Park Avenue, Sanford, Florida 32771, applied, on behalf of the owners, to the City of Sanford, pursuant to the controlling provisions of State law and the I I P a o e Code of Ordinances of the City of Sanford, to have the subject real property rezoned to the PRO, Parks, Recreation & Open Space, zoning classification/district from the existing AG, Agriculture, and RI-1, Restricted Industrial, zoning classifications /districts; and Whereas, the City's Planning and Development Services Department has conducted a thorough review and analysis of the demands upon public facilities and general planning and land development issues should the subject rezoning application be approved and has otherwise reviewed and evaluated the application to determine whether is comports with sound and generally accepted land use planning practices and principles as well as whether the application is consistent with the goals, objectives and policies set forth in the City's Comprehensive Plan; and Whereas, during the course of the reviews, it was noted that the real property adjacent to the real property, which is the subject of this Ordinance (3430 Cameron Avenue totaling approximately 96.5 acres), is under construction in that, on July 22, 2013, the City Commission enacted Ordinance Number 4294 amending the future land use designation of the subject real property as recommended by the Planning and Zoning Commission on May 16, 2013; and Whereas, on July 9, 2015 the Planning and Zoning Commission of the City of Sanford recommended that the City Commission approve the subject rezoning as set forth in this Ordinance; and Whereas, professional City planning staff, the City's Planning and Zoning Commission and the City Commission have determined that the proposed the rezoning of the subject real property as set forth in this Ordinance is consistent with the Comprehensive Plan of the City of Sanford, the land development regulations of the City 21P i ge of Sanford, and the controlling provisions of State law; and Whereas, the City Commission of the City of Sanford, Florida has taken, as implemented by City staff, all actions relating to the rezoning action set forth herein in accordance with the requirements and procedures mandated by State law including, but not limited to, all matters that are required in the context of a quasi-judicial proceeding. Now, therefore, be in enacted by the People of the City of Sanford, Florida: Section 1. Legislative Findings and Intent. (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the application relating to the proposed rezoning of the subject real property as well as the recitals (whereas clauses) to this Ordinance. (b). The subject real property, which is 12 acres in size, is located at 3401 Cameron Avenue and is assigned Tax Parcel Identification Numbers 03-20-31-5AY-0000-0230, 03-20-31-5AY-0000-0240 and 03-20-31-5AY-0000-0280 by the Property Appraiser of Seminole County. (c). The real property which is the subject of this Ordinance, and which is currently undeveloped as it is vacant except for groves of citrus trees, is located on the north side of East Lake Mary Boulevard and east of Cameron Avenue. The real property owners are requesting to rezone the real property, as set forth in this Ordinance, for the purpose of developing improvements related to the sports complex currently under construction by Seminole County on the adjacent 96.5 acre site located at 3430 Cameron Avenue. The owners have also applied for an associated amendment to the City's Comprehensive Plan to attain consistency and allow the development. An analysis 3 111 a - e comparing the economic benefits of developing with commercial and industrial uses which are currently allowed versus a sports complex which requires changing the future land use map was prepared for the adjacent 96.5 acre site which is currently under construction. The analysis determined that if the site developed according to land uses permitted in AIC, Airport Industry and Commerce, the property could potentially yield $103.9 million in economic impact to the community while the analysis indicated over $19.1 million would be generated if the site was developed as a sports complex (ball fields). A stated goal of the project is that the entire sports complex will generate millions of dollars for the local economy by attracting teams, fans and associated personnel and activities. (d). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. Section 2. Rezoning of Real Property /Implementing Actions. (a). Conditions of development relating to the subject real property may be incorporated into the subsequent pertinent development orders and development permits and such development orders and development permits may be subject to public hearing requirements in accordance with the provisions of controlling law. Section 3. Incorporation of Map. The map attached to this Ordinance is hereby ratified and affirmed and incorporated into this Ordinance as a substantive part of this Ordinance. Section 4. Conflicts. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Non - codification. This Ordinance shall be not be codified in the City Code of the City of Sanford or the Land Development Code of the City of Sanford; provided, however, that the actions taken herein shall be depicted on the zoning maps of the City of Sanford by the City Manager, or designee. Section 7. Effective Date This Ordinance shall take effect immediately upon enactment, and effective date, of the Ordinance relating to the associated amendments to the City's Comprehensive Plan, to wit: Ordinance Number 4348. BACKGROUND: The approximate 12 acre site is located on the north side of E. Lake Mary Boulevard and east of Cameron Avenue. The property owners are requesting to rezone the property from AG, Agriculture and RI -1, Restricted Industrial to PRO, Park, Recreation and Open Space for the purpose of developing improvements related to the sports complex currently under construction by Seminole County on the adjacent 96.5 acre site at 3430 Cameron Avenue. The owners have also applied for a comprehensive plan amendment to change the future land use map designation from AIC- Airport Industry and Commerce to PRO - Parks, Recreation and Open Space to be consistent with the proposed PRO zoning designation. On June 10, 2013 the City Commission approved the rezone of 96.5 acres on the adjacent site currently under construction at 3430 Cameron Avenue from AG, Agriculture to PRO - Parks, Recreation and Open Space. On July 9, 2015 the City of Sanford Planning and Zoning Commission recommended approval to rezone 12 acres at 3401 Cameron Avenue from AG, Agriculture to PRO - Parks, Recreation and Open Space subject to approval of the proposed comprehensive plan amendment. In addition, on July 9, 2015 the Planning and Zoning Commission also recommended approval to the proposed land use change from AIC - Airport Industry and Commerce to PRO - Parks, Recreation and Open Space. On August 10, 2015 the City Commission approved the first reading of Ordinance No. 4349 as recommended by the Planning and Zoning Commission. The City Clerk advertised notice of the public hearing in the Sanford Herald on September 6, 2015. LEGAL REVIEW: This matter has been reviewed by the City Attorney.
