MINUTES WORKSESSIO PLANNING AND ZONING COMMISSION MEETING of SEPTEMBER 2, 2001 7: P.M CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: T: Ross Robert Gary Lowell Andrew Kut Kevin Hips Steve Vaughn MEMBERS ABSENT: Bobby VonHrbulis- excused Cato Garrett- excused Caro Dennison-excused Rani o se f �i.an excused N ichael Skat- excused OTHERS PRESENT: Jay 1larder, Director of Engineering and Planning Eileen Hinson, Planner Presentation by Dianne Framer, Seminole County Public Schools, Deputy Superintendent of Operations, spoke on p for future educational facilities and her opinions of school concurrency. She stated that when she looks at concurrency and some of the legislation that cane down with growth management, The Planners Relief Act, she is not confident that it has done what people expected it to do. when she looks at extending concurrency to schools, she i concerned about its actually accomplishing what people think it will do. Ibis. Framer stated that part of their future p process is dealing with providing space for students and also making sure that as good and equitable education is provided as possible. There were times in this County when all of the money had to go to providing classrooms. Most measures of concurrency are if there is enough capacity for students. Capacity is based on the see of the classroonm. Two items that complicate capacity are the calculation of capacity and the fact that we are a countywide systenn. Ms. Kramer stated that enrollment projections are done by looking historically at how many children are born to residents of Seminole County five years previously, compare that number to TES PLANNING AND ZONING COMNESSION MEETING OF SEPTEMBER 20, 2001 PAGE 2 the number of students that enter Kindergarten, then look at the number of Kindergarteners this year, then next year as to how many of those Kindergarteners became First Graders. This process is followed all the way through the grades. In the last five years the cohort between the number of children born to residents of Serninole County vs. con into Kindergarten has steady gone down. It use to be ay more students entering Kindergarten than there were children born to residents. The birth rate is going up but the cohort coning into Kindergarten has gone down for two reasons: 1 there are ninny famili choosing to keep their students in private Kind ergarten and, 2 our growth rate as a county is that we are still growing but not at some of the higher rates that we were growing in the past. Ms. Kramer stated that she would be more than happy to spear to the Board ann ually, October or November, to keep then informed on school developments. REGULARLY LARLY SC EK EE MEETTNG Nk. Robert called the meeting to order at 7:15 P.M. The first item on the Agenda was to hold a Public Nearing to consider amending the Future Lard Use Map of the Comprehensive Plan Small Scale Amendment) changing the land use classification from HD R, High Density Residential to GC, General Commercial for property addressed as 4249 Orlando give. Mike Hatta ay stated that the zoning will allow multi -fly, general comm ercial and indoor wholesale and storage uses. His intent of this property is for a project that he has been working on for a number of years. He concurs with Staffs reconumndatlons and the Development Order. M[r. Kutz moved for approval per Staffs recommendations. Seconded by Mr. Hipes. All in favor. Motion carried. Next on the Agenda was to hold a Public Nearing to consider a rezone request for property addressed as 4249 Orlando give from MR-3, Multiple Family Residential, to GC-2, General Conunercial. Mr. Hatta ay represented this request. He stated that his intention is not to do any apartments. Edna Swigonsi stated that she lives across the street and did not oppose the request but that she did not understand what is going on. Mr. Robert explained that she is in the County and falls under the County's zoning jurisdiction. He stated that if she were to come into the City, the City would keep the same zoning classification. Kutz stated that it seems appropriate to amend the motion to make this subject to conditional use approval. l r. Lowell has a problem with approving the request for industrial uses without a site phi& Mr. Hipes, Mr. Robert and Nft. Vaughn in favor of the motion. Mr. Lowell and Nft. Lutz in opposition. Motion carried. The next item was to hold a Public Nearing to rezone property located at 4095 Smith Canal Load from ACS, Agriculture, to GC -2, General Conunercial. Carl Smith, 365 Aulin Avenue, Oviedo, was present representing the owner. He stated that the owner ors property adjacent to this piece