Commissioner Bridges moved to approve the first reading of Ordinance No. 4171, subject to the conditions
recommended by the Planning and Zoning Commission and StatIin Commission Memorandum 09-122, with amendments
to stipulations as follows: delete #7 which required that the owner work with Seminole County to provide safe pedestrian
connection to the existing sidewalks along County Road 46A during Development Plan approval; #9 - The Planned
Development approval shall expire three years from the effective date of the Ordinance approved by the City Commission,
subject to a request for extension that would be reviewed and considered by the City Commission, in good faith and under
all municipal laws and statutes pertaining thereto; #11 - The owner shall pay to Seminole County as the project's
"proportionate share" such costs of the traffic concurrency requirements prior to the issuance of a building permit; # 12 _

Mayor Kuhn said that the lien waiver request will be discussed at the April 13, 2009 meeting.
14) CITY COMMISSIONERS' REPORTS.
Commissioner Woodruff said that on June 18, 2008, a tree in the City's right of way fell upon and damaged
Ollie Williams' fence. City crews removed the tree, cleaned up the debris, and was amenable to fixing the fence, but after
review by Risk Management and the Florida League of Cities it was determined that the City didn't have to make the repair.
Since that time the City approved a program that will pay up to half of the cost of a denied claim and has offered to pay
$333 toward the repair although that is less than half of the estimated cost. With the amount of time that has been spent
discussing this issue the City should have just fixed the fence. While the City may not be legally bound he thinks it is
morally bound and asked that the City make the repair. He asked the Commission to review the Denied Claims Program at
the next meeting.
