Chairman Warner called the meeting to order Thursday, January
8, 1981 at 7:00 P.M. The meeting was held in the City Manager's
Conference Room, Sanford City Hall. A quorum was present when the
meeting was called to order. Mr. Robert Morris arrived at 8:00 P.M.*
Mr. Warner announced that the reason for the meeting to begin
at 7:00 P.M. was so that the Board could conduct oral interviews
of the 4 fire lieutenants applying for the position of Assistant
Fire Chief. Those applicants were: Lt. Richard A. Evans, Lt.
Tom Hickson, Lt. Bill Lee, and Lt. Jim Poovey. Each applicant was
interviewed in private for 15 minutes by the Board.
As a result of the oral interviews, Mr. Morris motioned that Lt.
Hickson be certified as he is the only applicant- educationally
qualified and that the other 3 applicants, Lt. Evans, Lt. Lee, and
Lt. Poovey, be conditionally certified with the condition to be
terminated in one year and the Civil Service Board consider at any
regular Civil Service Board meeting removing the condition upon
proof that the applicant has met the educational qualifications.

Seconded by Mr. Jones, motion carried unanimously. The applicants
were returned to the conference room and the board explained
their findings to them. At the conclusion of the interviews, the
regular agenda items of the Board were to be taken up.
OLD BUSINESS:
1. At 9:10 P.M. Chairman Warner called for a reading of the
minutes of the regular meeting of the Board of Thursday, December
4, 1980.
Donald Jones moved that the reading of the minutes of
the regular meeting of the Board of December 4, be accepted as
mailed. The motion was seconded by Dr. Perez and carried unanimously.
Mrs. Smith questioned whether the Board had heard anything
about being covered by insurance, which she thought was the original
reason why the Board wished to be changed to a Personnel Board.
Morris denied this insurance issue again, for the third time.
Morris said this has come up in the meeting and the newspaper, and
is not the reason why the Board wished to make the change.
NEW BUSINESS:
1. A discussion was held in reference to a possible change-
over from a Civil Service Board to a Personnel Board. Various
employees to be present.
Chairman Warner recognized newly elected city commissioner
Milton Smith and introduced him to the employees.
Warner asked the Board Secretary if each department had been

had not seen them. Steve Harriett stated that the packet was

distributed to each department head with a memo that they make it avail -
able to the employees. A copy of the transmittal memo was found
and read to the employees.
Chairman Warner asked if any of the employees who were present
and read the first draft, had any questions for the Board.
Diane Smith asked if Rule 28, Section 3 was correct in that
the ruling of the Personnel Board could be appealed by the City
Manager. She pointed out that in the minutes of December 4, this
was the case, and wanted to know if the Board would request that -
this be changed, so that the City Manager could not reverse the
decisions of the Personnel Board. Morris said Rule 28, Section 3"
would be considered for change. That even if the Board stays as
a Civil Service Board, the rules and regulations will be revised.
Mrs. Smith questioned whether the Board had heard anything

Ron Neel indicated that he felt Mr. Warner was worried about
the insurance for the Board; Warner replied in the affirmative,
that being sued was a problem for him. The other members indi-
cated they were not concerned about being sued.
Pete Tucker asked if there was any information obtained as
to whether the Board will get the insurance coverage mentioned in
the last meeting. Steve Harriett said the carrier had been con-
tacted, but the City had received no policy yet. Rosa Rotundo
said the City Commission had already voted to cover the Civil
Service Board.
Ron Neel asked the Board to explain again why it wanted to
be changed to a Personnel Board. Bob Morris responded; because
Civil Service Board Rules and Regulations must be revised to
comply with the present City policy as far as grievances, etc., in
order to comply with current state and federal case law. In
looking at it, the Board was considering whether or not they should
become a Personnel Board because there is a provision already
adopted for it in the City Charter. Even if the City has a Civil
Service Board, the City Commission could at any time appoint a
Personnel Board. The Civil Service Board wanted to recommend to
the City Commission whether or not to abolish the Civil Service
Board and appoint a Personnel Board. Insurance is not that much
a concern. Also, that some of the City personnel policies have
superceded the Civil Service Rules and Regulations.
Ron Neel asked if the Board couldn't revise its rules and
regulations and stay as a Civil Service Board. That the fire
department wants the Civil Service Board to remain. Morris then
mentioned his concern in having two Boards if the City desired
to appoint a Personnel Board. He indicated that the City Commission
could abolish the Personnel Board.
Diane Smith stated that the employees are asking that the I J
Civil Service Board remain for the employees protection from being �/
fired and the right for an appeal before an independent body. /��
They don't want a Personnel Board under the thumb of the administra-
tion.
Morris stated that all the Board wants to do is what is best
for everybody concerned, employees, management and the City tax-
payers in general.
Dr. Perez said the Civil Service Board would be saddled with
more work if it were to become a Personnel Board. He stated that if
a Personnel Board were created, it's responsibilities would encom-
pass almost all of the Civil Service Board's current duties, then
the Civil Service Board would be doing nothing except holding appeal
hearings of which we have had only two in the last several years.
This would also mean two grievance boards to fight each other and both