that is zoned GC-2. He noted that Staff is reconimending the Property be rezoned to RI -1 and asked if this would restrict the owner in the use of the property in relation to what he already ovens. Mr. Mar der stated that this is a better zoning for the entire inurtril park. It will not restrict the owner. Richard cardignio, owner, stated that the only problem is that he has one parcel now with to different zonings. Mr. Marder stated that his other property is zoned GC -2 but the whole area south of that industrial park where Coisco is and eerythg else on Codisco Way is all I -1 zoning, including some of the portions on Northstar Park on Central Park Drive. The whole area should be R1 -1 is why Staff has made this recommendation. The RI -1 zoning is more conducive to what the applicant wants to do, it gives him a lot more industrial. There being no one else to speak in favor of or against the request, Mr. Lowell moved to approve subject to Staffs recommendations. Seconded by IIr. Lutz. All in favor. Motion carried. The next hero was to hold a Public Meaning to consider a Conditional Use request for a boarding house with an associated daycare facility at 1 701 Brisson .Avenue in an AG, Agricultural Zoning District. Tessa E. Duncan, JUTE, Inc., stated that she was lead to believe that the recommendation would be for approval. Earlier today she had faxed a letter asking that the request be postponed so that they can better prepare. A boarding house is not an appropriate name for what will be done at this location. This will be a private home for teenage mothers. Nigh school mothers that would normally drop out and become homeless. This wili provide a home where they can continue their education and provide a better quality of life so there would not be repeated pregnancies. ibis. Duncan asked to postpone the request until they can prepare a better presentation. Mr. Kutz moved to table until October 4th. Seconded by Mr. Dowell. All in favor. Motion carried. Mr. Lutz stated that he would question 10 people in that small of a structure without � "Id It PLANNING AND ZONING COMMISSION MEETING OF SEPTEMBER 20, 2001 PACE having an idea of how it will be arranged. It might be good idea to give the Conm�ssion some idea of how things are to be arranged. Ms. Duncan stated that this is not a smafl property, it is 1.2 acre facility with 8 bedrooms. This is a historic home with h uge bedrooms which each participant will have their own bedroorn. Also, there are two f ree standing buildings on the property with two separate addresses. No modifications will have to be done to the house. Next on the Agenda was a Public Hearing to consider a Conditional Use request for outdoor display of used merchandise at 2535 French Avenue in a GC -, General Commercial District. Johan Pursuad, father owns 2531 French Avenue, stated that they are not against the request, but the City stopped his father from putting his produce outside. He asked if this applicant is allowed to put his chairs outside, why is his father not allowed to display his produce. Mr. M r er stated that the applicant is trying to get permission to display outside and Stab` has recommended denial to have his fumiture outside. It was explained to Mr. Pursuad the difference being that Nft. Cohen did not have a change of use when he moved into that building and his father did. The change of use was the trigger for the upgrades. Mr. Dowell moved to deny the Conditional Use per Staffs reconmmend.ations. Seconded by Mr. Hipes. Mr. Kutz stated that he is opposed not because the applicant is not here but based on Staffs reconunendations and the interested party's input. Mr. Dowell stated that he viewed this more as a comment on the fact that the applicant decided not t show as well as the Staff s comments. All in favor. Motion caned. Mr. Kutz stated that he would life to see a guideline on w hat Staff would see as an appropriate guideline for the utilization of outdoor display In the community and where it fits in with what we are trying to do with the zoning ordinances. Also, we should see some sort of a standardized procedure for conditional uses. We need to understand under what situations would a conditional use not be necessary but the actions could still be incorporated into a development order. He would like to know, on conditional uses, if we are going to require a survey or site plan and at what point in the site plan process will elevations be seem. He asked if a site plan could be required at the rezone level or does it have to be codified. Mr. Hlpes moved to approve the Minutes as circulated. Seconded by Mr. Lutz. All in favor. Motion carried.
