CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: Otto Garrett Ross Robert Rami Yosefian James Valerino Kevin Hipes Bobby VonHerbulis Andrew Kurz MEMBERS ABSENT: Carol Dennison Michael Skat OTHERS PRESENT: Russ Gibson, Land Development Manager Marion Anderson, Recording Secretary Eileen McDowell, Planner Mr. Robert called the meeting to order at 7:00 P.M. Mr. Robert informed the Commission regarding Item 2 on the Agenda, a request for a Conditional Use for property located at 500 Aero Lane to establish indoor manufacturing using hazardous materials, that the Commission has received a letter from Paul Lavoie of Metro Sewer Services requesting that they be removed from the tonight's docket. Mr. Yosefian moved to remove from the Agenda. Seconded by Mr. VonHerbulis. All in favor. Motion carried. The first item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 712 W. Lake Mary Blvd. in an RC -1, Restricted Commercial Zoning District, to establish an automobile cleaning establishment (car wash with detailing, window tinting and paintless dent removal). John Reynolds, American Civil Engineering, stated that he was representing Scott Scruby who is the owner /developer of the proposed car wash. Mr. Scruby is currently operating a detail shop in Maitland on 17 -92 and hopes to move his business to this piece of property. Mr. Reynolds stated that they have reviewed Staff's comments and have no problems with them. MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 1, 2001 PAGE Mr. Scruby stated that their hours of operation would be from 8:30am to 6:OOpm, Monday through Saturday, and 10:00am until 4:00pm on Sundays. There will be approximately 10 to 15 employees. He is proposing a full service car wash and detail facility. Mr. VonHerbulis stated that he is concerned with the 8' equipment building being as close to the property line as it is, within 5'. Mr. Reynolds stated that it will be within the setback. They will not seek any type of variance. They will build this facility within the current code. Mr. VonHerbulis stated that Mr. Scruby has stated that there will be between 10 and 15 employees possibly at this location, but yet there are only 15 parking spaces showing, which means he can't have any patrons. This needs to be addressed in the site plan. Mr. Hipes noted that this facility will be close to residential and asked about the noise factor. Mr. Reynolds stated that this facility would be similar to a Shiner's Car Wash. At the end of the tunnel there will be a blower to blow the water off with some noise associated with that. The vacuum will also be going on at the other end of the tunnel. This would be about the extent of the noise. The BP Gas Station next to this facility is somewhat excited about this happening because they are a gas station without a car wash. This facility will tie into the gas station's lift station. They will also have a cross access easement between the two properties. When Lake Mary Blvd. was widened, they installed a 24' wide driveway which will be utilized. John Gardner, 6124 Cheshire Lane, Orlando, was present. He stated that his concern is with the noise. He owns 6 of the duplexes in the neighborhood. He stated that the neighborhood is very well kept. He would like to see what the provisions are so that his tenants will not be driven out of their houses during the day because of the noise. Mr. VonHerbulis questioned whether the 6' high concrete block, stucco wall, and landscaping would apply to the duplexes. Mr. Gibson stated "yes ". John Johnson, 7510 Eldot Lane, Orlando, was present. He stated that he owns a neighboring duplex. He would like to know how this facility would affect his tenants. He stated that because of their retention pond, he is concerned with his drain field that is not elevated. David Pent, 100 N. Driftwood Lane, stated that he is concerned with the drainage because of his in ground septic system. He is concerned with the noise especially because of the late hours on the weekends. Ms. Pent noted that there is a culvert on the northeast corner running east and west, and if it is covered up the drainage from the entire block will be deterred. Mr. Kutz asked if an acoustical study could be done to determine the existing decibel level on the property and establish as part of the requirements for development that the decibel level should not increase more than 5 decibels or something like that. Mr. Gibson stated that he was not aware of any studies such as this being done before, but that it is in the realm of possibilities. In the Land Development Regulations there is a specific noise threshold that establishes a basis for which there could be complaints if noise exceeds those levels. Mr. Kutz stated that there is no reason why the Commission can't expect and ask the Civil Engineer to include this information as part of the site MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 1, 