boards talking to the commissioners. He is also afraid of a
Board that is under the thumb of the commissioners. As changes
in City management and the commission occur, this could affect the
Board. The employees must have the right to select at least two
of the Board members, so that the Board is not controlled by the
commissioners. Therefore, the makeup of the Board is the main
question. Perez felt that whatever the decision of the Board, the
commission would back them up. It would not be logical for the
commission to go against the Civil Service Board or Personnel
Board in its decisions, because the employee could take the City to
court if the decision was not ruled in his favor.-
The Personnel Board had always been a part of the City Charter
but it has never been activitated due to the Civil Service Board.
The Personnel Board would not be salaried. Rosa said she thinks
the commission wants the employees to be happy and asked if anyone
had approached the commission as to their desire to have a
Personnel Board. There was no response.
Larry Monti indicated he understood that the City Commission
will act on whatever the Civil Service Board recommends. He asked
if the Board had been asked by the City to push the Personnel Board
concept. Chairman Warner indicated that this was not the case,
that the City was not pushing the issue at all. That the Civil
Service Board brought the option up.
Bob Morris asked the chairman how the Board is to inform
the commission of what they have discovered as to the employees
wishes re the Personnel vs Civil Service Board proposal. He
indicated it appeared the employees wanted the Civil Service Board
and not the Personnel Board.
The City Manager asked to address the Board. He suggested
that the Board make a motion to table entirely the discussion of
�i going to a' Personnel Board. That it was apparent the employees did
not want it and that it would be best for the employees and the
\\ Board to get back down to the normal business of the day and
let this issue drop. That the Board update its rules and regulations
to comply with the laws and that it continue to operate as in the
past in the form of a Civil Service Board.
Dr. Darby motioned to table further discussion of changing
from a Civil Service Board to a Personnel Board and begin revising
present Civil Service Board rules and regulations to meet state
and federal regulations and current City rules. Motion was seconded

In the absence of the Chairman of the Board, Merle W. Warner,
Mr. Donald R. Jones opened the meeting at 7:00 P. M.,,Thursday, March
19, 1.981 with a quorum in attendance. The meeting was held in the
City Manager's Conference Room.
Mr. Jones called for nominations for the designation of a temporary
Chairman.
Mr. Morris moved that Mr. Jones be designated Chairman.
Dr. Perez seconded the motion and by unanimous approval of the Board,
Mr. Jones was designated as Acting Chairman.
The Chairman next designated, with the unanimous approval of the Board,
Mr. Morris to be Acting Secretary.
OLD BUSINESS:
1. The Chairman called for the reading of the Minutes of the Regu-
lar Meeting of the Civil Service Board held Thursday, January 8, 1981.
Dr. Perez moved that the Minutes of the Regular Meeting of the Civil
Service Board held Thursday, January 8, 1981, be accepted and approved as
mailed.

Motion seconded by Mr. Morris. Motion carried.
2. The Chairman called for the Board discussion of a replace-
ment for the 5th member, Merle W. Warner, retiring Board Chairman.
Mr. Morris submitted the name of one: Rev. Fred Neel, Pastor of the
Congregational Christian Church, active in civic affairs, a Rotarian,
has lived in and out of Sanford over the past ten years. Rev. Neel
has stated that he would be willing to accept the position.
Mr. Jones stated that he has the names of two persons who he has not
contacted.
Dr. Perez moved that further discussion be tabled until Dr. Darby is
present to formally submit his names of likely candidates to the Board.
Motion seconded by Mr. Morris. Motion carried.
NEW BUSINESS:
1. The Chairman called for the Board discussion of revising
the present Civil Service Rules and Regulations to meet State and
Federal guidelines.
The Board Secretary submitted a copy of the presertt Civil Service Rules
and Regulations.
After a lengthy discussion Mr. Morris moved that Mr. Knowles submit a
written wordage of the dismissal procedures presently being used as a
personnel policy by the Staff Office to the Board Members and to the
City Attorney, to be examined as an alternative to Civil Service Rules
and Regulations under sections 33 -37, pp. 11 -12.
Motion seconded by Dr. Perez. Motion carried.
2. The Chairman called for the Board discussion of revising or
validating tests presently being used in the civil service office.
Mr. Morris expressed his concern as to whether any of the test presently
being used in the civil service office ,-sere actually job related. Mr.
Morris stated that he felt the Civil Service Board should discontinue
testing, as a result, the new emplovee should be reviewed in 30 days
as well as the traditional 6 month evaluation.

