THIS INDENTURE, made this I~ day of December, A.D. 1985,
between FRIENDLY ICE CREAM CORPORATION, a Massachusetts corporation
with a principal place of business at 1855 Boston Road, Wilbraham,
Hampden County. Massachusetts 01095, doing business in Florida as
FRIENDLY ICE CREAM CORPORATION OF MASSACHUSETTS, party of the first
part, and CITY OF SANFORD, FLORIDA, a municipal corporation, situate
in Seminole County, Florida, party of the second part:
WITNESSETH
That party of the first part, for and in consideration of the
sum of ONE ($1.00) DOLLAR and other valuable consideration to
FRIENDLY ICE CREAM CORPORATION in hand paid by party of the second
part, receipt whereof is hereby acknowledged, has granted and
conveyed, and by these presents does grant and convey to party of
the second part, its successors, assigns, and licensees, a perpetual
non-exclusive easement under, upon, and across the ptope£ty situate
in Sanford, Seminole County, Florida, shown on EXHIBIT A attached
hereto and more particularly described as follows:
