The first item on the Agenda was to held a Public Hearing to Consider a request for a Conditional. Use for property located at 2588 S. Elm Avenue in a GC -2, General Commercial Zoning District, for the purpose of auto repair. Sherman Wi lliams, 2588 S . Elm Avenue Sanford, was present. He stated that he has been at this location for almost eight years. Because of a heart condition, he has stopped doing heavy work and started to do small repairs and air - Conditioning repairs. There will be no cars ; left overnight and the site will stay clean because there will be no greasy work. Mr. Gibson explained that the site was cited by Code Enforcement because the site fell into a state of disrepair because of the applicant's health problems. The Code Enforcement Board mandated that.due to the fact that there was not a conditional use permit on file with the City establishing the auto repair facility, that he be remanded to the Planning and Zoning Commission to resolve this. Calvin Day, Property Manager at Park Avenue Mobile Horne, spoke in ,r w� MINUTES PLANNING AND ZONING COMMISSION MEETING OF AUGUST 17, 2000 n n 0- V 7 opposition. He stated that Mr. Williams is a very good neighbor as far as personalities go. There has been many citings by the City to clean up the property. There have been cars on the right-of-way on both sides of the four -way stop sign, so the intersection can't be seen. He stated that it affects his business across the street. In the chained area there are two large dogs that stay outside all the time. At night, the dogs bark and upset the neighbors. He stated that the area is unsightly and resembles a junk yard. Amy Reed, 2600 Elm Avenue, spoke in favor of the request. She stated that she has no complaints about the dogs barking. Barking occurs only when someone goes over there who has no business over there. As far as the parking on the street, no one stops at the stop sign anyway. She is jealous of his roses and cacti. She stated that she sees nothing wrong with this. operation. Ray Familio spoke in favor. He stated that he is one of the people who use Mr. Williams' services. He has always been treated fairly. Robert Greenwood, 2606 S. Elm Avenue, spoke in favor of the request. He does not have a problem with the dogs as long as their not getting out terrorizing the neighborhood. He stated that there is no sense in denying Mr. Williams to make a living. Bonnie Reed, 2600 Elan Avenue, spoke in favor of the request. She stated that she,has never had any problems with Mr. Williams. The only time the property was in disrepair is when he was ill. Mr. Williams stated that he could put the dogs in the shop at night so the neighbors won't hear the barking. Another reason the dogs bark at night is because of the people living in the woods and sleeping in vans at the labor work place. Ms. Dennison moved to approve the Conditional Use based on Staff's stipulations. Seconded by Mr. VonHerbulis. All in favor. Motion Carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF AUGUST 17, 2000 niko- ' - 1 The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 118 S. Sanford Avenue in a SC--3, Special Commercial Zoning District, for the purpose of an accessory dwelling unit. Joseph W. Duggar, 118 % S. Sanford Avenue, was present. He stated that he needs a place for his grandson that is going to school. He is trying to help him with his living conditions. His long range plan is to use half of the front for a small business or office space. When his grandson finishes school, he hopes to rent the apartment to a single person. Mr. Robert moved on approval of the Conditional Use for the accessory dwelling unit based on the applicant meeting the standards for conditional uses and that there be a proviso that the occupancy of the additional unit be conditioned upon the owner of the property living in the main dwelling unit. Seconded by Mr. Hipes. All in favor. Motion carried. The next item was the consideration of the Site Plan for Facemyer, a proposed 7,999 square foot warehouse located at 31 Coastline Road. Dick Holsombach, 511 Central Park Drive, Sanford, was present. He stated that it will be occupied by the owner of the building . which owns an air conditioning business called Facemyer Air Conditioning. They have come to agreement with all of Staff's recommendations. Mr. Robert moved for approval of the site plan. Seconded by Ms. Dennison. All in favor. Motion carried. Next was the consideration of the Site Plan for Ugly Duckling Auto Detailing Center located at 2451 McCracken Road. John Froscher, Florida Land Design, 222 S. Westmonte, Altamonte Springs, was present. He stated that they have obtained conditional use approval. This site will be a regional facility for the Ugly Duckling distribution system. Seconded by Mr. Hipes. All in favor. Motion carried. Next was the consideration o f the Site Plan t o redevelop the Aristocrat Volkswagen dealership located at 4167 Orlando Drive. Mr. Langford with Suncoast Auto Builders in Clearwater, and Michael Wilson, Civil Engineer, were present. Mr. Langford stated that this will be a new Volkswagen prototype facility which is going in on an existing paved lot. The existing retention and existing storm retention will be slightly modified. Larry Bishop, owner of the facility, stated that there are no junk vehicles behind the fence in the wetlands. This is a world wide design. This is the only building that Volkswagen will allow him to build. Mr. VonHerbulis moved for approval of the site plan per Staff's recommendations with the exception of the conditional use for outdoor storage that is not needed for this site. Seconded by Mr. Hipes. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 2851 Jewett Lane in a MI -2, Medium Industrial Zoning District for the purpose of an increase in fence height requirements: 4 required, 8' proposed, a variance of 4 1 . Mr. VonHerbulis abstained due to a conflict of interest. Steven Esler, 790 Monroe Road, represented this request. Mr. VonHerbulis stated that the 8' fence would come around the front and back of the property separating the staging area. They had requested a 4' fence to go around the retention pond, but Staff has recommended that this be 6 There is no objection to a 6' fence being installed around the retention area. Mr. VonHerbulis stated that they are requesting that the fencing be galvanized. The next item was a Public Hearing to consider a request for a Conditional use for property located at 112 central Park Place in a RI -1, Restricted Industrial Zoning District, to allow outside storage adjacent to a proposed warehouse (weather Masters). Mr. VonHerbulis abstained due to conflict of interest. Steven Esler, 790 Monroe Road, stated that the request is for galvanized chain link fencing. Mr. VonHerbulis stated that there is a double gate on each side and -they are not objectionable to putting in slats on the front part that is straight facing the road. Mr. Hipes moved to approve subject to Staff's comments with a note that the galvanized fence is fine other than around the very front in front of the storage area which is to be opaque. Seconded by Mr. Garrett. All in favor. Motion carried. The next item was the consideration of the site Plan for Weather- Masters, an 18,600 s.f. window and screen door warehouse facility located at 112 central Park Place. Mr. VonHerbulis abstained due to conflict of interest. Steven Esler, 790 Monroe Road, represented this request. Mr. VonHerbulis stated that the parking spaces are 18' in length due to the trees that are 23" in diameter being saved. Mr. Gibson stated that there is a 2' overhang into a landscape area. Mr. Robert moved for approval per Staff's recommendations. Seconded by Mr. Hipes. All in favor. Motion carried. The next item was to consider the Site Plan for Chida Medical Office Building, a two story, 9,425 s . f . medical office facility located at 303 Mangoustine Avenue. All in favor. Motion carried. Mr. Garrett stated that at Randall Mechanical, 115 Coastline, there are pallets and spools, and trash in the driveway. Also, at Brown's Gym, the retention pond out front stays full. He asked that Staff check on these items. Mr. Gibson stated that the City has received numerous requests for assistance regarding this retention pond, but because of the tragedy, he has been holding off on sending a letter. Mr. Hipes suggested that the City arrange a half day bus tour of some things that were approved that are nice and some that are not so nice. The Commission looks at it on paper and never sees it again. Staff is to check on this. There being no further business, the meeting adjourned at 9:00 P.M.