Mr. Knowles stated that this would serve no real purpose because
supervisors presently could terminate new hires at any time, even
within a twenty -four hour period. Mr. Knowles also expressed his
concern over the job relevance and validity of the tests presently
being used in the civil service office. Mr. Knowles suggested to
the Board, that they do discontinue testing and that the Civil Service
,Secretary and the Personnel Office begin working on some type of struc-
ured interview rating to replace the tests.
After a lengthy discussion Mr. Morris moved- that the Civil Service
Board discontinue the practice of employment and promotional testing,
beginning immediately and the personnel office and the civil service
personnel begin working on a feasible structured interview rating scale
to replace the use of test in selecting probable candidates for entry
and promotion.-
Motion seconded by Dr. Perez. Motion carried.

Mr. Perez moved that the above named applicants who had satisfact-
orily completed entrance examinations for above listed positions, be
certified to the eligibility list of provisional applicants for these
positions. Motion seconded by Mr. Morris and carried unanimously.
There being no further business to come before the Board Acting
Chairman Jones adjourned the meeting at 8:34 P. M., March 19, 1981
upon receiving a motion from Mr. Morris and a second from Dr. Perez
to do so. Motion carried unanimously.
Read in an open meeting and approved this day of April, 1981.

Due to the resignation of Merle W. Warner, Chairman of the
Civil Service Board, Dr. John F. Darby opened the meeting at 8:00 P. M.,
Thursday, June 4, 1981 with a quorum in attendance. The meeting was
held in the City Managers Conference Room.
Dr. Darby called for nominations for the designation of a temporary
Chairman.
Mr. Morris moved that Dr. Darby be designated Chairman.
Mr. Jones seconded the motion and by unanimous approval of the Board,
Dr. Darby was designated as Temporary Acting Chairman.
OLD BUSINESS:
1. The Chairman called for the reading of the minutes of the
regular meeting of the Civil Service Board held Thursday, March 19,
1981.
Since the minutes had been unanimously, approved on Thursday, May 8,
1981, the Chairman moved on to the next item on the agenda.

NEW BUSINESS:
1. The Chairman called for the Boards, vote on t'he replacement
of the 5th member, Merle W. Warner, retired Board Chairman.
Mr. Morris moved that the Board elect and appoint Mr. Bill Mc4uatters
to the position vacated by the most honorable Merle W. Warner.
Motion seconded by Mr. Jones. Motion carried.
2. The Chairman called for the Boards, vote on a new Civil
Service Board Chairman.
Mr. Morris moved that Dr. Darby be appointed to the position of
Chairman of the Civil Service Board.
Motion seconded by Mr. Jones. Motion carried.
The Chairman then called for the Boards' vote on a new Secretary for
the Civil Service Board.
Mr. Morris moved that Mr. Donald R. Jones be appointed to the position
of Secretary.
Motion seconded by Mr. Mc4uatters. Motion carried.
3. The Chairman called for the Board discussion in reference to
the revised Civil Service Board rules and regulations.
Dr. Darby commended the work and time the Personnel Officer had put
into revising the rules and regulations.
After a lengthy discussion Mr. Morris moved that further discussion
on the revised Civil Service Board rules and regulations be tabled
until all Board members have had a chance to read and review the pro-
posed rules and regulations.
Motion seconded by Mr. Jones. Motion carried.
4. The Chariman called for the Board review of the 3rd draft of
the structured interview rating forms.
Since the 3rd draft of the interview rating forms were not ready for
presentation to the Board, the Chairman moved on to the next item on
the,agenda.

