E B SPECIAL MAGISTRATE HEARING CITY OF SANFORD, FLORIDA CITY OF SANFORD, FLORIDA a municipal corporation, Petitioner, vs. CASE NO. 15-77 LARRY DILLIGARD Respondent. PROPERTY ADDRESS: 1010 West 12 th Street, Sanford Florida 32771 FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER THIS CAUSE came on for public hearing before the Special Magistrate on May 13, 2015 after due notice to the Respondent. Respondent did attend the hearing. Based on the testimony of the Officer and the evidence presented, the Special Magistrate issues the following Findings of Fact, Conclusions of Law and Order: I. FINDINGS OF FACT: 1. Respondent, LARRY DILLIGARD, is the owner of the property located at 1010 West 12th Street, Sanford, FL 32771, more particularly described as: LOT 16 STENDIFRODS ADD PB 1 PG 110 OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA ("the Property"). 2. The Property was inspected by a Code Enforcement Officer of the City of Sanford on February 3, 2015 at which time the Officer observed that the siding on the structure is hanging loose and there was high growth on the property. 3. The owner was notified of the violations and instructed to correct same by February 27, 2015. 4. The Property was re- inspected on May 12, 2015, and prior to the hearing, and the violations had not been corrected. 11. CONCLUSIONS OF LAW: The Respondent and the Property are in violation of the following: Section 18 -33 and Section 302.4 of the City of Sanford Code of Ordinances. III. ORDER: It is the Order of this Special Magistrate that Respondent shall correct all violations on or before 9:00 a.m. on July 6, 2015, or a fine of fifty dollars ($50.00) per day shall accrue beginning on July 8, 2015 and continue until said violations are corrected. It is further ordered by this Special Magistrate that once said code violations are corrected, any violation of the same code provision by the Respondent on the same property within five (5) years from the date of this Order shall be treated as a repeat violation, wherein the Special Magistrate may impose a fine of up to $1000.00 per day for each day the violation exists. Upon complying, the burden shall rest upon Respondent to IMMEDIATELY notify the Code Enforcement Officer at (407) 688 -5163; 300 N. Park Avenue, Sanford, Florida 32771, Monday through Thursday, 7:30 a.m. to 5:30 p.m., who shall re- inspect the Property and notify the Respondent whether the Property is in compliance or noncompliance. r A Hearing to determine whether Respondent has complied is set for July 8, 2015 at 9:00 a.m. in the City Commission Chambers, 300 North Park Avenue, Sanford, Florida 32771. The sole issue of this hearing is whether the Property has been brought into compliance. A certified copy of this Order will be recorded in the Public Records of Seminole County and shall constitute notice to any subsequent purchasers, successors in interest, or assigns, and the findings herein shall be binding upon the Respondent, his successors and /or assigns, (including any purchasers of the Property). This Order may be appealed to the Circuit Court within thirty (30) days of its execution. DONE AND ORDERED this 3k -day of `YYI 12015. Beth W.