2001 PAGE plan information. He wondered if may be the Commission should be asking for, as an element of the site plan, a traffic study as to what actually might be generated by this activity. Mr. Reynolds stated that they would be happy to meet with the surrounding residents to meet both the client's and the neighbor's needs. They want to be good neighbors. They don't want to start off on the wrong foot. They have a site plan that can be changed. They would like to do something that is going to fit in with the character of the neighborhood. The car wash is a pre -fab system. He will check on the noise specifications. The central vacuum system can be enclosed in the equipment building. Mr. Yosefian moved for approval with all of Staff's recommendations. Seconded by Mr. Hipes. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 4249 Orlando Drive in a GC -2, General Commercial Zoning District to establish multiple family residential use in a GC -2, General Commercial Zoning District. Andy Russo, 1977 Dundee Drive, Winter Park, and Brian Denham, Lochrane Engineering, were present. Mr. Russo stated that they are requesting a conditional use for a strip along the east side of the property that is zoned GC -2, that is off of 17 -92 bordered by County Home Road and County Road 427. The rest of the property is zoned MR -3. Mr. Gibson explained that when the property was rezoned, they delineated a certain area. There was no specific project designed for that specific area that was rezoned for MR -3. They have now realized that they would like to utilize a larger area that encroaches into the general commercial. They are not modifying the commercial development that was proposed for the gas station tract. Maybelle Gay spoke in opposition. She stated that she and her sister own 4+ acres of the property adjoining this site. She asked how many apartments would be on this property. She asked that the traffic on 427 be considered. Mr. Russo stated that there would be 160 units, 3 stories high. Security gates are being considered. Emma Swigonsky stated that she is concerned with County Home Road. It is approximately 900' long and that before a turn can be made, 9 to 12 cars are backed up. The traffic is terrible on County Home Road and 427. Brian Denham stated that with the expansion of 427, Ms. Gay should have an easier time of getting out of her property. He stated that they believe that the majority of traffic will be using 17 -92 Mr. VonHerbulis moved for approval of the Conditional Use with staffs recommendations and also that it meets all of the Land Development Regulations. Seconded by Mr. Kutz. Mr. Valerino stated that he was in favor because if the Commission denied it the density would be almost the exact same in number. All in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 1, 2001 PAGE Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 3780 Orlando Drive to establish multiple family residential use in a GC -2, General Commercial Zoning District, and to allow open drainage cuts below the seasonal high water table within a secondary well field protection zone. Scott Culp, Sandspur Housing, stated that the request is proposed as a senior independent living community and that there will be no assisted or nursing health care provided, other than health screenings. There will be 160 multi - family units, 1 and 2 bedrooms, 3 -story with an elevator. Mr. Culp stated that there will be no food or laundry facilities. It will be restricted to seniors 55 and above, unless there is a disability. Brian Denham, Lochrane Engineering, stated that the open cut drainage cuts are to allow for the construction of a wet bottom retention pond because the facility will be within 2000' of a secondary well field protection zone. Mr. Culp stated that they are not planning to have vehicular access to the plaza, they are planning on working with and providing pedestrian access because most of the residents won't be driving very far. Scott Cardell, 104 Wax Myrtle Drive, spoke in opposition. He presented a petition with 45 signatures that are in opposition to the request. He asked that a barrier separation be provided from this community and their community if this is approved, and that there be no access whatsoever to Live Oak Blvd. They are opposed to the traffic and the impact its going to have on their homes. They are already affected greatly by the noise from the Airport, the Greeneway is encroaching on the other side of their community, the impact of Albertsons', as well as the traffic that drives through their community. Steven May, 113 Wax Myrtle, stated that his concern is with the traffic. The traffic is terrible. There are no sidewalks in the area and the children walk to school. He asked how would the drainage be affected because during the rainy season, they have standing water. Brenda Whitwam, 102 Wax Myrtle Drive, stated that she lives on the corner of Wax