Dr. Darby asked how much - insurance covered the Board.
Mr. Knowles informed the Board that they were covered up to 1 (one)
million dollars and that this was the same coverage that the City
Commission was under.
There being no further discussion on the subject, the Chairman moved
on to the next item on the agenda.
6. The Chairman called for the Board discussion of the Police
Fire Arms Qualifications.
After a lengthy discussion Mr. Morris moved that the Board adopt, on
a temporary basis, the range qualifications for police officer in
appendix I (one) of the rules and regulations of the Civil Service
Board and the police officers fire arms qualifications policy adopted
by the City Commission April 27, 1981, temporarily, until the Board
can review and adopt the revised rules and regulations.
Motion seconded by Mr. Jones. Motion carried.
7. The Chairman called for the Board discussion in reference to
filing the "Financial Disclosure" forms.
After a short discussion Mr. Morris moved that each member fill out
the financial disclosure forms and return them to the Civil Service
Office for the Secretary to file.
Motion seconded by Mr. Jones. Motion carried.
8. The Chairman called for the Board discussion in reference
to the expiring terms of Dr. John F. Darby and Mr. Robert Morris.
Dr. Darby and Mr. Morris stated that if the City felt they should be
reappointed they would accept another term.

nominating committee, designate a clerk and select an election date.
A memorandum prepared by the City Manager was given to each Board
Member. The memo suggested that the nominating committee be broad-
en to give all departments a representative on the committee.,
After a lengthy discussion Mr. Morris moved that each department,
Finance, Police, Public Works, Fire, Utilities, Recreation and Parks,
and the non departmental people (Staff Office), select 1 (one) in-
dividual to serve on the nominating committee and then after nomina-
tions are selected Jan Swart of Finance serve as clerk, Jim Cohen
of Utilities Department, Harry Smith of the Recreation Department,
and Thomas Hickson of the Fire Department serve as the Election Committee
to supervise the election and count the ballots, effective June 4, 1981.

As a result of the Annual Civil Service Employee Election a new
Board Member was seated, Attorney Gordon Frederick, he takes the place
of Attorney Robert Morris. Mr. Frederick became a voting member of the
Civil Service Board on July 1, 1981.
Chairman Darby opened the meeting at 8:05 P. M., Thursday, July 9,
1981 with a quorum in attendance. The meeting was held in the City
Manager's Conference Room.
The Chairman next designated, with the unanimous approval of the Board,
Mr. McQuatters to be Acting Secretary.
OLD BUSINESS:
1. The Chairman called for the reading of the Minutes of the Re-
gular Meeting of the Civil Service Board held Thursday, June 4, 1981.
Mr. McQuatters moved that the Minutes of the Regualr Meeting of the
Civil Service Board held Thursday, June 4, 1981 be accepted and approved
as mailed.
Motion seconded by Mr. Frederick, Motion carried.
NEW BUSINESS:
1. The Chairman called for the Boards' vote to reinstate the 5th
member.

Mr. Frederick moved that the Board reinstate Mr. Bill McQuatters as
the 5th member of the Civil Service Board.
Motion seconded by Dr. Darby. Motion carried.
2. The Chairman called for the Board discussion in reference
to reorganizing the Civil Service Board or the Meeting Procedures.
Dr. Darby requested that all papers that fall into one category be
clipped together and the highlights be outlined by the Civil Service
Secretary before the meeting, also that each member intial each set
of papers after they have reviewed them.
Mr. Frederick requested that a list of each person in each category
be attached to the front of each set of papers.
Mr. McQuatters moved that further discussion of reorganizing be tabled
until the new member becomes familiar with the procedures and the absent
members have had a chance to voice their opinions.

3. The Chairman called for the Board discussion in reference to
the revised Civil Service Rules and Regulations.
Dr. Darby explained to the new Board Member what the revised Civil
Service rules consisted of and where they were taken from.
Mr. Frederick moved that the Board defer further discussion of the
revised Civil Service Board Rules and Regulations until he has had time
to go through and compare them with the old Rules and Regulations.
Motion seconded by Dr. Darby. Motion carried.
Mr. McQuatters brought out (five) concerns he had about the revised
Civil Service Rules and Regulations.

