Mr. Volk seconded. All in favor. Motion carried. CONSENT AGENDA. Consider the Joint Planning Agreement for recommendation to the Sanford City Commission. Present to speak were Larry Dale and Diane Crews from the Sanford Airport Authority and Tony Matthews from Seminole County. Mr. VonHerbulis moved to approve the JPA per staff s recommendation. Mr. Skat seconded. All in favor_ Motion carried. Approve the Final Plat for Greystone Townhomes, Phase 1,1 SS units of a 332 unit townhome community located at 2215 Oregon Avenue; Hubert Earley, owner. Mr , Skat moved to approve the Final Plat per staff s recommendation. Mr. Volk seconded. All in favor. Motion carried. DEVELOPMENT PLANS. None. PLANNING & ZONING COMMISSION MINUTES — MEETING OF MAY 20 PAGE 2 PUBLIC HEARINGS. Consider a Conditional Use request to establish a Community Resource Facility for Last Chance Street Ministries at 900 W. 13' Street; Thomas R. Poitier, owner; Carolyn Fritz -Last Chance Street Ministries, representative. Present to speak and giving support were Pastor Lauren Fritz, Ulysses Raines, Pastor William Thomas, Ken Woodford, Richard Young, Mike, and Annie Eubanks. Karen Daniels was present to inform those in attendance that her father -in -law did not give permission for the use of the vacant lot east of this facility. Ms. Dennison moved to remove the request from the table. Mr. VonHerbulis seconded. All in favor, Motion carried. Mr. Skat moved to approve the Conditional Use request to establish a Church per staff s recommendation with the addition of a 12 month sunset provision which will allow the Planning and Zoning Commission to reconsider the approval after 1 year and to deny the Conditional Use request to establish a Community Resource Facility per staff s recommendation. Mr. VonHerbulis seconded. All in favor, Motion carried. Consider a Conditional Use request for an Urban Infill Redevelopment Project to allow a change of use from residential to commercial for a non - conforming property located at 1021 W. l it Street; Nicholas and Elizabeth D arwick, owners. Mr. VonHerbulis moved to table the Conditional Use until the June 3 meeting to allow for appropriate posting of the property. Ms. Dennison seconded. All in favor, Motion carried. ADD ON ITEM. Consider the Site Plan for the Cox Lumber Facility Expansion at 3940 Church Street. Tibbetts Land LLC, owner; Robert VonHerbulis -McKee Construction, representative. Due to Mr. VonHerbulis being the representative, he abstained from voting. Mr , Skat moved to approve the Site Plan per staff's amended recommendation (the development and use of the "Bass Property" shall be in accordance with the site plan presented to the Planning and zoning Commission on May 20, 2004). Ms. Dennison seconded. All in favor. Motion carried. STAFF REPORTS, Mr. Gibson reported that alternate member Rob Carraway submitted his resignation effective immediately. Since he is currently serving on the Code Enforcement Board as a regular member, the City Attorney advised him it is a conflict of interest to serve on the Planning and Zoning Commission at the same time. Mr.. Carraway stated that he wishes to be considered, when there is a vacancy, to serve on the Planning and Zoning Commission as a regular member. Mr. Skat requested that the City recognize Mr, Carraway for his service on the Planning and zoning Commission. Mr. Gibson reported that budget considerations for the repairs to the City Commission Chambers was submitted by the Public Works Division in the amount of $200,000, but was not approved at final budget and is currently an unfunded project. Also, regarding the inappropriate lights at 201 E. 18 Street, they have been corrected. PLANNING & ZONING COMMISSION MINUTES — MEETING OF MAY 20 PAGE 3 COMMISSIONERS REPORTS, Mr. Skat asked for an update on the Consolidated Investments project. Mr Gibson reported that he will follow up with the applicant to obtain an update on the project. Also, regarding the old Scotty's building, the Fire Department is working on some strategies to assess a daily fine for the violations. Mr. Skat asked if there could be some type of clean up along the seawall since the water level is presently low in the river. Mr. Gibson reported that the City is aware of the clean up issue and will check on it. Mr. VonHerbulis stated that the Riverwalk Grand Opening was a great success and staff did an exceptional job as well as the marketing group that was overseeing the event. CITIZEN PARTICIPATION. None.
