The first item on the Agenda was to hold a Public Hearing to consider a request for a conditional Use for property located at 531 N. Palmetto Avenue in a SC -3, Special Commercial zoning District for the purpose of a fuel tank. Tax Parcel No: 25-13-30 - 515 -0000 -0070. Owner /representative: Charles J. Volk. Bryan Volk, 531 N. Palmetto Avenue, was present for representation. He presented the Commissioners with a rough sketch of the site plan. Mr. Volk stated that this would be a 3,400 gallon, gasoline only, tank. The new tank will be updated as far as current standards and will have double lined pipes. The existing tanks will be sealed off and left in place. He stated that above ground tank will have containment underneath as required by EPA. The new tank will be located quite a bit of distance from the existing tanks, about 100' to the north. Mr. Volk stated that he has no intention of putting in any more tanks. Mr. Marder noted that the Department of Environmental Protection will inspect the tank to make sure all requirements are in place.. Mr. Skat moved on approval based on Staff's recommendations. Seconded by Mr. Robert. A11 in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 2604 S. Orlando Drive in a GC -2, General Commercial Zoning District, for the purpose of automobile resales. Tax Parcel No: 01-- 20- 30 -504- 1500 -4090. Owner: Alberta Hall. Representative: Sandra Lebron. Sandra Lebron, 2604 S. Orlando Drive, stated that she has been selling used autos for a number of years. She has moved to Florida and would like to establish an auto resale business. She has wholesaled cars only in NY. She stated that there would be no repairs, no painting, and no bodywork. Ms. Lebron stated that she would like to have 5 or 6 cars along 17 -92 and no more than 20 vehicles on the property at any one time. There will be cars and pick -up trucks. MINUTES PLANNING AND ZONING COMMISSION MEETING OF JANUARY 22, 1998 PAGE 2 Ms. Lebron stated that she had looked for lease property not far from where she lives and found that this site would be good for her business. She noted that the display area would basically be a holding area. She now has 6 vehicles. Mr. Marder stated that the applicant would need site plan review prior to commencing business. The sketch that was presented does not meet site plan criteria. Ms. Lebron stated that there are several other car lots in the area that utilize the grass for parking. She stated that the owner of the property told her that the property was once used as an auto business. She stated that she will be renting just the northerly part and that there is a real estate office on the other side. Bob Ball, 2220 French Avenue, stated that he owns the adjoining property. He stated that he has found that with small car dealers, to have any luck at all, they would soon have 20 vehicles on property. He stated that he is concerned that the car lot will get a little larger than what they say and parking would overflow onto his property. There is a flimsy fence separating the properties now. He noted that the State requires that there be a separation of the display area from where the employees park and that this property doesn't have this kind of room. Mr. Ball requested that they put a 5' chain link fence on the north border. Ms. Lebron stated that a State inspector suggested that a barrier be put up. She put in a chain. She stated that she is not planning to go beyond what she is leasing. Mr. Robert moved for approval per Staff's recommendations. Seconded by Mr. McClanahan. Mr. Skat stated that an auto sales storage area on 17 -92 should be out of public view. Mr. Hattaway noted that it is consistent with the LDR, the Comp Plan and that there is Staff approval. Mr. Skat noted that the car dealership would impact the site. Mr. McClanahan stated that this is an open economy situation and that the Commission could not tell people where to invest their money. He noted that the Commission could ask the City Commission to restrict the uses. Mr. Stogner stated that this Commission has to regulate and that he is concerned with how many car lots the City will allow. Mr. Skat and Mr. Valerino in opposition. All others in favor. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 4106 Orlando Drive in a GC -2, General Commercial Zoning District, for the purpose of a warehouse and distribution center for bakery goods and a small office with retail sales. Tax Parcel No: 11- 20- 30 -5AN- 0000 -0010. owner: AMPROP Corp. Representative: Roland Dove, Spring Engineering. Roland Dove, Spring Engineering, was present representing Flowers Bakery. He stated that Flowers is the largest baker of bread and bakery goods. This site will be a distribution facility. A daily semi -truck will bring in fresh baked goods, and vans come in and take the goods around to various stores. The distribution facility is a 16 route distribution center. This will be 900 square feet of retail where day -old bread and bakery goods are sold. She stated that she is concerned with big trucks entering at all times of night that would interfere with everything. Mr. Dove stated that there would be only one semi -truck to come in each morning around 3:30. Bakery goods would then be picked up between 5 and 6:30 by vans. The