Steve Harriett stated that a sentence may have been left out, if there
are not sufficent applicants on file then the Civil Service Office

(B) PG. 3, Rule 5, Applications for Employment, Section 5A & 5B:
Mr. McQuatters felt that under this section a clause stating the
hiring of the handicapped may be appropriate.
Steve Harriett stated that this is handled through the City's
Affirmative Action Plan and the City does hire handicapped employees
if the handicap will not interfere with the individual's job per-
formance.
(C) PG. 5, Rule 6, Eligible Rosters:
Mr. McQuatters asked where the applicant register was kept:
The Board Secretary informed Mr. McQuatters that it is kept in the
Civil Service Office.
(D) PG. 14, Rule 21, Causes for suspension, demotion & dismissal,
Section 10:
Mr. McQuatters asked if failure to pay debts was a valid reason to
dismiss an employee?
Rosa Rotundo stated that the reason for this rule was probably because
of the harassment of supervisors on the job to get the employees to
pay the debt.
Steve Harriett stated that it may need to be reworded so that a clearer
meaning would be relayed. Steve indicated if the City is harassed by
creditors to garnish wages or to get the employee to pay or if the City's
reputation is at stake then this would be sufficent reason for dismissal.
(E) PG. 25, Rule 31, Employee Elections, Sections 7 a, b, c:
Mr. McQuatters stated that the number of employees on the election
Committee changed to seven. At the last Board Meeting the Board
voted to have a representative from each department and (one) from
the City Managers Staff Office.
Steve Harriett stated that this change would be made.
4. The Chairman called for the Board review of the 3rd draft of
the structured interview rating forms.
Steve Harriett asked the Board if they would allow the Civil Service
Office to use one of the forms on a trial basis for one months' time
to see how well they work.

Mr. McQuatters moved that the Board ask the Department Heads to try
the "Interview Evaluation Form: for a period of one month, at the end
of the month they should address a report to the Civil Service Board
as to their opinion of the effectiveness of the form and any changes
they wish to recommend. They should also indicate how many forms they
used during this period of time.
Motion seconded by Dr. Darby. Motion Carried.
The Structured Interview Evaluation Form includes points for work his-
tory, education, and related skills.

Mr. Frederick moved that the Revised Rules and Regulations
be tabled for another thirty days until he has had time to study
them further.

2. The Chairman called for the Board discussion of the
Department Heads comments on the final draft of the Interview
Rating Forms.
Mr. Frederick moved that approval of the new Interview rating
forms be deferred for another thirty days. At the end of the thirty
day period Department Heads using the form should prepare a report
for the Civil Service Board indicating the effectiveness of the form,
any adverse comments should be supplemented by constructive ways by
which the form may be improved.
Motion seconded by Dr. Perez. Motion carried.
The Board next reviewed a letter from the City Clerk, Henry
Tamm, requesting that the Civil Service Board consider amending the
requirement of posting job announcements "in- house" for e days to
three.
After a review of the Civil Service Rules and Regulations, the Board
asked the Civil Service Secretary to write a memo to Mr. Tamm explain-
ing that they felt this was not their responsibility and that the
matter should be taken up with the City Managers Office, unless he
has information to the contrary.
Francie Wynalda stated she would find out just whose responsibility
it was and where the requirement originated, and would advise the Board.

Chairman Darby opened the meeting at 8:15 P. M., Thursday
October 8, 1981 with a quorum in attendance. The meeting was held
in the City Managers Conference Room.
With the unanimous approval of the Board, Mr. Bill McQuatters
was designated Acting Secretary for the October meeting.
OLD BUSINESS:
The Chairman called for the reading of the Minutes of the
regular meeting of the Civil Service Board held Thursday, August 6,
1981.
Mr. Frederick moved that the minutes of the Civil Service Board
held Thursday, August 6, 1981, be accepted and approved as mailed.
Motion seconded by Mr. McQuatters. Motion carried.

Mr, Frederick moved that the Revised Rules and Regulations
be tabled for another month until he has had time to prepare a
final deft.
Motion seconded by Mr. McQuatters. Motion carried.
Z. The Chairman called for the Board discussion of the Depart -
ment Heads comments on the final draft of the Interview Rating Forms.
The new forms (developed by the Personnel Officer: were presented
to the Board; one for Skilled Craft & Service Workers and one for
Police Officers and Firefighters. The Personnel Officer suggested 6
forms be developed, one for each of the following categories.
1.) Officials/Administrators
2.) Professionals
3.) Technicians
4.) Protective Service (Police Officers & Firefighters)
5.) Clerical
6.) Skilled Craft & Service Maint.
Mr. McQuatters stated that there may be to many forms, it may
be possible to use one form and the job description in conjuction to
the form as a summary sheet to compare with the applicants work history.
Mr. Frederick stated that the forms need room for additional
Comments. The Personnel Officer should develop the six forms on a
legal size sheet of paper leaving adequate room at the bottom for

prancie Wynalda stated that she would be grateful if Mr. McQuatters
and Dr, Darby would provide her examples of forms that their organizations
use. That maybe these would provide some new ideas for the City's inter-
view forms.

