MATES PLANNING & ZONING COMMISSION MEETING OF AUGUST 1, 2002 7:00 P.M. CITY COMMISSION CHAMBERS CITY HALL, SANF RD, FLORIDA MEMBERS PRESENT: Kevin Hipes, Acting Chairperson. Andy Iut Gary Lowell Ram Yosefian Bobby VonHerbulis Carol Dennison Otto Garrett MEMBERS ABSENT: Michael Skat, excused Ross Robert OTHERS PRESENT: Nick Balevich, Planner Mary Muse, Recording Secretary Mr. Hipes called the meeting to order at 7: PM. The first item on the agenda was to hold a Public Hearing to amend the Future Land Use Map designation of the Comprehensive Plan from LDR -SF (Low Density Residential Single Family) to GC (General Commercial) for property located at 2209 French Avenue for Dr. Quinn's Office Building. Ir. `V'onHrbulis abstained from voting due to a conflict of interest. David Rodd with McKee Construction was present. The reason for the comp plan change is to allow all of Dr. Quinn's proper to be under the same land use category. There is a drainage area on the lot to the north, which is owned by someone else. The drainage for Dr. Quinn's property will be self - contained on the lot. John Harper of 2200 Cordova Drive was present to speak. He was concerned about the fence and the property line location. fir. VonlHerbulls pointed out on the site plan how the fence location is not on the property line. At one end of the property, the fence is located on Dr. Quinn's property and at the opposite end, Dr. Quinn's fence is on Mr. Harper's property. A new fence, which is required to be opaque and landscaped, will be built along Dr. Quinn's property one. PLANNING & ZONING COMMISSION MINUTES — MEETING OF AUGUST 1. 2002 PAGE 2 letter from Gayle Fahr of 406 Colonial way was submitted. The secretary read the letter into the record. The letter stated that Ms. Fahr opposes the applicant's request. She requested that the board not approve the rezone, but if they did, requested then to not allow are outlet onto Colonial way. She is concerned about how this will change the neighborhood. The Board informed Ms. Fahr that there would not he an access from Colonial way. Nis. Fahr stated that she would like to have it on record that she objects to an access on Colonial way. Mr. Rodd stated that there would he two entrances on Katherine Court, with one entrance only being for the doctors and for handicap parking. The existing entrance on 17-92 will be closed. Mr. Yosefian moved to approve per staff s recommendations. Ms. Dennison seconded. Mr. VonH rbulis abstained, all others in favor. Motion carried. The next item was to hold a Public Bearing to Rezone property at 2209 French Avenue from SR- I .Aw, Single Family Residential, and C -1, restricted Commercial, to GC-2, General Connner ial, for Dr. Quinn's Office Building. Mr. Hipes stated that Ms. Fahr's letter would be considered for this item also. Mr. Lowell stated that RC zoning is more respectful for residential. Mr. VonHerbulis stated that staff requested theca to rezone to CSC due to the existing zoning splits one lot in an odd manner. There is no record why it was zoned that way so staff requested it to continue with CSC so no enclave would be left. Mr. Lowell moved to approve per staff s recommendations. Mr. Garrett seconded. Nir. v nHerbulis abstained, all others in favor. Motion carried. The next item was to hold a Public Hearing to consider a Variance request for Dr. Quinn's Office Building located at 2209 French Avenue to reduce the north side yard setback from 10 ft. to 2.7 t. Mr. T odd stated that the reason for the variance is due to the existing structure being built 2.7 feet from the property line and to make the parking work, they would like to maintain the existing setback for the new addition. The 2.7 feet will remain grass because with the existing slope along the drainage pond to the north, it would be difficult to install landscaping. Ms. Dennison moved to approve per staff s recommendations. Mr. Kutz seconded. Mr. v nH rbulis abstained, all others in favor. Motion carried. The next item was to consider the Site Plan for a proposed 1,500 -sq. ft. addition to Dr. Quinn's Office Building located at 2209 French Avenue. PLANNING & ZONING COMMISSION MINUTES — MEETING OFAUGUST 1, 2002 PAGE Mr. Rodd stated that there would not be any additional signage on the property. Landscaping will be provided per city's landscape ordinance. Mr. Balevich stated that staff would work with the applicant regarding the landscaping. At final engineering approval, the landscaping is reviewed. Mr. lodd stated that there would be only wall pacts on the existing building and the new addition. The new addition will have the same elevation as the existing structure. Mr. Lowell moved to approve per staff s recommendations Frith the stipulation that no all packs be installed along 1 -2, staff work with the applicant regarding the landscaping, and a fence be installed along Colonial way and along the west property line adjoining the parting area behind the building. Mr. Yos flan seconded. N1r. VonHerbulis abstained, all others in favor. Motion carried. Ms. Dennison moved to approve the Minutes of the Jul} 18, 2002 meeting. Mr. Lowell seconded. All in favor. Motion carried. Mr. Kutz recommended that staff` produce a checklist for every project to ensure the site plan satisfies all items. Mr. B le ieh stated that staff has a checklist that is used and it can be provided if needed. This site was reviewed a a redevelopment, n existing site with modifications. Mr. VonHerhulis asked if the City Commission approved the moratorium and was informed that they did approve the moratorium on apartment buildings.