vans would return to the facility between 3 and 4 in the afternoon. The semi comes-in in the rear, and vans come in at the side. Mr. Skat moved on approval based on Staff's recommendations. Next was the consideration of the Site Plan for Flowers, property located at 4106 Orlando Drive in a C -2, General Commercial Zoning District, for a warehouse and distribution center for bakery goods. Tax Parcel No: 11- 20- 30 -5AN -0000 -0010. Property Owner: AMPROP Corporation. Representative: Roland Dove - Spring Engineering. Mr. Dove stated that he had reviewed with Staff the separation requirements and was asked to provide a cross access easement. His client is agreeable to doing this. He stated that it would not be appropriate to provide a wall along the west of the property because of the cross access easement. Mr. Dyal moved on approval per Staff's recommendations. Seconded by Mr. Skat. All in favor. Motion carried. Next was the consideration of the Site Plan for a proposed 15,000 sq. ft. warehouse /office building for Marine Fasteners on lots 24 and 25, Sanford central Park, Phase 2 (Plat is pending final approval), located at 120 Sun Drive in a RI -1, Restricted Industrial Zoning District. Property Owner: Marine Fasteners. Representative: Parks Wilson - Wilson and Company. Parks Wilson, P. O. Box 620430, Oviedo, stated that this is a stainless steel fasteners business. Marine Fasteners is growing and is in need of a larger facility, a better distribution facility. Mr. Skat moved on approval based on Staff's recommendations. Seconded by Mr. Stogner. All in favor. Next was the consideration of the Site Plan for a 7,950 sq. ft. warehouse addition to Crankshaft Rebuilders located at 1200 Albright Road in a MI -2, Medium Industrial Zoning District. Tax Parcel No: 34 19- 30- 501 - 0040 -OOA1. Owner: R & M Manufacturing. Representative: Robert VonHerbulis - McKee Construction. Bobby VonHerbulis, McKee Construction, 2290 W. Airport Blvd., stated that this building will be an overflow for the warehouse. He stated that the owner refurbishes crankshafts. The business is booming. This will be dead storage of finished crankshafts, awaiting shipping. Mr. Robert moved on approval based on Staff's recommendations . Mr. Skat seconded. All in favor. Motion carried. Mr. Marder reported that DCA notified the City objecting to the plan amendment for Twin Lakes on several elements. Mr. Gibson presented the Final Plat for Sanford Central Park Phase II to the Commission for consideration. Mr. 5kat moved on approval. Seconded by Mr. Stogner. . All in favor. Motion carried. INC. - Request conditional use permit to establish an above- ground fuel tank in an SC -3, Special Commercial Zone located at 531 North Palmetto Avenue. Site is Zoned SC -3, Special Commercial and includes a boat maintenance, repair, rental and sales business with access to Lake Monroe. Various equipment and tools related to boat repairs and maintenance are stored outdoors on the site. 2. The applicant requests a conditional use permit to establish an above - ground fuel tank that would be generally located at the southeast corner of the site. 3. Recommend approval of the request to establish an above - ground fuel tank at the Monroe Harbour site based on similarity of proposed fuel storage tank with other equipment and tools already located outdoors on the site. CARISMA AUTO WHOLESALER/HALL - Request conditional use permit to establish used automobile sales in a GC -2, General Commercial Zone located at 2604 South Orlando Drive. Site is Zoned GC -2, General Commercial and is located on the west side of U.S. Highway 17& 92. The site includes various improvements including a building, a handicapped parking space and driveways. 2. In 1994 the Planning and Zoning Commission approved a conditional use permit to establish trailer and truck rentals on the site. In 1996 the Planning and Zoning Commission approved a conditional use permit to allow a second detached sign on the site. 3. The applicant requests a conditional use permit to establish used automobile sales and has submitted a site plan that reflects automobile display proposed for northerly and southerly portions of the site fronting U.S. Highway 17 & 92. 4. Used automobile sales are located north of the site. Trailer sales are located near the site on the east side of U.S. Highway 17 & 92. Various automobile - oriented businesses are located along U.S. Highway 17 & 92 in the general vicinity of site. Planning Recommendations - Page 1 5. Recommend approval of the conditional use permit to establish used automobile sales based on similar uses already located in the immediate area and similarity with uses previously approved for the site. SPRING ENGINEERING /AMPROP CORPORATION - Request conditional use permit to establish warehousing for property Zoned GC -2, General Commercial located at 4106 South Orlando Drive. Site is Zoned GC -2, General Commercial, includes approximately 1.77 acres and fronts U.S. Highway 17 & 92. 2. Site is adjacent to automobile sales and service, vacant commercial land and an undeveloped site Zoned MR -3, Multiple Family Residential. Nearby uses include condominiums and a public safety complex. 3. GC -2 Zoning requires a conditional use to establish warehousing as a land use. 4.