ed of the Board's review of Administrative Reports, Probationary and
Anuual Evaluations, Provisional/Probationary Status and "F" Grade
Evaluations, and asked if any one had any comments to make about
these items on the agenda.
Mr. Frederick stated that after reading the Civil Service Rules
and Regulations, he can find no requirement or necessity of the Civil
Service Boards review of these reports. The Civil Service Board's auth-
ority is limited to disciplinary actions and the Board can only act if
an appeal is filed.
Mr. Frederick moved that the Board dispense of the review of
administrative reports, employee probationary and /or annual evaluations,
provisional employees' certification to probationary status, and employee
evaluations in "F" grade. Mr. Frederick also requested that the items
not be put on the agenda in the future, unless there is information con-
cerning these items which the Civil Service Board should review.
Motion seconded by Mr. McQuatters. Motion carried.
Mr. McQuatters suggested that in the future a report be prepared
showing the number and types of personnel transactions occuring during
the month.
The Secretary was instructed to continue to list these transactions
in the minutes of each Board Meeting.

Pete Tucker asked if there was any information obtained as
to whether the Board will get the insurance coverage mentioned in
the last meeting. Steve Harriett said the carrier had been con-
tacted, but the City had received no policy yet. Rosa Rotundo
said the City Commission had already voted to cover the Civil
Service Board.
Ron Neel asked the Board to explain again why it wanted to „
be changed to a Personnel Board. Bob Morris responded; because
Civil Service Board Rules and Regulations must be revised to
'comply with the present City policy as far as grievances, etc., in_�"
order to comply with current state and federal case law. In
looking at it, the Board was considering whether or_not they should
become a Personnel Board because there is a provision already
adopted for it in the City Charter. Even if the City has a Civil
Service Board, the City Commission co*ild -at any= tiy:c appoint a
Personnel Board. The Civil Service Board wanted to recommend to
the City Commission whether or not to abolish the Civil Service
Board and appoint a Personnel Board. Insurance is not that much
a concern. Also, that some of the City personnel policies have
superceded the Civil Service Rules and Regulations.
Ron Neel asked if the Board couldn't revise its rules and
regulations and stay as a Civil Service Board.. That the fire
department wants the Civil Service Board to remain. Morris then
mentioned his concern in having two Boards if the City desired
to appoint a Personnel Board. He indicated that the City Commission
could abolish the Personnel Board.
Diane Smith stated that the employees are asking that the
Civil Service Board remain for the employees protection from being
fired and the right for an appeal before an independent body.
They don't want a Personnel Board under the thumb of the administra-
tion.
Warner stated that all the Board wants to do is what is best
for everybody concerned, employees, management and the City tax-
payers in general.
Dr. Perez said the Civil Service Board would be saddled with
more work if it were to become a Personnel Board. He stated that if
a Personnel Board were created, it's responsibilities would encom-
pass almost all of the Civil Service Board's current duties, then
the Civil Service Board would be doing nothein except holding appeal
hearings of which we have had only two in the last several years.
This would also mean two grievance boards to fight each other and both
. boards talking to the commissioners. He is also afraid of a Board
that is under the thumb of the commissioners. As changes in City
management and the commission occur, this could affect the Board. The
employees must have the right to select at least two of the Board mem-
bers, so that the Board is not controlled by the commissioners.

