Consider the Preliminary Subdivision Plan for Flagship Park, a proposed 117 lot triplex subdivision at 1801 Rinehart Road; James W. & Carol McCall, owners; James Baysinger, P.E. — VHB, Inc., Keith Ray - Land Acquisition Director for DR Horton, and Phillip Hollis — Hollis Engineering, representatives. Mr. VonHerbulis moved to approve the Preliminary Subdivision Plan per staff's recommendation with the exception on Item (d) only - have it state that all life safety site improvements are to be completed and the water lines completed and approved by DEP prior to any vertical construction. Mr. Volk seconded. All in favor. Motion carried. Consider the Site Plan for a proposed 3,287 square foot Wendy's at 470 Towne Center Circle; Seminole Towne Center, LP, owner; Jill Minton, P.E. — CPH Engineers, Inc., representative. Present to speak were Nadine Culbreath and Lucille Boykin. They were concerned about increased traffic on W. la Place and existing water drainage problems currently on their properties. Mr. Yosefian moved to approve the Conditional Use per staff's recommendation. Mr. VonHerbulis seconded. All in favor. Motion carried. Mr, VonHerbulis moved to approve the Preliminary Subdivision Plan per staff's recommendation. Mr . Yosefian seconded. All in favor. Motion carried. STAFF REPORTS. Mr. Robertson reported that the American Door/Window Company advised staff that they are in the process of re- organizing and re- locating their various operations in the area which would result in the use of the former Scotty's facility being in compliance (e.g., fire /life safety codes). A specific date has not been set, however it was indicated that it could be as early as November or perhaps by the end of this year. Mr. Robertson distributed a copy of a letter addressed to Paul Lanza informing him the Conditional Use is considered void due to the Site Plan not being submitted within the required time period.