Myrtle and Live Oak. She has two young children that cannot play in the front yard due to the speed and amount of traffic. She stated that they have wanted a sidewalk for years and cannot have one because there is not enough traffic. Children in the neighborhood will be at risk. Ann Steel, 109 Sweet Gum Court, stated that she is mad about the prospect of having more traffic in the neighborhood. David Hanson, 109 Sweet Gum Court, was also concerned with the traffic. Felipe Cordova, 101 Sweet Gum Court, spoke in opposition. He stated that a 3 -story building will invade his privacy. He stated that not only would he be deprived of his privacy, but he will absorb the cost of someone living on that property out of his taxes. MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 1, 2001 PAGE 5 Mr. Valerino asked what could be put on the property now without having to get any permission. Mr. Gibson explained that the property is zoned General Commercial which would allow retail sales and service establishments like those that exist in the shopping center, business and professional office uses, hotels, general retail restaurants, there could be an opportunity to get some automotive uses, auto rentals, just general retail commercial operations that are permitted by right. Mr. Valerino moved to table because he was interested in what the rent range would be. Seconded by Mr. Kutz for discussion. Mr. Valerino stated that he feels that this issue is important. It was a question that was asked several times which could not be answered. Mr. Culp stated that the rent would be between $400 and $600 per month. Mr. Kutz and Mr. Valerino in favor of the motion. All others opposed. Motion failed. Mr. Hipes moved to approve subject to Staff's comments and that the developer save the trees bordering residential. Seconded by Mr. VonHerbulis. Mr. Valerino and Mr. Kutz in opposition. Motion carried. The next item was the consideration of the Site Plan for Universal Maps, a proposed 45,480 sq. ft. warehouse addition at 201 Tech Drive. Mr. Gibson stated that Mr. Holsombach had expressed his regrets in not being able to attend tonight's meeting. Mr. VonHerbulis asked if there had been anything handled as far as the site being over the existing dump. This site was the existing Seminole County dump for 40 to 50 years. He wanted to make sure that Staff understands that something needs to be done, it just can't sit on top of the existing drain. Mr. VonHerbulis also asked, with the back of Universal Map facing Upsala Road and facing the Greeneway, if something could be done to make the back of the building look a little bit better than the back of a building. He does not want to see a 540' wall of a building 24' high all the way down. There needs to be something on the back of this building even if it's a couple of false canopies, some architectural enhancements. Mr. Yosefian moved to approve. Seconded by Mr. VonHerbulis. Motion carried unanimously. Mr. Kutz asked if there would be a comprehensive study of vehicles prior to or in correlation to the comprehensive plan of sidewalks. Mr. Gibson stated that he was not aware of there being a nexus with the analysis or the study of the sidewalks citywide with traffic. Mr. Kutz asked if there was any effort underway or anticipated to do a traffic analysis or study that will be of benefit in the crowded traffic areas of the City, either out - source or by Staff. Mr. Gibson stated that he was not aware of the City commissioning such an effort. Mr. Kutz stated that rather than blow it off like Staff has done for some time now, we need the traffic study before a master plan can be developed. If we don't have a master plan, we are never going to have controlled growth. Mr. VonHerbulis disagreed that Sanford has traffic problems. He stated that Sanford is growing, Sanford has some growing pains. MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 1, 2001 PAGE Mr. Kutz stated that for example, the historic area, there is an internal traffic problem, you can't move around in there, we will never be able to clean that area up, we will never be able to effectively feed out of that area into the adjacent areas, and from the adjacent areas into that area without some kind of traffic study. We aren't going to be able to decide where to put the sidewalks, we aren't going to be able to decide where to put the parking, we aren't going to be able to decide where to put the infrastructure until we have decided which of the roads will be cast in stone, if any of the roads are going to be one -way, widened. We have to have some kind of a backbone circulation in the downtown area, at least, in order to be able to begin some kind of a rational, controlled, plan to develop growth. Without better knowledge, understanding, and better studies on the traffic in the community, we are never going to get a really rational complete handle on controlled growth.