286.011 Public meetings and records; public

Ad meetings of any board or commission of
state agency or authority or of any agency or au-
11t`• of any county, municipal corporation, or po-
;d subdivision, except as otherwise provided in
C „ ~stitution, at which official acts are to be tak-
clared to be public meetings open to the
• all times, and no resolution, rule, or formal
action shall be considered binding except as taken or
made at such meeting.
(2) The minutes of a meeting of any such board
or commission of any such state agency or authority
shall be promptly recorded and such records shall be
open to public inspection. The circuit courts of this
state shall have jurisdiction to issue injunctions to
enforce the purposes of this section upon application
by any citizen of this state.
(3) Any person who is a member of a board or
commission or of any state agency or authority of any
county, municipal corporation, or political subdivi-
sion who violates the provisions of this section by at-
tending a meeting not held in accordance with the
provisions hereof is guilty of a misdemeanor of the
second degree, punishable as provided in s. 775.082,
s. 775.083, or s. 775.084.
(4) Whenever an action has been filed against any
board or commission of any state agency or authority
or any agency or authority of any county, municipal
corporation, or political subdivision to enforce the
provisions of this section or to invalidate the actions
of any such board, commission, agency, or authority,
which action was taken in violation of this section,
and the court determines that the defendant or de-
fendants to such action acted in violation of this sec-
tion, the court shall assess a reasonable attorney's fee
against such agency, and may assess a reasonable at-
torney's fee against the individual filing such an ac-
tion if the court finds it was filed in bad faith or was
frivolous. Any fees so assessed may be assessed
against the individual member or members of such
board or commission; provided, that in any case
where the board or commission seeks the advice of its
attorney and such advice is followed, no such fees
shall be assessed against the individual member or
members of the board or commission. However, this
subsection shall not apply to a state attorney or his
duly authorized assistants or any officer charged with
enforcing the provisions of this section.
(5) Whenever any board or commission of any
state agency or authority or any agency or authority
of any county, municipal corporation, or political
subdivision appeals any court order which has found
said board, commission, agency, or authority to have
violated this section, and such order is affirmed, the
court shall assess a reasonable attorney's fee for the
appeal against such board, commission, agency, or
authority. Any fees so assessed may be assessed
against the individual member or members of such
board or commission; provided, that in any case
where the board or commission seeks the advice of its
attorney and such advice is followed, no such fees
shall be assessed against the individual member or
members of the board or commission.
(6) All persons subject to subsection (1) are pro-
hibited from holding meetings at any facility or loca-
tion which discriminates on the basis of sex, age, race,
creed, color, origin, or economic status or which oper-
ates in such a manner as to unreasonably restrict
public access to such a facility.

(7) Whenever any member of any board or com-
mission of any state agency or authority or any agen-
cy or authority of any county, municipal corporation,
or political subdivision is charged with a violation of
this section and is subsequently acquitted, the board
or commission is authorized to reimburse said mem-
ber for any portion of his reasonable attorney's fees.

county, or municipal governmental board, commis-
sion, or agency who is present at any meeting of any
such body at which an official decision, ruling, or oth-
er official act is to be taken or adopted may abstain
from voting in regard to any such decision, ruling, or
act, and a vote shall be recorded or counted for each
such member present, except when, with respect to
any such member, there is, or appears to be, a possi-
ble conflict of interest under the provisions of s.
112.311, s. 112.313, or s. 112.3143. In such cases said
member shall comply with the disclosure require-
ments of s. 112.3143.

title and every right, interest, claim or demand of any
kind in and to any patent, trademark or copyright, or

nial Commission of Florida as remain in effect at the
time of its abolishment. The department shall have
such powers and authority as may be necessary to
protect the interests of the state in matters resulting
from the programs and activities undertaken by the
commission in fulfillment of its statutory responsibil-
ities.

sponsorship. —Any nongovernmental organization
which sponsors a program financed partially by state
funds or funds obtained from a state agency shall, in
publicizing, advertising, or describing the sponsor-
ship of the program, state: "Sponsored by (name of orra-
nization) and the State of Florida." If the sponsorship
reference is in written material, the words "State of
Florida" shall appear in the same size letters or type
as the name of the organization.

(1) The public officers in charge or governing bo-
dies, as the case may be, of every county, district
school board, governmental unit, department, board,
or bureau of the state, including tax or other dis-
tricts, political subdivisions, and public and qua-
si- public corporations, other than incorporated cities
and towns, of the several counties and the state, all
hereinafter referred to as political subdivisions,
which political subdivisions in the performance of
their necessary functions own or lease and operate
motor vehicles upon the public highways or streets of

the cities and towns of the state or elsewhere, own or
lease and operate watercraft or aircraft, or own or
lease buildings or properties or perform operations in
the state or elsewhere are hereby authorized, in their
discretion, to secure and provide for such respective
political subdivisions, and their agents and employ-
ees while acting within the scope of their employ-
ment, insurance to cover liability for damages on ac-
count of bodily or personal injury or death resulting
therefrom to any person, or to cover liability for dam-
age to the property of any person or both, arising
from or in connection with the operation of any such
motor vehicles, watercraft, or aircraft, from the own-
ership or operation of any such buildings, property,
or livestock, or any other such operations, whether
from accident or occurrence; and to pay the premi-
ums therefor from any general funds appropriated or
made available for the necessary and regular expense
of operations of such respective political subdivi-
sions, without the necessity of specific appropriation
or specification of expense with respect thereto. Pro-
vided, that in those instances where, by general law,
provision has been made for the public officer in
charge or governing body of any such political subdi-
vision to provide such insurance, this section shall
not be construed to impair any such previous acts but
shall be construed as cumulative thereto.

