR ($1.00) and other
good and valuable consideration, receipt of which is hereby acknowledged, the GRANTOR
does hereby give, grant, bargain and release to the GRANTEE, the temporary right to enter
upon and act upon (as set forth herein) the following lands of the GRANTOR, said real property
being described as follows:
See attached documents describing the limits of the properties that may be entered.
(The fact that the documents relate to a "temporary construction easement does not change the
limitation of rights herein granted by the GRANTOR).
For the purposes of allowing the GRANTEE to access the said real property and to
conduct installation of silt fencing, relocating a stop sign and restriping of a drive lane (all other
work is being conducted on right -of -way owned by the GRANTEE and CSX railroad right -of-
way). The work will commence after June 1, 2013, and terminating on August 1, 2013 or such
earlier date if the improvements are completed earlier as evidenced by an affidavit of the
GRANTEE's Public Works Director provided to the GRANTOR said right of entry being granted
in order for the GRANTEE to install sidewalks, remove and replace striping /stop guard and
related improvements to the area which will enhance the transportation facilities serving the
GRANTOR's school.
The GRANTOR hereby warrants that it has good and marketable title and authority to
grant the rights to the GRANTEE as set forth herein.
By the acceptance of the rights granted herein GRANTEE agrees to accept, to the

extent permitted by law and subject to the limits set forth in law', responsibility for its acts of
negligence and, further, GRANTEE agrees to reasonably return the subject property to the
condition that it existed in prior to the use of the said property by the GRANTEE. MOREOVER,
THE GRANTEE AGREES that it's contractors and sub - contractors will agree, by contract
provision, to fully indemnify the GRANTOR for any loss, damage, injury to persons or property,
name the GRANTOR as a third party insured on their general liability insurance and restore the
property of the GRANTOR to substantially the same condition with the same utility as existed
prior to the work commencing. BY ACCEPTANCE AND USE of the rights granted herein the
GRANTEE and its contractors and sub - contractors agree not to interfere with the normative
school operations of the GRANTOR.
IN WITNESS WHEREOF, the GRANTOR has hereunto set its hand and seal the day
and year first above written.
