MINUTES 49 Work Session March 9,2009 City Commission, Sanford, Florida E0051444IDW The City Commission of the City of Sanford, Florida, met in Work Session on Monday, March 9, 2009 at 4:00 PM, in the City Commission Chambers, 1st Floor, City Hall, 300 North Park Avenue, Sanford, Florida. Present: Vice Mayor Randy Jones [Left at 5:07 PM] Commissioner Art Woodruff Commissioner Velma Williams Commissioner Jack T. Bridges City Manager Robert (Sherman) Yehl Assistant City Attorney Lonnie Groot City Clerk Janet R. Dougherty Administrative Specialist Pat Lee Absent: Mayor Linda Kuhn City Attorney William Colbert Vice Mayor Jones called the Work Session to order at 4:03 PM. Vice Mayor Jones stated that Mayor Kuhn was at a doctor's appointment and that he needed to leave at 5:00 PM.to coach his son's basketball game. 1) Alternative Water Supplies - presentation. [Commission Memo 09-093] Paul Moore, Public Utilities Director, stated that in (approximately) the year 2017 there will be a need for alternative water resources. He introduced David Gierach, Conklin, Porter and Holmes (CPH) Engineers, who reviewed the Alternative Water Supplies Report, noting Sanford is in a very good condition and better off than other cities, because the City has excess capacity. Recommendations included continuing use of reclaimed water, maximizing use of the augmentation system to meet irrigation needs; continuing with the aggressive conservation program that has resulted in the low per capita use the City has; and continue to be part of the planning and participation of alternative water supplies. Mr. Moore advised that $300,000 would be budgeted next year as Sanford's share of the preliminary design of the East 46 Project and he also will be coming back for funding of the Yankee Lake preliminary design in about ninety days. 2) Property purchases for Stormwater Projects. - discussion. (Regular Items No.9. E and F) [Commission Memos 09- 094 and 09-095] Mr. Yehl stated this item pertains to two separate purchases as Public Works is seeking solutions at Oak Avenue and 24th Place to mitigate repetitive flooding events and to provide additional retention capacity. Assistant City Attorney Groot stated that the law was very simple on inverse condemnation and flooding: if it occurs naturally it is not caused by action of the government and there is no liability. If government does anything, even to the extent of fixing a problem which then results in property flooding, government then has liability. In the case under discussion, the technical knowledge is that it is natural. After discussion, it was the consensus of the Commission for staff to speak with other adjacent property owners and come back with a total package to purchase the properties needed. In response to a question from Commissioner Bridges, Tom George, Public Works Director, stated that he determined there was no benefit to the City to purchase properties in the vicinity of 10th and 11 th Streets (off of Cedar Avenue) for the possibility of modifying the pond with the intent of improving the stormwater project, as there was no benefit in trying to extend the pond to the south and there have been no projects/improvements that he knows of that have increased the flow of water to those areas. Further, he does not recommend purchasing property simply because it naturally floods, and to consider purchasing such property only if the City needs it. 3) Proposed Code Enforcement Ordinances - discussion. (Regular Items No. 8.A (1) thru (7)) [Commission Memo 09-092] Mr. Yehl stated two public meetings have been conducted and he believed everyone benefitted from having a side-by-side comparison of the existing Standard Housing Code and the 2006 International Property Maintenance Code, MINUTES 50 Work Session March 9. 2009 City Commission, Sanford, Florida E0051444lDW noting there are not many differences between the two codes. Discussion was held concerning existing older homes being required to come up to code and Mr. Yehl stated that the systems have to be in good operating condition. Mr. Groot explained that "working fine" means not a danger to the public health, safety or welfare. Regarding Ordinance No. 4157 (foreclosure), Mr. Groot stated the City may want to table this Ordinance to see what the Legislature may enact. Mr. Yehl distributed an add on agenda Item, 9.1, for the regular meeting: Authorization of $248,750 payment to Calvin Smith for full and final settlement of his August 30, 1999 work related injury. 5) End the meeting.