Herein lies the problem.
1
-� Since Bob Morris appointed Jan Stuart, Jim Cohen, Harry Smith
and Tom Hickson, with the exception of Harry's death, there
has been no change since 1981 in the election committee
$'supervisors" if you will. ( See attached election committee chart).
Since the subject of the election committee is on the agenda
for discussion again Thursday night, I thought you might like
a recommendation as to how to settle this.
I have studied the Act and both the old and newly revised Rules
and Regulations and make the following recommendations re: the
election committee. I feel these will not be in conflict with
the act or rules:
1. Department employees nominate a person to sit on the elect. comm.
2. Dept. representative cannot serve more than two years on the
election committee. He /she may be re- appointed to a 2 year term
only after all other dept. employees have had an opportunity
to serve.
. 3. Board reviews the 7 names and authorizes them as the election
committee (Unless they find a name unacceptable and ask for
a substitute) . 0--4-
4. Board then selects 1 clerk and 3 inspectors from the 7 employees.
However, all 7 employees make up the committee and input will be
encouraged and accepted from all 7. The election committee,
specifically, will be charged with duties and responsibilities
as noted in the Act, Section 3 and the Rules and Regulations
Rule 31, Sections 6 and 7,(i.e. to supervise the election,
issue ballots to voters, maintain a list of persons voting and
ascertain that only qualified civil service personnel participate
in the vote, count votes, certify results and report results
to City Clerk.).
Also, the clerk and 3 inspectors review the candidates to ensure they
meet nominating requirements before placing them on the ballot.
5. On election day, the clerk and 3 inspectors supervise the election.
Also, I thought you might be interested in the number of votes
being cast in civil service elections over the past 10 years. A
• table is attached which shows a downward trend since 1979.

some background information relating to the Civil Service Employee
. Election Committee. This item is on the agenda under section 2,
number C. I
THE CIVIL SERVICE ACT, LAWS OF FLORIDA, 1961_
SECTION 3 (a),Election of the Two Board Members by the CS Em_plloyees
Members of the Board appointed by the City Commission shall annually
appoint, from the permanent civil service employee list, an election
committee consisting of a clerk and 3 inspectors to provide for and
supervise the election of Board members to be elected by the civil
service employees.
CIVIL SERVICE MEETING
JUNE 4, 1981
During the June 4 meeting, a memorandum was distributed by the City
Manager to each Board member. The memo suggested that the election
committee be broadened to give all departments representation on the
committee. After lengthy discussion Bob Morris moved that each dept:
Finance, Police, Public Works, Fire, Utilities, Recreation/ Parks and
the Staff Office select one individual to serve on the election
committee. After these 7 were selected that Jan Stuart of Finance
serve as clerk, Jim Cohen, Harry Smith and Tom Hickson serve as the
inspectors. Motion was seconded and carried.
CIVIL SERVICE MEETING
OCTOBER 7, 1982
Another discussion was held in reference to rotating the civil
service board election committee members within each department so that
all depts. became involved in the election process. Motion was made to
approve this amended plan, seconded and carried. The new plan was:
Each department is to be assigned a number. Even numbered departments
appoint representatives on the even numbered years and odd numbered
departments appoint members on odd numbered years. A department
representative cannot serve on the committee more than two consecutive
years. Depts. were numbered as follows:
1. All Staff Offices
2. Finance Dept.
3. Police Dept.
4. Fire Dept.
5. Public Works Dept.
6. Recn. & Parks Dept.
• 7. Utility Dept.

You will notice that before 1981 the election committee rotated
the clerk, and 3 inspectors even though each Dept. did not have
his /her own department representative. In 198.E each Dept. was
3iven a Dept. representative to allow for greater representation,
and in 1982 was amended to limit terms on the committe to not more
than two consecutive terms. However the clerk and 3 inspectors
have not changed in the past two years.
