4314 Florida Building Code amdmts lIPage Ordinance No. 2014-4314 An ordinance of the City of Sanford, Florida substantially revising and amending Section 104.6.6. of Section 18-2. of the City Code of the City of Sanford, Florida relating to building valuation data and determinations pertaining to the issuance of building permits under the provisions of the Florida Building Code; providing for the taking of implementing administrative actions; providing for enforcement; providing for conflicts; providing for a savings provision; providing for codification; providing for severability and providing for an effective date. Be It Enacted By The People Of The City Of Sanford, Florida: Section 1. Legislative findings and intent. A new section of the City Code of the City of Sanford, Florida is created to read as follows: (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to this Ordinance. (b). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. Section 2. Building permit valuations. Section 104.6.6. of Section 18-2. Of the City Code of the City of Sanford, Florida is substantially revised and amended to read as follows: Sec. 18-2. Amendments to Florida Building Code. Chapter 1 of the Florida Building Code, entitled "Administration," is amended as follows: The Florida Building Code (Section 553.73, Florida Statutes) replaced Florida's mixture of codes that were developed, amended, administered and enforced by more than 400 local jurisdictions and state agencies with building code regulation responsibilities. The current Florida Building Code is a single statewide code based on national model codes and consensus standards, amended for Florida specific needs for the design and construction of buildings. For the purposes of this Ordinance, underlined type shall constitute additions to the original text, *** shall constitute ellipses to the original text and strikethrough shall constitute deletions to the original text. Wage 104.6.6. Building permit valuations. The applicant for a building permit of any type or nature shall provide to the City an estimated permit value relating to the work proposed to be permitted at time that the application for a building permit is submitted to the City. No application for a building permit will be accepted without the tendering of an estimate of permit building costs value. Permit valuations shall include the full estimated total value of the work proposed to be accomplished under the authority of the building permit for which application is made including, but not limited to, materials and labor relating to the work and shall include, by way of example only, all aspects of the work such as electrical, gas, mechanical, plumbing equipment and permanent systems. New building construction and additions, for the purpose of determining permit fees and plan review fees, shall be established by adherence to the International Code Council2 building valuation data table based on square footage under roof which data is published semi-annually in the Building Safety Journal, or such other publication relied upon by the Building Official, as published by the International Code Council.3 If, in the professional opinion of the Building Official, based upon sound and generally accepted 2 The International Code Council (ICC) is a member-focused association dedicated to developing model codes and standards used in the design, build and compliance process to construct safe, sustainable, affordable and resilient structures. Puerto Rico and the U.S. Virgin Islands enforce one or more of the I-Codes. 3 The International Code Council provides periodic Building Valuation Data (BVD). The BVD is updated at 6-month intervals. Wage practices and principles of building officials serving in the State of Florida, and a review and application of the International Code Council data source, the valuation is determined to be underestimated on the application by the applicant, the permit shall be denied; provided, however, that, if the applicant can provided detailed estimates to the Building Official which demonstrate, by clear and convincing evidence, that such values are correct; the Building Official shall accept such values as tendered by the applicant. If such proof is not provided, the Building Official shall deny such request in writing. Final buildings permit valuation shall be established by the Building Official in the event of a dispute as set forth above. The decision of the Building Official shall be final and subject to appeal only to a Court of competent jurisdiction. , - - _ _ _ _ • _ , •• _ Section 3. Implementing Administrative Actions. Section 4. Penalties; Enforcement. A new section of the Code of Ordinances of the City of Sanford is created to read as follows: The City Manager, or delegatee, in conjunction with the City Attorney, may enforce the provisions of this Ordinance by any means authorized by controlling Florida law including, but not limited to, the statutory and home rule code enforcement powers of the City. Section 5. Conflicts. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed and the City Code codifier is hereby directed to take all actions necessary to implement the provisions of this Ordinance in that regard. Section 6. Savings. The prior actions of the City of Sanford relating to regulations relating to building permit valuations and the issuance of building permits, as well as related matters and processes activities relating thereto, are hereby ratified and affirmed. Section 7. Codification. It is the intention of the City Commission of the City of Sanford, Florida, and it is hereby ordained, that the provisions of this Ordinance shall be codified into the Code of Ordinances of the City of Sanford; provided, however, that Sections 6, 7, 8, 9 and 10 shall not be codified. Additionally, the code codifier shall have liberal authority to codify the provisions of this Ordinance. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 9. Effective Date. This Ordinance shall take immediate effect upon enactment. Passed and adopted this 27th day of January, 2014.
